Is Alan liable for solicitation?
Solicitation is when the defendant, with an intent that another person commits a crime, asks, entices, advises, incites, orders, or otherwise encourages that person to commit a crime.
Here, Alan asks his friend Brian to be an accomplice, because he told him his plan to burn athletics equipment shed at the high school and asked him to drive him there. Alan has the intent for Brian to drive him to the school so Alan can burn the athletic equipment shed. That will make Brian an accomplice to possible arson.
Thus, Alan is liable for solicitation. If conspiracy between Alan and Brian is established, the solicitation will merge into conspiracy.
