II LEGAL AND ECONOMIC ASSESSMENT A Introduction 28 Section 2(1) of the Act sets out the Chapter I prohibition of agreements between undertakings, decisions by associations of undertakings or concerted practices which may affect trade within the UK and have as their object or effect the prevention, restriction or distortion of competition within the UK. An agreement which falls within the scope of the Chapter I prohibition may be exempted if it satisfies the criteria set out in section 9 of the Act. An individual exemption may be granted to a particular agreement if a request for exemption is made by a party to the agreement and the agreement is one to which section 9 applies. 29 Section 18 of the Act sets out the Chapter II prohibition of conduct on the part of one or more undertakings which amounts to the abuse of a dominant position in a market if it may affect trade within the UK.
