CEC APPROVED FINAL VOTE TALLY OF ELECTIONS


Tbilisi, 18 April ’04, civil.ge. - The Central Election Commission (CEC) approved on April 18 final vote tally of the March 28 parliamentary elections. According to the final results of the elections two parties could secure seats in the new parliament – President Saakashvili’s National Movement-Democrats, which received 66,24% of votes and the Rightist Opposition – New Rights-Industrialists – 7,96%. Other 10 parties and 4 election blocs failed to secure seats in the legislative body as they received less than 7% of votes: Labor Party - 6,01%; Adjarian leader Aslan Abashidze’s Revival Union – 3,89%; Freedom (Tavisupleba) Movement – 4,39%; NDP-Traditionalists – 2,55%; Unity – 2,47%; The final vote tally was approved by 15-member CEC with 11 votes to 2. Two representatives of the Revival Union were against the vote tally citing mass irregularities during the elections, while the repre-sentative of the Labor Party boycotted the CEC session, also citing ballot fraud. The Labors intend to appeal the Supreme Court with the demand to annul results of the March 28 polls. One members of the CEC from the Revival Union party was absent at the session. […]

LABORITES APPEAL AGAINST ELECTION RESULTS


Tbilisi, 17 April, ’04, Black Sea Press. - The Labor Party of Georgia (leader Shalva Natelashvili) is going to appeal against the final protocol of the parliamentary elections

which the Central Election Commission (CEC) is going to make public on 19 April , Gela Danelia, the head of the Labor Party press center, said to a Black Sea Press reporter. The Party demands that the results of the parliamentary elections on proportional system be annulled and that repeat parliamentary elections be called this fall. It demands that 150 deputies be elected to parliament during the repeat elections based on the results of the referendum held on 2 November last year. He underscored that if the Supreme Court refused to satisfy their claim, the Party would appeal to the Strasbourg Court. The Labor Party claims that the 28 March parliamentary elections had been stuffed throughout Georgia. […] The Labor Party is going to send a claim to the Constitutional Court of Georgia demanding that the 28 March elections be recognized “unconstitutional”.


ZURAB CHIABERASHVILI ASKED GENERAL PROSECUTOR'S OFFICE TO EXAMINE THE OFFENCES AT PARLIAMENTARY ELECTIONS OF MARCH 28 IN ACHARA AND KVEMO KARTLI


Tbilisi, 16 April ’04, Black Sea Press. - Zurab Chiaberashvili, chairman of Central Election Commission (CEC) of Georgia, asked General Prosecutor's Office to examine the offences at Parliamentary elections of March 28 in Batumi, Keda, Kobuleti, Shuakhevi, Khelvachauri and Khulo in Achara and in Bolnisi, Gardabani and Marneuli in Kvemo Kartli. Zurab Chiaberashvili reported at the today's briefing that he addressed with proper letter Irakli Okruashvili, the Prosecutor General. The chairman of CEC asked to institute criminal proceedings after the cases of the offences.

GEORGIAN SUPREME COURT REJECTS APPEAL ON AJARIA ELECTION RULING


Tbilisi, 17 April ’04, BBC Monitoring, Source: Caucasus Press. - The Supreme Court of Georgia has rejected an appeal filed by the Young Lawyers Association and the Revival union [led by Ajarian leader Aslan Abashidze] against the decision of the Central Electoral Commission [CEC] to annul election results in [Ajaria's] Kobuleti and Khulo districts. The lawyer for the Young Lawyers Association, Malkhaz Ghughunishvili, told Caucasus Press that, when he went to the court today, he was told that the court had dismissed the appeal. Ghughunishvili was informed that the court ruling would be sent to the Young Lawyers Association. [Passage omitted] According to Ghughunishvili, since the court ruling was delivered without oral hearings, this means that the association and Revival had had no right to appeal against the CEC's decision. "This is illegal, because the association had the status of an election monitor during the [28 March parliamentary elections] while Revival took part in the elections, so the issue directly concerned Revival," Ghughunishvili said.

WITHIN THREE DAYS SUPREME COURT CONSIDERS CLAIMS PROTESTING AGAINST REPEAT ELECTIONS IN AJARA

Tbilisi, 15 April ’04, Black Sea Press. - The NGO "Association of Young Lawyers” and the Party “Revival” (leader Aslan Abashidze) filed 14 April a claim to the Supreme Court of Georgia protesting against holding on 18 April repeat parliamentary elections in the Kobuleti and Khulo electoral districts. The claims will be considered within three days, a Black Sea Press reporter was informed at the Supreme Court press center. On 8 April the Tbilisi District Court considered the joint claim of the "Association of Young Lawyers” and the “Revival” remaining valid the CEC decision. Commenting on the judgment of the District Court the Chairperson of the NGO “Association of Young Lawyers” Tinatin Khidasheli claimed that “the court was frightened to pass a legal judgment otherwise it would have been at variance with the decision of the government. In turn, CEC Secretary Dmitri Kitoshvili claimed that the decision taken by the CEC had been legal, as the elections had been annulled in those districts where facts of mass election stuffing had been observed by international observers.



Leader of Ajara believes that parliamentary elections in Khulo and Kobuleti regions won't be held

Tbilisi. 15 April’04. Prime-News - The leader of Ajara Aslan Abashidze believes that repeated parliamentary elections won't take place in Khulo and Kobuleti regions of autonomous republic on April 18. Aslan Abashidze told journalists on Thursday that this issue is already decided. According to him, due to policy of the Chairman of Central Elections Commission Zurab Chiaberashvili over 52% voters didn't participate in the elections in Ajara. Aslan Abashidze's supporters have shown the door to members of special group of the Central Election Commission on Wednesday. […]
