During the review of the Record of Protected Structures (RPS) Dublin City Council Development Plan 2011-2017, this building was due for deletion however the procedure for making additions or deletions under Part IV Section 55 of the Planning and Development Act 2000 (as amended 2010) were not correctly followed.

Surviving parts of former distillery and ancillary buildings, including chimney and brick walling at Smithfield. Children's Court building at corner of New Church Street and Smithfield.

As a consequence of this error, the Children’s Court remains on the RPS 2011- 2017. It is therefore requested to officially delete the entry through the correct procedure. The Distillery Building shall remain on the RPS as it is rightfully protected in the current Development Plan and will not be endangered through the deletion of the Children’s Court from the RPS.

The building is located on the corner of New Church Street, at the east side of Smithfield Market. It is south of the Smithfield Chimney, possibly once part of the Jameson Distillery siting.
The area is zoned Z5: To consolidate and facilitate the development of the central area, and to identify, reinforce, strengthen and protect its civic design character and dignity.

Bow Street, New Church Street, Friary Avenue, Dublin 8: Corner sited, three-bay, three-storey, red brick court building c. 1990, with limestone dressing to ground floor.

Main entrance onto Smithfield.



Historical Background

Based on the cartographic evidence available, it appears that the existing building has replaced the original buildings that are recorded on the 1847 Town Plans of Dublin, shown below. The present building does not appear to have the same footprint of the building extant on the 1847 Town Plans of Dublin. The current building is a new building and the structures on the 1847 Town Plans of Dublin have gone.

Assessment of Special Interest under the Planning & Development Act 2000

None
Significance/NIAH Rating:

The National Inventory of Architectural Heritage (NIAH) has not been carried out for the Dublin City Council area; however, its categories of special interest (architectural, historical, archaeological, artistic, cultural, scientific, technical & social) and its rating system has been used to assess the building in question. The NIAH identifies five categories of rating in seeking to rank buildings. The NIAH rating values are International, National, Regional, Local and Record Only (I, N, R, L, O). Structures which are considered of International, National, and Regional significance are deemed worthy of inclusion on the RPS.

This structure is considered not to merit being placed on the RPS and should only be considered for Record Only (O). Record Only is defined as: These are structures or sites that are not deemed to have sufficient presence or inherent architectural or other importance at the time of recording to warrant a higher rating. It is acknowledged, however, that they might be considered further at a future time.

Meeting of the Area Committee

The proposed deletion of the structure was brought forward to the Central Area Committee on 8th October 2013 where it was agreed by the elected members to initiate the procedure to delete it from the RPS.
Recommendation to the City Council

In accordance with section 55 of the Planning and Development Act 2000, it is recommended that Bow Street, New Church Street, Friary Avenue, Dublin 7: Surviving parts of former distillery and ancillary buildings, including chimney and brick walling at Smithfield and Children’s Court building at corner of New Church Street and Smithfield be deleted from the Record of Protected Structures in the Dublin City Development Plan 2011-2017, due to a duplicate entry on the RPS.


The making of any deletion from the Record of Protected Structures is a reserved function of the City Council.

With Reference to the Phibsborough Mountjoy Area Plan

The Phibsborough/Mountjoy Local Area Plan 2008 was discussed at the January meeting of the Central Area Committee. It was agreed, inter alia, at the meeting that the Monitoring Committee for the Plan should be reconstituted and used for consultation purposes in relation to the available options for the existing plan.


The original nominated Councillors to the Monitoring Committee in July 2010 were Councillor Emer Costello and Councillor Mary O’Shea.
The views of the members are requested in relation to the Councillor representation on the Plan Monitoring Committee for the consultation exercise.
