MUNICIPAL OFFICERS MEETING

AUGUST 16, 2005
Mayor Nutting called the meeting to order at 8:40 p.m.
Roll Call: Phillippe Dumont, John McCurry, Jr., Clement Fleurent, Wayne McBreairty, Kenneth Farley, Christina Manikas, Raymond Cote, George Lamontagne
James Murphy was excused.
There were no adjustments to the agenda.
Game of Chance Application: St. Andre’s Church

Motion by Councilor Farley, seconded by Councilor McCurry to grant the game of chance application to St. Andre’s Church.

Vote: 7/1; Councilor Fleurent opposed.

Councilors Dumont, McCurry, McBreairty, Farley, Manikas, Cote and Lamontagne in favor. Motion carries.


Public Hearing: Bond Referendum – Fire House-Outer Pool Street

Mayor Nutting opened the public hearing at 8:45 p.m.

Public hearing was closed at 9:00 p.m.
Public Hearing: Bond Referendum – CSO Projects

Mayor Nutting opened the public hearing at 9:00 p.m.

Public hearing was closed at 9:12 p.m.
There was no public that addressed the Council.
Motion by Councilor McCurry, seconded by Councilor Dumont to adjourn.

Vote: Unanimous. Time: 9:12 p.m.




COUNCIL MEETING


AUGUST 16, 2005
Mayor Nutting called the meeting to order at 9:12 p.m.
Roll Call: Phillippe Dumont, John McCurry, Jr., Clement Fleurent, Wayne McBreairty, Kenneth Farley, Christina Manikas, Raymond Cote, George Lamontagne
James Murphy was excused.
Adjustment to Agenda:

Will consider Order 2005.83 before Second Readings.


Consideration of Minutes: August 2, 2005

Motion by Councilor Lamontagne, seconded by Councilor Fleurent to accept the minutes as printed.

Vote: Unanimous.

Order 2005.83) Appointment/Fire Chief – Robert Fournier

Motion by Councilor Lamontagne, seconded by Councilor McCurry to move into Executive Session before considering the order.

Vote: 5/3; Councilors Manikas, McBreairty and Fleurent opposed.

Councilors Dumont, McCurry, Farley, Cote and Lamontagne in favor.

Motion carries.
Mayor Nutting called the meeting back to order at 9:30 p.m.

2005.83 IN BOARD OF CITY COUNCIL..AUGUST 16, 2005


BE IT ORDERED, that the Mayor’s appointment of Robert Fournier to be Fire Chief, as recommended by the Fire Commission, be confirmed.
Motion by Councilor McCurry, seconded by Councilor Farley to confirm the appointment.

Vote: Unanimous.


Second Readings:

2005.75) Acceptance/Bond Referendum/Fire House – Outer Pool Street

Motion by Councilor Dumont, seconded by Councilor Lamontagne to grant the second reading of the order.


Motion by Councilor McCurry, seconded by Councilor Dumont to amend the order with the following amendments:


  1. Section #2 shall now read: The City Council acknowledges that the question set forth in section 1 was considered by the Finance Committee of the City Council and that the Finance Committee reported that it has made no recommendation that the voters respond “Yes” or “No” to the question set forth in section 1.

  2. Section #3 shall read: The City Council recommends that the voters respond “Yes” or “No” to the question set forth in section 1 and mark their ballots accordingly.

  3. In section #4, add to the first sentence, for the purpose of providing information to the voters. Also, add as a last sentence: The attached Notice of Public Hearing will be amended to conform to this Order as finally approved by the City Council.

  4. In section #5, add as a last sentence: The attached Warrant for Municipal Election will be amended to conform to this Order as finally approved by the City Council.

  5. In section #6, add the language: which will be amended to conform to this Order as finally approved by the City Council.

  6. In section #8, strike the language: is approved by the voters of the City of Biddeford and if amendment of Article IX, Section 6.

Vote on amendments: Unanimous.


Vote to send the Bond Referendum to the Voters, as amended: 6/2; Councilors Farley and McBreairty opposed.

Councilors Dumont, McCurry, Fleurent, Manikas, Cote and Lamontagne in favor.

Motion carries.
Motion by Councilor Dumont, seconded by Councilor Lamontagne to call for a Roll Call Vote of Yeas and Nays for Council recommendation.

Vote: Unanimous.


Yeas: Councilors Dumont, Fleurent, Manikas, Cote and Lamontagne.

Nays: Councilors McCurry, McBreairty and Farley.


2005.76) Acceptance/Bond Referendum/CSO Projects

Motion by Councilor Lamontagne, seconded by Councilor Cote to table the second reading until the September 6, 2005 Council meeting.

Vote: 5/3; Councilors McCurry, McBreairty and Manikas opposed.

Councilors Dumont, Fleurent, Farley, Cote and Lamontagne in favor. Motion carries.


Orders of the Day:

Motion by Councilor Farley, seconded by Councilor McCurry to table Orders 2005.69; 2005.78; 2005.79; 2005.80; and 2005.81 until the September 6, 2005 Council meeting.

Vote: 6/2; Councilors McBreairty and Manikas opposed.

Councilors Dumont, McCurry, Fleurent, Farley, Cote and Lamontagne in favor.

Motion carries.
Resignation, Appointments and Reports of Committees will be considered at the September 6, 2005 Council meeting.
Executive Session: Personnel Matter

Motion by Councilor McCurry, seconded by Councilor Farley to move into Executive Session.

Vote: 6/2; Councilors Dumont and McBreairty opposed.

Councilors McCurry, Fleurent, Farley, Manikas, Cote and Lamontagne in favor.

Motion carries. Time: 10:20 p.m.
Mayor Nutting called the meeting back to order at 10:45 p.m.
Motion by Councilor McCurry, seconded by Councilor Dumont to adjourn.

Vote: Unanimous. Time: 10:45 p.m.
