Here it is vital that the other principles in this report are strongly institutionalised within the regulator to ensure the competency and structures are in place to manage this discretion. The objectives of the regulator and any discretion provided to the regulator should not encourage or provide opportunities for mission creep. The regulator should remain within its scope of activity that is defined by legislation, and monitored
through the practice of open, transparent and accountable processes, with the judiciary being able to call the regulator to task for exercising beyond its legitimately intended powers (
ultra vires).
