Android Market App Submission Thank you for your interest in BlueToad’s “Publisher App for Android Market.” To ensure that your submission is processed timely, please complete this entire application. Please keep in mind that the absence of any part will delay the submission of your application to Android Market. Once you have completed the form and created the required art—e-mail a .zip file of these files with your application form to Your Account Representative or Sales@bluetoad.com 1. Publication Name This is the name of the publication from your digital edition dashboard. (Please complete one form for each publication) _________________________________________________ 2. Title The name of your application as you would like it to appear in Android Market. An application name longer than 30 characters will not be accepted. Do not enter an app name for which you do not hold the relevant intellectual property rights. If you enter an app name that is currently trademarked, you run the risk of having your application removed from Android Market. Please note: Best efforts will be made to secure the name you request. If the name requested is not available, we will contact you to determine an alternate. Title______________________________________ 3. Desktop Name The Desktop name appears as the label underneath the icon on the Android Market device. While there is no maximum requirement, this name should be 12 characters or fewer if you would like the entire description to appear unabbreviated on the Android Market device. Desktop Name______________________________________________ 4. Application Description Provide a detailed description of the application you are adding. This description is what will appear to customers that are viewing your App when they are in Android Market. A description longer than 4000 characters will not be accepted by Android Market. IMPORTANT: This field should only be used to describe the features and functionality of your application. This field, once submitted to Android Market, may be changed at a price of $50 per modified submission. It should be written to describe your publication, not any particular issue within your publication. It should not be used as a vehicle for other communications to your customers. Promo Text Provide text that can be used in promotional areas of Android Market. Android Market images Android Market icons can be transparent, shiny or glossy. Android Market Launcher icons should meet the following criteria

9. Ratings Determine a rating for the App. Please see the Android Market ratings guidelines in Exhibit “A”. Everyone _____ Low Maturity _____ Medium Maturity _____ High Maturity _____ 10. Android Market Application Agreement By signing your name at the bottom of this section, you (hereinafter referred to as the “Publisher”) agree to the terms and conditions set forth herein (the “Agreement”). 1. Android Market Application Services: Publisher hereby authorizes BlueToad, Inc. (“BlueToad”) to submit an application on the Android Market for the inclusion of a publication-specific Android Market App (the “App”) in the Android Market for the publication chosen by Publisher. Upon approval from Android Market, BlueToad will make available to the App all relevant publication-specific digital edition content paid for using BlueToad’s or its reseller’s digital edition services. 2. Term: The term of this Agreement shall be for a period of one (1) year from the date the App is accepted by Android Market and made available through the Android Market. 3. Publisher Obligations: Publisher acknowledges and understands that by accepting the terms of this Agreement it is obligated to pay BlueToad’s one time set up fee of $199 for submitting each App to the Android Market and to pay BlueToad’s monthly App hosting fee of $99 per month for one year for that publication. BlueToad is not responsible for any applications denied by Android Market for offensive or inappropriate content or for any other reason unrelated to the design or coding of the App itself. Publisher is obligated to pay BlueToad’s monthly App hosting fee regardless if it creates any digital edition content or otherwise discontinues using BlueToad’s digital edition services. If the App is rejected by Android Market, Publisher will only be responsible for paying BlueToad’s one time set up fee and will be relieved from paying BlueToad’s monthly App hosting fee. 4 Applicable Law and Binding Effect: This Agreement shall be governed by and interpreted under the laws of the State of Florida, and shall inure to the benefit of and be binding upon the parties hereto and their heirs, personal representatives, successors and assigns. If any action, suit or proceeding is instituted as a result of any matter or thing affecting this Agreement, the parties hereby designate Orange County, Florida, as the proper jurisdiction and the venue in which same is to be instituted. 6. Attorney’s Fees: In the event of litigation arising under this Agreement, the prevailing party will recover from the nonprevailing party, in addition to available remedies at law, all court costs and reasonable attorneys’ fees (including charges attributable to law clerks and paralegals) incurred in any such action. Signing your name below constitutes your legally binding signature to the terms and conditions set forth in this Agreement. I agree to be bound to the foregoing Application Agreement Name: __________________________________________ Title:____________________________________________ Organization:_____________________________________ Exhibit A: App Ratings for Android Market Rating your application for Android Market How to rate your application for Android Market Developers must label their applications according to the Android Market ratings system, which consists of four levels: Everyone Low maturity Medium maturity High maturity Please follow these guidelines when choosing a rating for the app. Please consider content and advertisements equally when rating the app. Alcohol, Tobacco and Drugs Apps that contain illegal content are not permitted in Android Market. Apps that include references to drugs, alcohol or tobacco products must be rated "Medium maturity" or above. Apps that primarily focus on the consumption or sale of drugs, alcohol or tobacco must be rated "High maturity." Gambling Apps that facilitate real gambling are not permitted in Android Market. Apps with gambling themes or simulated gambling must be rated "Medium maturity" or "High maturity." Hate Hate speech is not allowed in Android Market. Apps that contain inflammatory content must be rated "Medium maturity" or "High maturity." Location Applications rated "Everyone" must not ask users for their location. Apps that access location data must be rated "Low maturity" or above. Apps that publish or share users' location with others must be rated "Medium maturity" or "High maturity." Profanity and Crude Humor Apps that include profanity or crude humor should be rated “Medium maturity” or "High maturity." Sexual and Suggestive Content Pornography is not permitted in Android Market. Apps that include suggestive or sexual references must be rated "Medium maturity" or "High maturity." Apps that focus on suggestive or sexual references must be rated "High maturity." User Generated Content and User to User Communication Apps rated "Everyone" must not host any user generated content or enable communication between users. Apps that focus on allowing users to find each other and communicate should be rated "Medium maturity" or "High maturity." Violence Apps that contain mild cartoon or fantasy violence must be rated "Low maturity" or above. Apps that contain realistic or intense fantasy violence must be rated "Medium maturity" or "High maturity," and those that contain graphic violence must be rated "High maturity." Gratuitous real violence is not allowed in Android Market.
