TERMSANDCONDITIONS
Definitions:The following words and expressions shall have the corresponding meanings wherever appropriate.
The following Business rules will apply to the SMS/Mobile Banking :
3.1TheFacilitywillbeavailabletoCustomershaving aSavings/ Currentaccount with theBank.
3.2In pilot phase of its implementation, per day transaction limit of our bank is Rs. 3000/- with a calendar month limit of Rs.20000/- per customer for both SMS/USSD variants. These limits are subject to change.
3.5 In the case of a joint account, customer is required to get the required mandate (in its prescribedform)dulyauthorizedfromtheotherholder.Accountsinthenameofminoror where minorisajointaccountholderarenoteligiblefor MobileBanking.
3.7The Customercanrequest forterminationoftheFacilitybyde-registeringatJ&K Grameen Bankbranchof theprimaryaccountenabledforMobileBanking.The Customershallremainaccountableforallthe transactionsonthedesignatedaccount madepriortoconfirmationofanysuchcancellationrequest bytheBank.It shallbetheBank’sendeavortogiveareasonablenoticeforwithdrawalor terminationofthefacility, but theBankmayat itsdiscretionwithdrawtemporarilyorterminatethe facility, eitherwhollyorpartially, anytimewithoutgivingpriornoticetotheCustomer.Thefacility may be suspended for any maintenance or repair work for any breakdown in the Hardware/ SoftwareofMobileBanking,any emergencyorsecurityreasonswithoutpriornoticeandthebank shallnotberesponsibleifsuchanactionhastobetakenforreasons ofsecurity oremergency.
3.8 TheservicesofferedundertheFacilitywillbeautomaticallyterminatediftheprimaryaccount linkedfortheMobileBankingServicesisclosed.TheBankmayalsoterminateorsuspendthe services under the Facility without prior notice if the Customer has violated the terms and conditionslaiddownbytheBankoronthedeathoftheCustomerwhenbroughttothenoticeof theBank.
4.UsageofFacility:
Byaccepting thetermsandconditionswhileregistering for thefacility,theCustomer:
4.3authorizestheBanktomaptheaccountnumber andMobilePhone Numberforthe smoothoperationofMobileBankingofferedbyBankandtopreservethemappingrecordinitsown server or server of any other third party and to use such data at its discretion for providing/enhancing furtherbanking/ technologyproductsthatitmay offer.
oranyothermethoddecidedatthediscretionoftheBankwhichmaynotberecognizedunderthe ITAct, 2000forauthenticationofelectronic recordsandthisisacceptableandbindingtothe Customerand hencetheCustomerissolelyresponsibleformaintenanceofthesecrecyand confidentiality of the MPIN withoutanyliabilitytotheBank.
5.Responsibilities and obligationsoftheCustomer
5.1 The Customer will be responsible for all transactions, including unauthorised /erroneous/ wrong/incorrect/mistaken/falsetransactionsmade throughtheuseofhis/hermobilephone, SIM cardandMPIN, regardlessofwhethersuchtransactionsareinfact entered intoorauthorizedby him/ her. TheCustomerwillberesponsiblefortheloss/damage,ifanysufferedinrespectofallsuch transactions.
5.2TheCustomershalltakeallpossiblestepstoensurethattheApplicationandhis/her mobile phonearenotsharedwithanyoneandshalltakeimmediateactiontode-register fromMobile Banking asperprocedurelaiddownin case ofmisuse/ theft/loss of themobilephone orSIMcard.
5.4TheCustomershallkeepthe MPINconfidentialandwillnotdisclosethesetoany otherpersonorwillnotrecordtheminawaythatwouldcompromisetheconfidentialityofthe same or thesecurity oftheservice.
5.5 Itwillbetheresponsibilityof theCustomertonotifytheBankimmediatelyifhe/ shesuspectthe misuse of the MPIN. Hewillalsoimmediatelyinitiatethenecessarystepstochangehis MPIN.
RelatingtotheservicesofferedundertheFacility whichwouldbepublicizedontheBank’swebsites andat thebranchesandwouldberesponsiblefortakingnoteof/ complianceofsuchinformation/ modificationsinmaking use of theFacility.
5.10 TheCustomershallbeliableandresponsibleforalllegalcomplianceandadherenceofall commercial terms and conditions in respectof the mobile connection/SIMcard/mobile phone throughwhichthefacilityisavailedandtheBankdoesnotaccept/acknowledgeanyresponsibility in thisregard.
6.1The Customer shall not use or attempt to use Mobile Banking for funds transfer without sufficient funds intherelativeaccount orwithout apre-existingarrangement with J&K Grameen Bankforthe grantofanoverdraft.
6.2J&K Grameen BankwillendeavortoeffectsuchfundstransfertransactionsreceivedthroughMobile Bankingprovidedtherearesufficient fundsavailableinthe Account.J&K Grameen Bankshallnot be liablefor anyomission to makealloranyofthepaymentsorforlatepaymentsdueto circumstancesbeyond thereasonablecontrolofJ&K Grameen Bank.
7.FeestructurefortheFacility:
7.1 Subscription charges for availing the service are nil. First five transactions for the general public and fifteen transactions for the staff of the bank (present and retired) on SMS banking as free in one calendar month. Each transaction beyond this limit shall be chargeable to the customer with charge as Rs.5/- (five rupees only) per transaction. However, bank reserves the right to change the fee charged for the services provided under the facility at its discretion. Display of such charges on Bank’s websites would serve as sufficient notice and same is binding on the customer. 8.AccuracyofInformation:
8.1ItistheresponsibilityoftheCustomertoprovidecorrectinformationtotheBankthroughthe useoftheFacilityoranyothermethod.Incaseofanydiscrepancyinthisinformation,theCustomer understandsthattheBankwillnotbein any wayresponsibleforactiontaken basedonthe information.TheBankwillendeavorto correcttheerrorpromptlywhereverpossibleonabest effortbasis,if thecustomerreportssucherrorininformation.
8.2 The CustomerunderstandsthattheBankwilltry,tothebest ofitsabilityandeffort, toprovide accurateinformationandshallnotholdthe Bankresponsibleforanyerrors oromissionsthatmay occurduetoreasonsbeyond thecontroloftheBank.
Documentssentbyelectronicdelivery willcontainalltheinformationas itappears intheprinted hardcopyversionaspreparedanddistributedbytheoriginator, withthepossibleexceptionof graphic insertionssuchasphotographsorlogotypes.Electronicdelivery maybe intheformofan electronicmail,anattachmenttotheelectronicmail, orintheformofanavailabledownloadfrom theWebsite.J&K Grameen Bank would bedeemed to havefulfilled itslegalobligation to deliverto the Customeranydocumentifsuchdocumentissentviaelectronicmeans.FailuretoadviseJ&K GrameenBank ofanydifficultyinopeningadocumentsodeliveredwithintwenty-four(24)hoursafterdelivery shallserveasanaffirmationregarding theacceptanceof thedocument.
10.Bank’sLien
J&K Grameen Bankshallhavetheright ofset-offandlien, irrespectiveofanyother lienorcharge, present as well as future on the deposits held in the Customer’s Primary Account and/ or; Linked Account(s)or inanyotheraccount, whether insinglenameorjoint name(s), totheextent ofall outstandingdues, whatsoever,arising asaresultoftheMobileBankingextended toand/orusedby theCustomer.
11.DisclaimerofWarranties
11.2J&K GrameenBankdoesnot warrantthataccess totheFacilitywillbeuninterrupted, timely, secure, or errorfreenordoes it makeanywarrantyastotheresultsthat maybeobtainedfromuseofthe Facility orastotheaccuracy orreliability of theFacility.
11.3 J&K Grameen Bankwillnotbeliablefor misuse or unauthorized use of mobile handset oranyvirusthat mayentertheCustomer’ssystemasaresultofthe Customerusing theFacility.
12. Indemnity
13.3Whileit shallbetheendeavoroftheBanktocarryouttheinstructionsreceivedfromthe Customerspromptly, it shallnot beresponsibleforthedelay/failure incarryingout the instructions duetoanyreasonswhatsoever includingfailureofoperationalsystemorduetoanyrequirement of law.The CustomerexpresslyauthorizestheBanktoaccesshis/heraccount informationrequiredfor offeringtheservicesundertheFacilityandalso to sharetheinformationregardinghis/heraccounts with theserviceprovider/ thirdpartyasmayberequired toprovidetheservicesundertheFacility.
13.5 The Customer hereby authorizes the Bank or its agents to send promotional messages includingtheproductsoftheBank, greetingsoranyothermessagestheBankmayconsiderfrom timetotime.
13.6TheCustomerunderstandsthattheBankmaysendrejection or cannotprocess therequest messagesfortheservicerequest(s)sent bythe Customerwhichcouldnot beexecutedforany reason.
