COMMITTEE REPORTS
Councilmember Alexander informed Council President Pitts that the Zoning
Committee’s report contained legislation of interest to a large percentage of the
persons present in the audience. Therefore, he asked if the Agenda could be
reordered to allow him to report first. Mr. Pitts, hearing no objections, allowed
the change.
ZONING COMMITTEE (1)

Attendance at the Friday, December 4, 1998 meeting of the Zoning Committee was as follows:
Present: Councilmembers Alexander (Chair), McCarty, Starnes, Bond, Winslow, Boazman, and Emmons
Committee Chairperson Alexander noted that if there was no objection, items on
the Zoning Committee’s Agenda would be considered in varied order as a
courtesy to citizens present in the audience to hear deliberation of certain
issues.
ORDINANCES FOR SECOND READING
98-O-0757 ( 1) An Ordinance by Zoning Committee to amend Ordinance U-76-
U-76-2 2/U-82-31 which granted a special use permit for a church in an
U-82-31 R-2 (Single-Family Residential) District, for the purpose of a site plan amendment, property located at 4465 Northside Drive, N.W., and for other purposes.

Committee Chairperson Alexander sounded the above item and on behalf of the Committee, Made a Motion to Adverse. Discussion began with Councilmember McCarty Making a Substitute Motion to Refer 98-O-0757 Back to Committee for 60 days. The Motion was properly Seconded and discussion ensued. Councilmember Martin offered a friendly amendment to Mr. McCarty’s Motion by recommending that it be held in the Breast of Council (Tabled) for 60 days instead. Mr. McCarty accepted and therefore amended his Motion to instead Table for 60 days. The Motion was Seconded but subsequently FAILED by a roll call vote of 2 yeas; 11 nays. Consequently, discussion reverted back to the initial Motion to Adverse which subsequently, CARRIED by a roll call vote of 11 yeas; 3 nays.

(Cont’d) requested a Point of Information to ask a question of the Law Department and Senior Assistant City Attorney David Blum responded accordingly.

98-O-1553 ( 2) An Ordinance by Zoning Committee to rezone property from the
Z-98-53 R-3 (Single-Family Residential) District to the PD-H (Planned Development – Housing) District, property located at 3884 Ivy Road, N.E., and for other purposes.

Committee Chairperson Alexander sounded the above item and on behalf of the Committee, Made a Motion to Adopt. However, Councilmember Morris made a Substitute Motion to File. It was properly Seconded and Mr. Morris provided brief clarification. 98-O-1553 was subsequently FILED by a roll call vote of 11 yeas; 3 nays.

Committee Chairperson Alexander recused himself from chairing while the above item was being considered. He noted a potential conflict of interest due to his wife’s membership in the subject church. President Pitts advised Mr. Alexander that the situation did not warrant recusal, however, Mr. Alexander stated his preference to recuse himself and to abstain on the vote, as well. As a result, Committee Vice-Chairperson Boazman sounded the item and on behalf of the Committee, Made a Motion to Adopt. It was properly Seconded and subsequently CARRIED by a roll call vote of 13 yeas; 0 nays; 1 abstention.
