24. WARRANTY:

All warranties express and implied shall be made available to the City for goods and services covered by this solicitation. All goods furnished shall be fully guaranteed by the successful bidder against factory defects and workmanship. At no expense to the City, the successful bidder shall correct any and all apparent and latent defects that may occur within the manufacturer’s standard warranty.



25. PROTEST:

A recommendation for contract award or rejection of award may be protested by a bidder. The bidder may file a written protest with the City Clerk’s office. The bidder shall file its written protest with the City Clerk, Monday through Friday, between the hours of 8:00 a.m. and 5:00 p.m., excluding legal holidays. Protests shall contain the name, address, and phone number of the petitioner, name of the petitioner’s representative (if any), and the title and bid number of the solicitation. The protest shall specifically describe the subject matter, facts giving rise to the protest, and the action requested from the City.


The written protest must be received no later than seventy-two (72) consecutive hours (excluding Saturdays, Sundays, and legal holidays) after the time of award posting. Failure to file a timely formal written protest within the time period specified shall constitute a waiver by the bidder of all rights of protest under this procedure.
In the event of a timely protest, the City shall not proceed further with award of the contract and agreement until all administrative remedies are exhausted, or until the City Manager determines the award of the contract is immediately necessary to protect the public health, welfare, or safety.


26. FRAUD AND MISREPRESENTATION:

Any individual, corporation, or other entity that attempts to meet its contractual obligations with the City through fraud, misrepresentation, or material misstatement, may be debarred for up to five (5) years. The City, as a further sanction, may terminate or cancel any other contracts with such individual, corporation, or entity. Such individual or entity shall be responsible for all direct or indirect costs associated with termination or cancellation, including attorney’s fees.



27. OMISSIONS IN SPECIFICATIONS:

The scope of services or description of items contained within this solicitation describes the various functions and classes of work required as necessary for the completion of the project. Any omissions of inherent technical functions or classes of work within the specifications and/or statement of work shall not relieve the bidder from furnishing, installing, or performing such work where required to the satisfactory completion of the project.



28. FORCE MAJEURE:

The City and the successful bidder are excused from the performance of their respective obligations under the contract when and to the extent that their performance is delayed or prevented by any circumstances beyond their control, including fire, flood, explosion, strikes or other labor disputes, natural disasters, public emergency, war, riot, civil commotion, malicious damage, act or omission of any governmental authority, delay or failure or shortage of any type of transportation, equipment, or service from a public utility needed for their performance provided that:



  1. The non-performing party gives the other party prompt written notice describing the particulars of the force majeure, including, but not limited to, the nature of the occurrence and its expected duration, and continues to furnish timely reports with respect thereto during the period of the force majeure.

  2. The excuse of performance is of no greater scope and of no longer duration than is required by the force majeure.

  3. No obligations of either party that arose before the force majeure causing the excuse of performance are excused as a result of the force majeure.

  4. The non-performing party uses its best efforts to remedy its inability to perform.

Notwithstanding the above, performance shall not be excused under this section for a period in excess of two (2) months, provided that in extenuating circumstances, the City may excuse performance for a longer term. Economic hardship of the successful bidder shall not constitute a force majeure. The term of the contract shall be extended by a period equal to that during which either party’s performance is suspended under this section.



29. BID AWARD NOTICE FORM:

Attached is a Bid Award Notice Form. All submitted bids are to include this form to be notified of the recommendation of award. (See attached Form 2).

SECTION C: TCPN ROOF REHABILITATION BID


  1. GENERAL




        1. RELATED DOCUMENTS

          1. Drawings and general provisions of the Contract, including General and Supplementary Conditions and Division 01 Specification Sections, apply to this Section.




        1. SUMMARY

          1. This Section includes the following:

            1. Rehabilitation or replacement of base flashings.

            2. Application of fluid-applied roof membrane and flashings over existing modified bituminous membrane roofing.

          2. Related Requirements:

            1. Division 00 Document “Available Information,” including the following pre-construction test report attachments.

              1. Infrared roof moisture survey report.

            2. Division 01 Section "Summary" for use of the premises and phasing requirements, and for restrictions on use of the premises due to Owner or tenant occupancy.

            3. Division 01 Section "Summary of Building Envelope Rehabilitation" for description of scope of building envelope rehabilitation, use of the premises and phasing requirements, and for restrictions on use of the premises due to Owner or tenant occupancy, for full building rehabilitation projects.

            4. Division 01 Section "Photographic Documentation" for photographs taken before coating preparation.

            5. Division 01 Section "Temporary Facilities and Controls" for temporary construction and environmental-protection measures.

        1. MATERIALS OWNERSHIP

          1. Demolished materials shall become Contractor's property and shall be removed from Project site.




        1. DEFINITIONS

          1. Roofing Terminology: Refer to ASTM D 1079 and glossary in NRCA's "The NRCA Roofing Manual" for definition of terms related to roofing work in this Section.

          2. Existing Roofing System: SBS-modified bituminous roofing, and components and accessories between deck and roofing membrane.

          3. Roofing Re-Coating Preparation: Existing roofing that is to remain and be prepared to accept restorative coating application.

          4. Patching: Removal of a portion of existing membrane roofing system from deck or removal of selected components and accessories from existing membrane roofing system and replacement with similar materials.

          5. Remove: Detach items from existing construction and legally dispose of them off-site unless indicated to be removed and reinstalled.

          6. Existing to Remain: Existing items of construction that are not indicated to be removed.




        1. ACTION SUBMITTALS

          1. Product Data: For each type of product specified.




        1. INFORMATIONAL SUBMITTALS

          1. Contractor's Product Certificate: Submit notarized certificate, indicating products intended for Work of this Section, including product names and numbers and manufacturers’ names, with statement indicating that products to be provided meet the requirements of the Contract Documents.

          2. Qualification Data: For Installer, Manufacturer, and Roofing Inspector.

            1. Letter written for this Project indicating manufacturer approval of Installer to apply specified products and provide specified warranty.

            2. Certificate indicating Installer is qualified in Project jurisdiction to perform asbestos abatement.

          3. Product Test Reports: Based on evaluation of comprehensive tests performed by manufacturer and witnessed by a qualified testing agency, for components of roofing rehabilitation system.

          4. Warranties: Unexecuted sample copies of special warranties.




        1. CLOSEOUT SUBMITTALS

          1. Maintenance Data: To include in maintenance manuals.

          2. Warranties: Executed copies of 20 Year approved warranty forms.

        2. QUALITY ASSURANCE

          1. Installer Qualifications: An employer of workers trained and certified by manufacturer, including a full-time on-site supervisor with a minimum of five years' experience installing products comparable to those specified.

          2. An Approved and Pre-Qualified TCPN In-Network Contractor.

          3. Roofing Inspector Qualifications: A technical representative of manufacturer experienced in the installation and maintenance of the specified roofing system, qualified to perform roofing observation and inspection specified in Field Quality Control Article, to determine Installer’s compliance with the requirements of this Project, and approved by the manufacturer to issue warranty certification. The Roofing Inspector shall be one of the following:

            1. An authorized full-time technical employee of the manufacture will be onsite a minimum of 5 days or the duration of the project whichever is less.

          4. Roofing Rehabilitation Pre-installation Conference: Conduct conference at Project site to comply with requirements in Division 01 Section "Project Management and Coordination." Review methods and procedures related to roofing system.

            1. Meet with Owner; roofing re-coating materials manufacturer's representative; roofing re-coating Installer including project manager and foreman; and installers whose work interfaces with or affects re-coating including installers of roof accessories and roof-mounted equipment requiring removal and replacement as part of the Work.

            2. Review methods and procedures related to re-coating preparation, including membrane roofing system manufacturer's written instructions.

            3. Review temporary protection requirements for existing roofing system that is to remain, during and after installation.

            4. Review roof drainage during each stage of re-coating and review roof drain plugging and plug removal procedures.

            5. Review and finalize construction schedule, and verify availability of materials, Installer's personnel, equipment, and facilities needed to make progress and avoid delays.

            6. Review base flashings, special roofing details, drainage, penetrations, equipment curbs, and condition of other construction that will affect re-coating.

            7. Review HVAC shutdown and sealing of air intakes.

            8. Review shutdown of fire-suppression, -protection, and -alarm and -detection systems.

            9. Review procedures for asbestos removal or unexpected discovery of asbestos-containing materials.

            10. Review governing regulations and requirements for insurance and certificates if applicable.

            11. Review existing conditions that may require notification of Owner before proceeding.

        3. PROJECT CONDITIONS

          1. Owner will occupy portions of building immediately below re-coating area. Conduct re-coating so Owner's operations will not be disrupted. Provide Owner with not less than 72 hours' notice of activities that may affect Owner's operations.

          2. Protect building to be rehabilitated, adjacent buildings, walkways, site improvements, exterior plantings, and landscaping from damage or soiling from rehabilitation operations.

          3. Maintain access to existing walkways, corridors, and other adjacent occupied or used facilities.

          4. Weather Limitations: Proceed with rehabilitation work only when existing and forecasted weather conditions permit Work to proceed without water entering into existing roofing system or building.

            1. Store all materials prior to application at temperatures between 60 and 90 deg. F.

            2. Apply coatings within range of ambient and substrate temperatures recommended by manufacturer. Do not apply materials when air temperature is below 50 or above 110 deg. F.

            3. Do not apply roofing in snow, rain, fog, or mist.




        1. WARRANTY




            1. Warranty Period: 20 years manufacturer labor and material from date of completion of rehabilitation work.

            2. Installer's Warranty: Submit roofing Installer's warranty, on warranty form at end of this Section, signed by Installer, covering the Work of this Section and related Sections indicated above, including all components of the liquid applied roof membrane.

            3. Warranty Period: Two years from date of Substantial Completion.



  1. PRODUCTS




        1. MANUFACTURERS

          1. Basis-of-Design Manufacturer/Product: The roof system specified in this Section is based upon products of Tremco, Inc., Beachwood, OH, (800) 562-2728, www.tremcoroofing.com that are named in other Part 2 articles. Subject to compliance with requirements, provide the named product or an approved comparable product by one of the following:

        2. PERFORMANCE REQUIREMENTS

          1. General: Provide recoated roofing membrane and base flashings that remain watertight; do not permit the passage of water, thermally induced movement, and exposure to weather without failure.

            1. Accelerated Weathering: Roofing system shall withstand 2000 hours of exposure when tested according to ASTM G 152, ASTM G 154, or ASTM G 155.

          2. Material Compatibility: Provide roofing materials that are compatible with one another under conditions of service and application required, as demonstrated by roofing manufacturer based on testing and field experience.




        1. MATERIALS

          1. General: Re-coating materials recommended by roofing system manufacturer for intended use and compatible with components of existing membrane roofing system.

          2. Temporary Roofing Materials: Selection of materials and design of temporary roofing is responsibility of Contractor.

          3. Infill Materials: Where required to replace test cores and to patch existing roofing, use infill materials matching existing membrane roofing system materials, unless otherwise indicated.




        1. FLUID-APPLIED ROOFING MEMBRANE

          1. Bio-Based Polyurethane Roof Coating Base Coat: ASTM D7311, Two-part catalyzed low-odor polyurethane roof base coating formulated for direct application and for use with fiber reinforcement in conjunction with a compatible top coat.

            1. Basis of Design Product: Tremco, Alphaguard BIO Base Coat.

            2. Volatile Organic Compounds (VOC), maximum, ASTM D3960: 1 g/L.

            3. Combustion Characteristics, UL 790: Class A.

            4. Bio-Based Content: Not less than 20 percent.

            5. Percent solids, by volume, ASTM D 2697: 100.

            6. Percent solids, by weight, ASTM D 1644: 100.

          2. Bio-Based Polyurethane Roof Coating Top Coat: ASTM D7311, Two-part catalyzed low-odor polyurethane roof top coating formulated for direct application over compatible reinforced base coat.

            1. Basis of Design Product: Tremco, Alphaguard BIO Top Coat.

            2. Volatile Organic Compounds (VOC), maximum, ASTM D 3960: 6 g/L.

            3. Combustion Characteristics, UL 790: Class A.

            4. Bio-Based Content: Not less than 20 percent.

            5. Percent solids, by volume, ASTM D 2697: 100.

            6. Percent solids, by weight, ASTM D 1644: 100.

            7. Water Vapor Transmission, ASTM E 96, Wet Cup: 0.020 perm-in (1.32 g/m2/day).

          3. Polyester Reinforcing Fabric: Stitch-bonded polyester fabric, minimum 3 oz./sq. yd., for fluid-applied membrane and flashing.

            1. Basis of Design Product: Tremco, Permafab.




        1. AUXILIARY ROOFING COATING MATERIALS

          1. General: Auxiliary materials recommended by roofing system manufacturer for intended use and compatible with existing roofing system and fluid-applied roofing system.

          2. Metal Surface Primer: Single-component, water based primer to promote adhesion of base coat to metal surfaces.

            1. Basis of Design Product: Tremco, Alphaguard M-Prime.

          3. Asphaltic Surfaces Primer: Single-component, multi-substrate primer to promote adhesion of base coat to surfaces recommended by manufacturer.

            1. Basis of Design Product: Tremco, Alphaguard Re-Prime Alphaguard WB Primer.

          4. Joint Sealant: Single component, high solids, moisture curing polyurethane sealant recommended by coating manufacturer.




  1. EXECUTION




        1. EXAMINATION

          1. Examine existing roofing substrates, with Installer present, for compliance with requirements and for other conditions affecting application and performance of roof coatings.

            1. For the record, prepare written report, endorsed by Installer, listing conditions detrimental to performance.

            2. Verify compatibility of approved re-coating system with and suitability of substrates.

            3. Verify that substrates are visibly dry and free of moisture.

            4. Verify that roofing membrane surfaces have adequately aged to enable proper bond with re-coating system base coat.

            5. Verify that existing roofing membrane is free of blisters, splits, open laps, indications of shrinkage, and puncture damage or other indications of impending roof system failure.

            6. Application of fluid-applied re-coating membrane indicates acceptance of surfaces and conditions.




        1. PREPARATION

          1. Protect existing roofing system that is indicated not to be rehabilitated, and adjacent portions of building and building equipment.

            1. Tape of metal coping with painter’s tape to protect from coating.

            2. Protect top of metal coping with temporary protection at ladder access points.

            3. Mask surfaces to be protected. Seal joints subject to infiltration by coating materials.

            4. Limit traffic and material storage to areas of existing roofing membrane that have been protected.

            5. Maintain temporary protection and leave in place until replacement roofing has been completed.

          2. Shut down air intake equipment in the vicinity of the Work in coordination with the Owner. Cover air intake louvers before proceeding with re-coating work that could affect indoor air quality or activate smoke detectors in the ductwork.

            1. Verify that rooftop utilities and service piping affected by the Work have been shut off before commencing Work.

          3. Maintain roof drains in functioning condition to ensure roof drainage at end of each workday. Prevent debris from entering or blocking roof drains and conductors. Use roof-drain plugs specifically designed for this purpose. Remove roof-drain plugs at end of each workday, when no work is taking place, or when rain is forecast.

            1. Do not permit water to enter into or under existing membrane roofing system components that are to remain.




        1. ROOFING COATING SCOPE OF WORK




  1. Coating Preparation

    1. Remove all debris and foreign matter from roof and gutters. Clean roof sections and flashings to be restored by pressure washing with a minimum of 2000 psi.




  1. Wet Roofing Removal & Replacement

    1. Remove marked roof areas in orange spray paint that correspond to the marked areas on the infrared scan report drawings.

      1. Remove roofing and insulation down to the deck and discard.

      2. Install new materials that match existing roof in size and style of existing roof system.

      3. Tie newly installed roof system into existing roof system.




  1. Repairs

    1. Make repairs to all marked punctures, splits, openings, blisters, fishmouths, etc. prior to the installation of the Alphaguard liquid applied roof system. New granulated cap sheet can be torched down for repairs. If smooth surface torched down membrane is used the sheet will need to be primed with Alphaguard WB Primer.

    2. Strip in all gutter seams and downspout seams by back brushing Geogard Seam Sealer into seams.

    3. Cut gutter edge stripping back a minimum of 2” to expose the metal flange.

      1. Remove all foreign matter from metal flange.

      2. Prime Metal Flange with Alphaguard M-Prime.

      3. Apply Alphaguard Base Coat by transitioning it from the metal gutter flange onto the modified bitumen roof, a minimum of 2” overlap.

      4. Embed 4” reinforcement into the wet Alphaguard Base Coat and apply another course of Alphaguard Base Coat.

    4. Soil Stacks

      1. Prime all soil stack leads with Alphaguard M-Prime.

      2. Apply Alphaguard Base Coat onto primed soil stack and transition a minimum of 4 inches onto the roof surface.

      3. Embed Permafab reinforcing polyester into the wet base coat until fully encapsulated.

      4. Once base coat is cured install Alphaguard finish coat over cured Alphaguard Base Coat.

    5. Metal Counter flashings

      1. Caulk all surface mounted metal counter flashings with Tremseal D.

    6. Existing Mastic Repairs

      1. Prime all existing mastic repairs or asphaltic based surfaces with Alphaguard WB Primer prior to installing Alphaguard Base Coat.

    7. Generator Roof Pitch Pans

      1. Fill pitch pans with Polyroof SF and allow to cure 1 day prior to Alphaguard installation.

      2. Prime metal pitch pan with Alphaguard M-Prime.

      3. Prime cured Polyroof SF with Alphaguard WB Primer.

      4. Apply Alphaguard Base coat onto primed pitch pan and transition a minimum of 4” onto roof surface.

      5. Immediately embed Permafab reinforcement into wet base coat.

      6. Allow base coat to cure and install Alphaguard finish coat over previously coated and cured Alphaguard base coat.

  2. Mixing

    1. Mix the Alphaguard Base Coat activator into the Alphaguard Base Coat prior to application. Mix the Alphaguard Top Coat activator into the Alphaguard Top Coat prior to application. There are 2 activators, one for the base coat and a different one for the top coat. It is recommended that the top coat activator is not on the roof with the rest of the materials until all the base coat work is complete.

      1. If in the event the activator does not get mixed into the base coat or top coat, the product will not cure and will have to be scraped & wiped clean and then pressure washed prior to installing the material properly.

    2. Do not apply product when ambient temperatures are below 45 degrees Fahrenheit or when overnight temperatures drop below 40 degrees Fahrenheit.




  1. Flashings

    1. Any loose aluminum facers on flashings needs to be removed.

    2. Flashings must be dry prior to application of primer and Alphaguard System.

    3. Prime aluminum facers on the flashings with Alphaguard M-Prime.

    4. For parapet walls if the wall is a solid wall there is no need to remove copings to install the Alphaguard on the top of the parapet. Apply the base coat directly to the flashings up to the metal coping and immediately embed the reinforcement. The flashings will be fully reinforced.

      1. Stop the reinforcement fabric approximately 1” below the metal coping.

    5. Apply Alphaguard top coat over the cured base coat up to the metal coping.




  1. Coating Installation

    1. Roof must be dry prior to application of Alphaguard Roof System.

    2. Ensure proper coverage rates by visibly marking off 100 square feet sections prior to installing the base coat and the top coat.

    3. Apply Alphaguard Base Coat to membrane by pouring directly onto surface. Spread evenly at 4 Gallons per 100 square feet on field of the roof, flashings, and penetrations.

      1. Immediately embed the 40” Permafab Alphaguard reinforcement into wet Base Coat. Work in with a roller until fully embedded.

      2. Overlap side laps 3” minimum and end laps 6” minimum.

      3. Surface texture and condition may affect the actual coverage.

      4. All Permafab must be encapsulated and embedded in the Alphaguard Base Coat by the end of each work day.

    4. The Base Coat must be coated with the Finish Coat within 72 hours of tack free cure of Base Coat or it will be required to prime before applying the Finish Coat.

    5. Apply Finish Coat by pouring directly onto the surface. Spread evenly at 2 Gallon per 100 square feet over all previously coated areas. Surface texture and condition may affect the actual coverage. The gray color of the Base Coat must be fully covered by the white Finish Coat for proper system performance.

    6. Allow to cure 24 hours prior to any foot traffic.
