Dwelling unit. A room or combination of rooms designed for year-round habitation, containing a bathroom and kitchen facilities, and designed for or used as a permanent residence by at least one family. Eating, Drinking and Entertainment Establishment, drive-in. An establishment designed to accommodate the consumption of food and/or beverages in motor vehicles on the premises of such establishment, or an Eating, Drinking and Entertainment Establishment with a drive-in service window and/or outdoor service window having indoor seating accommodation for fewer than 50 patrons. (Petition No. 2013-090, §2.201, 07/21/2014) Eating, Drinking and Entertainment Establishment, Type 1 (Petition No. 2013-090, §2.201, 07/21/2014) An establishment where food is prepared and beverages may be provided, excluding alcohol. Indoor and outdoor entertainment may be provided. (Petition No. 2013-090, §2.201, 07/21/2014) Eating, Drinking and Entertainment Establishment, Type 2 (Petition No. 2013-090, §2.201, 07/21/2014) An establishment where any alcohol is consumed, food and other beverages are optional, and entertainment may be provided, including outdoor entertainment. Excluded from the Type 2 Eating, Drinking and Entertainment Establishment are adult establishments, athletic and sports facilities, conference centers, cultural facilities, hotels and motels, and recreational facilities approved as part of a residential development plan, and similar uses, and uses exempt in accordance with the Alcohol Beverage Commission standards. A privately-owned or publicly-owned kindergarten (where students are 4 or more years in age), elementary school, middle school, junior high school, or high school, licensed by the state of North Carolina as a school. (Ptition No. 2008-061, §2.201, 04/21/08) Entertainment. Entertainment means any activity or game that is live, broadcast, or recorded, including, but not limited to, dancing, music, theater or comedy performance, sporting event, trivia game, or game of skill or chance. (Petition No. 2013-090, §2.201, 07/21/2014) Façade Modulation. Variations in the plane of a building wall that break up the mass and bulk of a building. Façade modulation is calculated as the area created between the front building line and the recessed building façade. (Petition No. 2013-026, § 2.201, 06-16-2014) Family. An individual, or two or more persons related by blood, marriage, or adoption living together as a single housekeeping unit; or a group of not more than six persons not related by blood, marriage or adoption, living together as a single housekeeping unit.
