Appendix 5—Freedom of information
Agencies subject to the Freedom of Information Act 1982 (the FOI Act) are no longer required to publish an annual report statement pursuant to former section 8 of the FOI Act.
Former subsection 8(1) of the FOI Act set out the information which was previously published and updated each year in annual reports. This reporting requirement included preparation of a statement:
-
setting out the particulars of the organisation and its functions
-
setting out the arrangements by which any person or bodies outside the Commonwealth administration could participate in policy formulation or in the administration by the agency
-
identifying the categories of documents that are held by the department and how members of the public could get physical access to documents held by the agency
-
advising the procedures for gaining access to documents.
Agencies are now required to publish similar information to the public as part of the Information Publication Scheme (IPS). This requirement is contained in Part II of the FOI Act and has replaced the former requirement to publish a section 8 statement in an annual report.
The department’s agency plan showing what information is published in accordance with the IPS requirements is accessible from the department’s website at .
Information which would previously have been found in the department’s section 8 statement can now be found on the department’s website .
