52. ASSIGNMENTOFANTITRUSTACTIONS: Pursuantto GovernmentCode Sections4552,4553,and4554,the following provisionsareincorporatedherein:
a) In submitting a bid to the State, the supplier offers and
agreesthatifthe bidisaccepted,itwillassignto the Stateall rights,title,andinterestinandto allcausesofactionitmay have under Section 4 of the Clayton Act (15 U.S.C. 15) or under theCartwrightAct(Chapter 2,commencing with Section 16700, ofPart 2 ofDivision 7 ofthe Businessand Professions Code), arising from purchases of Goods, materialorotheritems,orservicesbythe supplierfor sale to theStatepursuanttothe solicitation. Suchassignmentshall
be madeandbecome effectiveat thetimetheStatetenders finalpayment tothesupplier.
b) IftheStatereceives,eitherthroughjudgmentorsettlement, amonetaryrecoveryforacauseofactionassignedunder
this chapter, the assignor shall be entitled to receive
reimbursementforactuallegalcostsincurredand may,upon demand,recover fromthe State anyportionof therecovery, including treble damages, attributable to overcharges that were paidby theassignor butwere notpaidby the State as partofthebidprice,lessthe expensesincurredinobtaining thatportionoftherecovery.
c) Upondemandinwritingbytheassignor,theassigneeshall, withinoneyearfromsuchdemand,reassignthe causeof actionassignedunderthispartiftheassignorhasbeenor mayhavebeeninjuredbytheviolationoflawforwhichthe causeofactionaroseand
(i) theassigneehasnotbeeninjuredthereby,or
(ii) theassigneedeclinestofilea courtaction for thecause ofaction.
certifiesunderpenalty ofperjury underthelawsoftheStateof CaliforniathattheContractorwill complywith therequirementsof the Drug-Free Workplace Act of 1990 (Government Code Section8350etseq.) andwillprovideadrug-freeworkplace by takingthefollowingactions:
a) Publishastatementnotifying employeesthatunlawful manufacture, distribution, dispensation, possession, oruse ofacontrolledsubstanceisprohibitedandspecifyingactions to be taken againstemployeesforviolations,asrequired by Government CodeSection8355(a).
b) Establish a Drug-Free AwarenessProgramasrequired by Government Code Section 8355(b) to inform employees aboutallof thefollowing:
(i) thedangersofdrugabuseintheworkplace;
(ii) theperson'sororganization'spolicyofmaintaininga drug-freeworkplace;
