2. Description of the Action: The proposed action is for a

firm-fixed-price (FFP) delivery order issued under the National

Aeronautics and Space Administration (NASA) Solutions for

Enterprise-Wide Procurement (SEWP) IV Government-Wide Acquisition

Contract for the procurement of 205 Terabytes (TB) of brand name

CommVault Simpana CommCell Data Protection Advance (DPA) Suite software

usage licensing and associated maintenance. This action is to purchase

additional backup software usage licensing and maintenance to augment

existing licensing for the Office of Information and Technology (OI&T),

Field Operations Region 3's two centralized CommVault CommCells

installed and operating in each respective non-Vista Data Center in

Cleveland, Ohio and the Durham, North Carolina VA Medical Centers

(VAMC). The period of performance will consist of a 30 day delivery

schedule for the CommVault CommCell DPA Suite software usage licensing,

followed by 12 months of maintenance support.

3. Description of Supplies or Services: This requirement is to

purchase brand name CommVault Simpana CommCell DPA software usage

licensing and maintenance to augment existing OI&T Region 3 CommCells

and allow support of additional Veterans Health Administration VAMC

servers and database backups of its critical data in support of direct

patient care operations. The required 205 TB of software usage

licensing and maintenance support will be utilized within the Region 3

facilities (Cleveland and Durham VAMCs) which currently utilize the

CommVault Simpana backup software to provide standardized backup, file

replication, and data recovery solutions that support facility disk

tiering and data protection requirements. The licensing is also

required to support Region 3's alternate site processing of its critical

virtualization environment. The CommVault Simpana Suite CommCell

software licenses are provided on a usage basis. The total estimated

dollar value of the required additional CommVault Simpana CommCell DPA

software usage licensing and maintenance is

4. Statutory Authority: The statutory authority permitting an

exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as

implemented by the Federal Acquisition Regulation (FAR) Subpart

16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing

the supplies or services required at the level of quality required

because the supplies or services ordered are unique or highly

specialized."

5. Rationale Supporting Use of Authority Cited: This is a brand name

justification in support of FAR 11.105, Items Peculiar to One

Manufacturer. OI&T Region 3 currently utilizes CommVault Simpana Suite

software, specifically the CommVault Simpana CommCell and Simpana One

Pass backup software, with a lifecycle centralized file system to manage

the Region's two petabyte centralized file storage devices. CommVault

Simpana CommCell and CommVault Simpana One Pass backup software are

utilized across all of the Region's 41 facilities to provide a

standardized file archiving and backup solution. VA has established a

centralized file backup system wherein all of Region 3's CommVault

licenses are consolidated into three Region 3 CommVault CommCells

located at the Cleveland, Ohio data center; the Durham, North Carolina

data center; and the Warner Robbins, Georgia Air Force Base Defense

Information Systems Agency data center. This procurement is to purchase

additional license capacity for the Cleveland and Durham locations only.

VA requires ongoing backup actions to be monitored from one console and

currently utilizes a one console, one solution to manage the Region 3

data center and facility assets which has provided significant

improvement in Region 3 core system service line operations and support.

CommVault Simpana Suite is the only software that provides a one

console, one solution configuration to manage backup jobs including disk

to disk or tapes and also provides visibility to all physical locations.

Additionally, in accordance with Region 3 Core System Standards, backup

software is required to have agentless backup capability and archived

data must be searchable, without full retrieval from the data center.

CommVault Simpana Suite is the only software that has these

capabilities. Furthermore, no other product can transmit file level and

block level data into a single encrypted transmission to backup files in

remote locations, which is required by VA standards. In addition, in

accordance with VA Security requirements, backup software is required

to have Federal Information Processing Standards (FIPS) 140-2

certification. CommVault Simpana Suite is the only backup software that

has this required certification.

6. Efforts to Obtain Competition: Market research was conducted,

details of which are in the market research section of this document.

In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), this action will

be synopsized and the Justification will be made available within 14

days of award on the Federal Business Opportunities Page (FBO). In

addition, in accordance with FAR 16.505(a)(4)(iii)(A), this

Justification for an Exception to Fair Opportunity will be posted on the

NASA SEWP IV website with the solicitation.

7. Actions to Increase Competition: In order to remove or overcome

barriers to competition in future acquisitions for this requirement, the

Government will continue to perform market research to determine if

there are any products and/or source providers available that will

enable future requirements to be competed.

8. Market Research: The market research for this acquisition was

conducted in February 2014. The Region 3 OI&T technical experts

performed market research by conducting internet searches,

demonstrations, and reviewed the technical data for backup software

products. The Region 3 OI&T team looked at the backup software products

from multiple vendors to include CommVault Simpana, Asigra, Netbackup,

and Symantec Backup Exec. The backup software offered by Asigra and

Symantec Backup Exec do not provide the capability to manage backups

through one console, one solution. Netbackup and Asigra do not provide

agentless backup capability or searchable archive capability. In

addition, only CommVault Simpana CommCell Suite software has the

required FIPS 140-2 certification. None of the other backup software

products reviewed can meet all of VA's functional requirements as

discussed in paragraph five of this document. Based upon this research,

the Government's technical experts have determined that only CommVault

brand name software can meet all of VA's requirements identified in

Paragraph 5.
