Foreword contained herein are the regulations and/or procedures formulated by the administrators of the Buffalo City School District. The organizing system in this manual utilizes the same numerical coding as in the Buffalo City School District Policy

SUBJECT: STAFF USE OF COMPUTERIZED INFORMATION RESOURCES


The District's computer system (DCS hereafter) is provided for staff to enhance the educational programs of the District, to further District goals and objectives; and to conduct research and communicate with others.


Generally, the same standards of acceptable staff conduct which apply to any aspect of job performance shall apply to use of the DCS. The standards of acceptable use as well as prohibited conduct by staff accessing the DCS, as outlined in District policy and regulation, are not intended to be all-inclusive. The staff member who commits an act of misconduct which is not specifically addressed in District policy and/or regulation may also be subject to disciplinary action, including loss of access to the DCS as well as the imposition of discipline under the law and/or the applicable collective bargaining agreement. Legal action may also be initiated against a staff member who willfully, maliciously or unlawfully damages or destroys property of the District.
Staff are encouraged to utilize electronic communications in their roles as employees of the District. Staff are also encouraged to utilize electronic means to exchange communications with parents/guardians or homebound students, subject to appropriate consideration for student privacy. Such usage shall be limited to school related issues or activities. Communications over the DCS are often public in nature; therefore, general rules and standards for professional behavior and communications will apply.
The District's policies and accompanying regulations on staff and student use of computerized information resources establish guidelines for staff to follow in instruction and in working with students on acceptable student use of the DSC, including access to external computer networks.
Privacy Rights
Staff data files, e-mail and electronic storage areas shall remain District property, subject to District control and inspection. The computer coordinator may access all such files and communications to ensure system integrity and that users are complying with requirements of District policy and accompanying regulations. Staff should NOT expect that information stored on the DCS will be private.
Prohibitions
It is not the intention of this regulation to define all inappropriate usage. However, in addition to the general requirements of acceptable staff behavior, activities which shall be prohibited by staff members using the DCS include, but are not limited to, the following:


  1. Using the DCS which in any way results in unauthorized charges or expense to the District.

  1. Damaging, disabling or otherwise interfering with the operation of computers, computer systems, software or related equipment through physical action or by electronic means.




  1. Using unauthorized software on the DCS.




  1. Changing, copying, renaming, deleting, reading or otherwise accessing files or software not created by the staff member without express permission from the computer coordinator.




  1. Violating copyright law.




  1. Employing the DCS for commercial purposes, product advertisement or political lobbying.




  1. Disclosing an individual password to others or using others' passwords.




  1. Sharing confidential information on students and employees.




  1. Sending or displaying offensive messages or pictures.




  1. Using obscene language.




  1. Harassing, insulting or attacking others.




  1. Engaging in practices that threaten the DCS (e.g., loading files that may introduce a virus).




  1. Violating regulations prescribed by the network provider.




  1. Use of the DCS for other than school related work or activities.




  1. Assisting a student to violate District policy and/or regulation, or failing to report knowledge of any student violations of the District's policy and regulation on student use of computerized information resources.




  1. Use which violates any other aspect of Buffalo City School District policy and/or regulations, as well as local, state or federal laws or regulations.

Any user of the DCS that accesses another network or other computer resources shall be subject to that network's acceptable use policy.

Sanctions
The computer coordinator will report inappropriate behavior to the staff member's supervisor who will take appropriate disciplinary action. Any other reports of inappropriate behavior, violations or complaints will be routed to the staff member's supervisor for appropriate action. Violations may result in a loss of access to the DCS and/or disciplinary action. When applicable, law enforcement agencies may be involved.
Notification
All staff will be given a copy of the District's policies on staff and student use of computerized information resources and the regulations established in connection with those policies. Each staff member will sign an Acceptable Use Procedure for Technology Form (Form #6470F) before establishing an account or continuing their use of the DCS.

ACCEPTABLE USE PROCEDURES FOR TECHNOLOGY

DISTRICT EMPLOYEE
The Buffalo Public School System makes available a variety of technological resources to support learning and enhance instruction. The District's goal is to provide access to technology tools to facilitate resource sharing, innovative instructional opportunities, and communication. The users (defined as any employee utilizing a District computer) of these tools assume certain responsibilities, including the use of technology in an ethical manner.
GUIDELINES FOR ACCEPTABLE USE OF COMPUTERS AND COMPUTER NETWORKS IN SCHOOLS: The District encourages students to use computers and technology available in the Buffalo Public School System; however, with these privileges comes responsibility. Users are expected to:
Respect the privacy of others.

  • Users will not try to learn passwords of other users or network administrators.

  • Users will not attempt to gain unauthorized access to networked or stand alone systems.

  • Users will not modify or read files of other individuals; however, it should be noted that network system managers have access to all files. Privacy shall not be assumed.




  • Respect the legal protection provided by copyright and license to programs and data.

  • Users will not make copies of licensed programs, in violation of copyright laws.

  • Users will not install their own software on District computers without authorization.




  • Respect the integrity of every computer and of the Buffalo Public School Networks and other networks to which the District is connected.

  • Users will not intentionally develop or use programs to harass others or infiltrate a computing system or damage or alter the software components or network.

  • Users will not intentionally send inappropriate, obscene or hateful messages/mail to others.

  • Users will not copy or modify server or network system files.

  • Users will not block access (use encryption programs) on District computers without authorization.




  • Respect the materials and resources of the Buffalo Public School System.

  • Users will not play unauthorized games on District computers.

  • Users will not use the District's computer resources for non-academic activities or non-work related activities during work time.

  • Users will properly utilize computer time and will not waste limited resources or supplies that are provided by the Buffalo Public School System.

  • Users will work in ways that will not disturb others.




  • Respect the materials and resources of Internet accounts.

  • Users will not send or receive offensive material over the internet.

  • Users will not use obscene, offensive, harassing, insulting, or otherwise abusive language over the Internet or on e-mail.

In accordance with the Child Internet Protection Act all internet activity within the Buffalo Public School District is both electronically filtered and monitored. Requests to gain access to external internet sites are filtered for appropriate content. The type of sites accessed is also monitored. This is done for the protection of our children and staff. It is also a requirement of the FCC in order to allow the District to participate in the Federal E- rate Program.

The use of personal computer equipment connected to the district’s Local Area Network (LAN) within district buildings is prohibited. To facilitate remote maintenance, staff is prohibited from disabling remote access to computer equipment on nights and weekends.
A violation of the Acceptable Use Procedures for Technology may result in the loss of computer privileges. It may also result in appropriate action for employees pursuant to the applicable contract provisions.

SUBJECT: FAMILY AND MEDICAL LEAVE ACT

The Family and Medical Leave Act of 1993 (FMLA) requires public agencies to provide up to twelve (12) weeks of unpaid, job-protected leave to "eligible" employees for certain family and medical reasons. Employees are "eligible" if they have worked for a covered employer for at least one (1) year, and for 1,250 hours over the previous twelve (12) months.


Reasons for Taking Leave
An employer must grant unpaid leave to an eligible employee for one (1) or more of the following reasons:


  1. For the care of the employee's child (birth, or placement for adoption or foster care);




  1. For the care of the employee's spouse, son or daughter, or parent/guardian, who has a serious health condition; or




  1. For a serious health condition that makes the employee unable to perform their job.

At the employee's or employer's option, certain kinds of paid leave may be substituted for unpaid leave.


Advance Notice and Medical Certification
The employee may be required to provide advance leave notice and medical certification.


  1. The employee ordinarily must provide thirty (30) days advance notice when the leave is "foreseeable."




  1. An employer may require medical certification to support a request for leave because of a serious health condition.




  1. An employer may also require medical certification if the employee is unable to return from leave because of a serious health condition.


Intermittent or Reduced Leave


  1. An employee may take intermittent leave or may work a reduced leave schedule to reduce the usual number of hours per day or work week.




  1. Intermittent or reduced leave schedules are subject to employer approval unless medically necessary.
