DISPOSITION WITHOUT TRIAL


  • Adversarial tools that allow for the party/court to end the process earlier than the final trial (e.g. striking out a pleading, summary judgement, etc.)

  • Contrast to non-adversarial ways (mediation, case conference etc. where parties agree to a resolution)

  • All these tools are brought by way of a motion (except r.2.1)

Summary of Possible Tools:





  • Motions to strike, stay and dismiss (r.21)

  • Summary judgement (r.20)

  • Special case (r.22)

  • Default proceedings (r.19)

  • Dismissal for delay (r.24)
