5. Deposit. Landlord has agreed to waive the security deposit for this lease.


6. Acceptance of Premises “As Is”. Tenant acknowledges it has examined the Premises and accepts the Premises in its present condition “AS IS” and as of the date of possession by Tenant. Tenant further acknowledges that Landlord makes no representation or warranty as to the condition of the Premises, any use to which the Premises may be put as to the suitability of the Premises for any endeavor. Tenant’s entry on the Premises and its use thereof is at its own risk.
7. Utilities. Landlord shall not pay for or provide any utilities to the Premises. Tenant shall not install nor connect any water, sewer, gas, electricity, telephone and other utilities and services on the Premises during the Term.


8. Repairs and Maintenance. Tenant shall, at its sole expense, shall make all repairs and replacements necessary to restore the Premises to its condition upon taking possession. Upon expiration of the Lease Term, whether by lapse of time or otherwise, Tenant shall promptly and peacefully surrender the Premises to Landlord in as good condition as when received by Tenant from Landlord or as thereafter improved, reasonable wear and tear and insured casualty excepted.


9 Insurance. During the Lease Term, Tenant shall pay for and maintain commercial general liability insurance. This policy shall name Landlord and *** its affiliate ** as an additional insured, and shall insure Tenant’s activities and those of Tenant’s employees, officers, contractors, licensees, agents, servants, employees, guests, invitees or visitors with respect to the Premises against loss, damage or liability for personal injury or death or loss or damage to property with a occurrence limit of not less than $1,000,000.00 and aggregate limit of $3,000,000. By executing this Lease, Landlord acknowledges it has reviewed and approved the certificate of insurance provided by Tenant in accordance with this provision.
