MARKET ASSIGNMENTS 1. Markets, will be assigned to each agent/broker based on the date received and the priority in which the companies are requested. 2. All market request forms must be in writing, (fax acceptable) and received by Kathy Arrington, Director Budget & Purchasing no later than the close of business on November 6, 2009. 3. Assignments will be based on:
Primary request by only one agent/broker. Strong qualifying evidence that the assignment to the requesting agent/broker is more beneficial to the County than assignment to another agent/broker. Conflicts not addressed under a.) or b.) may be resolved through negotiations. A secondary request may be assigned a Market based on choice and availability. All markets are available except the current excess carrier Safety National Casualty Corp. whose policy runs 01/01/2009 to 01/01/2010 with limits as follows Self Insured Retension (SIR) $ 750,000 Workers Compensation Limits $ 25,000,000 Employers Liability Limits $ 1,000,000

BROKERS/AGENTS INSURANCE REQUIREMENTS 1. The Contractor shall provide and pay for insurance coverage of such types and in such amounts as will completely protect the Contractor and the County, its elected officials, officers, agents, servants, employees and assigns against any and all risks of loss or liability arising out of this Contract. 2. The following is the minimum mandatory type and amount of insurance coverage to be carried in accordance with this Article: (a) Professional Liability insurance including errors and omissions coverage which shall protect CONTRACTOR and the COUNTY from all claims which may arise out of or result from CONTRACTOR’S operations under this contract. 3. Neither approval by the County nor failure to disapprove Certificates of Insurance furnished by Contractor shall release Contractor of full responsibility for all liability and casualty claims or losses. Insurance is required as a measure of protection and Contractor’s liability is not limited thereby. 4. The Certificate shall be subject to the review and approval of the County Counsel or Risk Manager. 5. If at any time during the term of this contract or any extension thereof, any required policies of insurance should expire or are canceled, it will be the responsibility of the Contractor to furnish to the County, Certificate of Insurance indicating renewal or an acceptable replacement of the expiring policy prior to the expiration or cancellation date so that there will be no lapse in any coverage. The County reserves the right to waive or modify any of the proceeding insurance requirements in the event of demonstrated unavailability of coverage or financial handicap. Any request for waiver or modification of these insurance requirements, due to the non availability of cost of procuring either the type of limits of insurance required herein must be made in the proposal and any such requests shall include a detailed explanation of the basis for the request. Workers’ compensation insurance fund The governing body of a local unit may create and appropriate money for a fund to be designated and known as “The Workers’ Compensation Insurance Fund.” The money so appropriated shall be deposited in the name of the local unit in a National or State bank or trust company and remain there as a trust fund.
