FINING POLICY
Infraction(s) to any of the Association Rules or Rules and Regulations (R&R’s) in this publication (Infraction(s)) or other Governing Documents may result in penalties, including but not limited to, fines being levied to Owner’s account and/or suspension of rights and privileges.
All Owners will have an opportunity for due process. Before the Board of Directors imposes penalties, the Board will conduct a hearing. The Owner will be given notice of this hearing at least 10 days prior to the hearing. At the hearing, the Owner will have an opportunity to address the Board. The Owner will receive a written notice of the outcome of that hearing within 15 days of the hearing.


  1. Disciplinary proceedings may be initiated upon the receipt of a written complaint (“Complaint”), reported by Security Service, Property Management Company, Homeowners, residents or the Board of Directors.

  2. Once a Complaint is received, the offending Owner will be sent a Notice of Hearing. The Notice of Hearing will advise the Owner that a hearing before the Board of Directors will be held. The Notice of Hearing will provide the nature of the alleged infraction; the date, time and location of the hearing, and a statement that the Owner has the right to attend the hearing and address the Board.

  3. If the Board finds a violation of the governing documents has occurred, the Board may impose a fine of $150.00 per infraction subject to the continuing infractions and damage and vandalism exceptions below.

  4. The Association may hold an Owner financially responsible for any and all damages to or vandalism of properties of the Association. In addition, Board of Directors may impose a fine from $300.00 up to $1,500.00 that is reasonably proportionate to the damage or vandalism caused and/or suspension of rights and privileges.

  5. For continuing infractions, the Association may impose $20.00 per day maximum for each day the infraction(s) exists after specified date as motioned and approved by the Board at the hearing. Continuing infractions are defined as infractions that are continuing in nature (such as an un-remedied architectural violation). The Board may impose a daily fine without further hearing. However, multiple infractions/violations of the same restriction cannot be considered a continuing infraction and require further hearings before fines may be imposed. The Owner will be notified in the initial hearing notice that the alleged infraction(s) may be deemed a continuing infraction, potentially subjecting the Owner to periodic fines without further notice.

  6. When fines reach $750.00, an action to collect may be taken in Small Claims Court.

  7. In addition to imposing fines, the Association has the right to suspend an Owner’s membership rights and privileges, together with any voting rights for any period of time during which the assessment of a Member’s Condominium remains unpaid or for a period not to exceed thirty (30) days for any infraction/violation of the Association’s governing documents. (CC&R, section 2.1.4)

The Avalon at Eagles Crossing Homeowners’ Association has adopted the following policies. Please read this information carefully and refer to it as needed.

PLUMBING REPAIRS AND DAMAGES CAUSED FROM LEAKS (Adopted 8/8/95)

As stated in Section 6.2 OWNER RESPONSIBILITY FOR LIVING UNIT of the Declaration of Restrictions, the homeowner has responsibility for a plumbing repairs and the repair of any water damage created by a plumbing leak.

It is the homeowner’s responsibility to determine the location of any leak and take immediate corrective action, and always within two hours. It is also the homeowner’s responsibility to take every measure necessary to prevent damage to any other living unit, or common area. The managing agent for the Association must be contacted immediately if it is determined that the leak is caused by a component which falls under the responsibility of the Association.

In the event it becomes necessary for the Association to make plumbing repairs that are the Homeowner’s responsibility, your account will be charged for all costs incurred. Payment is due in full within 30 days.


PLUMBING WHAT TO DO IN THE EVENT OF A PLUMBING LEAK

In the event of a leak, you must take corrective action, within two hours of discovering a leak. It is the homeowner’s responsibility to determine the location of any plumbing leaks.


1) Shutting off the water to your building.
2) Notify each of your neighbors advising them that the water will be off. If no one comes to the door, place a note on the window closest to the front door or on the door handle (no tape on the door, please).
3) Call the Association’s property manager to determine what the next step should be.
4) If so advised by management, call a plumber.


INSURANCE COVERAGE
The association’s policy covers the common area and has a $10,000-deductible, not covered by the association. It is vital that all Unit Owners are insured with Homeowners’ Insurance to protect your home and finances. Contact your individual insurer to ensure you are sufficiently insured with HO6 Insurance, which covers the deductible, your personal property and particularly exclusive use plumbing lines, i.e., coverage in an event of a leak or burst of water pipe such as a water heater, refrigerator’s icemaker, washing machine hoses, toilets, etc.

In addition, while on vacation and/or part-time residents; it is recommended that you shut off all plumbing valves, i.e., on your refrigerator’s icemaker, washing machine, sinks and toilets to help prevent water damage while you are away.




COMMON AREA LANDSCAPE (Adopted 8/8/95)
The Association is responsible for the maintenance, repair, and replacement of landscape in all common areas. Homeowners/Residents may not place landscape material in any common area grounds. This policy is being adopted to ensure that there is landscape uniformity of the common area grounds.


POTTED PLANTS/RAILINGS (Adopted 8/8/95)
Potted plants may not be placed on top of any railing or ledge. Potted plants may only be placed on the interior side of any balcony or patio.
Potted plants are permitted on stairway landings, as long as they do not interfere with the passage of any person using the staircase. Potted plants are not allowed to be placed on the stairs at any time. All potted plants must have a water tray under the pot/plant caddy to prevent damage to any building surface.


HOOK/HANGER INSTALLATION-STUCCO (Adopted 7/11/95, Revised to include adhesives 3/99)
The installation of hooks or any other such hardware by penetrating the surface of the stucco or by the use of adhesives is not allowed on any building. This policy is being adopted to prevent water intrusion, additional maintenance costs for the association, and to help reduce the infestation of termites.

COMMUNITY BULLETIN BOARD (Adopted 7/11/95, Revised June, 2014)
The Association provides a community bulletin board (located in the breezeway, between the clubhouse and exercise room) for residents to place items for sale, services, etc. All notices must be printed legibly or typed on a 3”X5” card and submitted to the Property Manager for posting in the bulletin board. Personal notices must be dated and may be posted for 30 days on the bulletin board. Only notices regarding Association business are allowed on the mail stations. No personal notices are allowed in this area. No notices of any nature are allowed on the dumpster areas.


SKATEBOARDING, ROLLER BLADING, BIKE RIDING (Adopted 7/11/95, Revised July 2002)
Skateboarding, roller blading, razors, bike riding and scooters (motorized or not) or Motorized Cars are NOT allowed within Avalon’s walkways.


WINDOW TREATMENTS (Adopted 2/11/92)
All homeowners must install interior window treatments on all windows within 60 days after the close of escrow. Approved window treatments are drapes, blinds, shades and shutters. The exterior side of the window treatment must blend with the stucco color of the exterior fascia of the building. Any variance to this policy requires the approval of the Architectural Review Committee and/or Board of Directors.
Window treatments that have been installed in Phase I, as of March 30, 1992, and do not meet the established guidelines are exempt from this policy. However, at the time of replacement of any window treatment, the homeowner is required to follow this policy.


WINDOW TINTING (Adopted 5/12/98)
Window tinting must be no darker than the industry standard shade of 52% heat rejection. Architectural improvement application must be filled out by the homeowner and submitted to the Architectural Committee prior to installation.


SCREEN DOOR POLICY(Adopted 8/8/00, Revised June, 2014)
Homeowners may select any style of screen door or security screen door to be installed in their unit provided that it is white or cream in color. The screen may be either silver or black. Architectural improvement application must be filled out by the Homeowner and submitted to the Architectural Committee prior to installation.

TO ADD, MODIFY OR DELETE ANY OF THE BELOW STATED RULES AND REGULATIONS (R&R’s).

OTHER RULES AND REGULATIONS ADOPTED
NO SOLICITING (Adopted June, 2014)
No door-to-door soliciting and/or pamphlets placed on doors. These are prohibited for the safety of Avalon’s residents. “NO SOLICITING” signs are posted at the entrances of the Avalon complex.


NO SMOKING IN COMMON AREA (Adopted June, 2014)
Smoking is not allowed in the Common Area.


GARDEN HOSES (Adopted June, 2014)
Garden Hoses are prohibited in the Common Area.


CAR WASHING (Adopted June, 2014)
Washing of vehicles is prohibited in the Common Area.






SWIMMING POOL AND SPA RULES
The pool and spa hours are from 7 a.m. to 11 p.m. Please obey all pool and spa rules. Be respectful of one another and enjoy!
The following are the Pool and Spa Rules which are posted and must be adhered to:

The intent of these rules is to provide a safe and enjoyable pool and spa area for ALL. Any activities specified or not, which interfere with the safe and courteous use of these facilities is prohibited. Failure to observe these regulations will result in a fine and/or suspension of privileges.




  1. Please shower before using either facility.




  1. Number of guests that may be invited to pool and spa area is limited to six (6) at any given time.




  1. All resident children under 14 years old must be accompanied and supervised by a responsible adult resident 18 years of age or older from their residence Unit when using the pool or spa. All guests must be accompanied and supervised by a responsible adult resident 18 years of age or older from the host Unit when using the pool or spa. Residents are responsible for the conduct of guests and children in their care.




  1. No alcohol beverages or food is permitted inside the pool/spa area. No glass containers or breakable items are allowed in the pool/spa area. Food and alcohol beverages are allowed in the picnic areas outside the pool/spa gates. Do not throw cigarettes on the ground.




  1. Entry gates must be locked at all times.




  1. Only proper swimwear must be worn in the pool or spa. No persons wearing “cut off” clothes, “T-shirts” or wet suits are allowed to use the pool or spa.




  1. Running, pushing, horseplay is not allowed. Horseplay is defined as any activity, which endangers people or disrupts normal pool activities. Excessive noise is prohibited.




  1. Diving in the pool or spa is prohibited.




  1. Boogie boards, large floats, hard balls, footballs, etc. are prohibited. Swim fins, snorkel masks, swim boards, single person air mattress, softballs, and floatation safety aids are allowed.



  1. Entering pool or spa with suntan oil is prohibited. Entering the pool or spa after using sun block lotions is acceptable. Use of shampoo, bubble bath or soap of any kind in the pool or spa is prohibited.




  1. All incontinent persons are prohibited from using the pool and spa.




  1. No animals are allowed in the pool or spa areas.




  1. Please turn off spa jets and replace cover when not in use.


SPA: DO NOT USE MASTER SAFETY SWITCH (IN RED BOX) TO TURN OFF JETS. JETS WILL TURN OFF WITH TIMER SWITCH.
The Homeowners Association Does Not Provide Life Guard Supervision And Assumes No Liability For Accidents.


The Avalon at Eagles Crossing Homeowners’ Association

Satellite Dish Installation and Maintenance Policy (Revised June, 2014)


  1. The term “qualified satellite receiver” as used within this policy means (1) a satellite dish or other antennae, that is, one (1) meter or less in diameter, or diagonal measurement, which is designed to received direct broadcast satellite service (including direct-to-home satellite service), or to received or transmit fixed wireless signals via satellite (or other than via satellite) or video programming service via wireless cable (MMDS) or (2) an antenna designed to received local television broadcast signals. Satellite dishes larger than one (1) meter in diameter, and any other antennae not covered by the Telecommunications Act of 1996 (the “Act”) are prohibited as provided in the Association’s governing documents.




  1. No fee or deposit payable to the Association shall be required prior to installation of a qualified satellite receiver.



  1. A resident may install a qualified satellite receiver in the resident’s Unit or on the patio/balcony in the location necessary for the signal strength desired by the resident. If more than one location in the Unit or on the patio/balcony will provide the requisite signal strength, resident must place his or her qualified satellite receiver in the location which will minimize the visual effect of the equipment on the Common Areas and other residents.




  1. Upon installation of a qualified satellite receiver, resident shall be responsible for the maintenance, repair and replacement of the qualified satellite receiver and shall not permit the same to become unsightly.




  1. Qualified satellite receivers MAY NOT be installed on ANY part of the Association Common Areas. The ONLY exception to the provision is as follows:

The Board of Directors adopted a policy in November 2000 to allow installation of a qualified satellite receiver on the wood fascia board below the roof tiles and gutters only if no other location allows signal reception. (See paragraphs 10 and 11 for important installation instructions)


  1. Resident shall indemnify and hold harmless the Association, and it agents, directors, officers, and employees, from any and all loss, claim, damage, injury, judgment, or cost, including attorneys’ fees and court costs, resulting from or arising out of resident’s installation, maintenance, or use of the qualified satellite receiver, to the extent that resident’s negligence in installation, maintenance, and/or use of the qualified satellite receiver caused or resulted in the loss, claim, damage, injury, judgment or cost, including attorneys’ fees and court costs being indemnified.




  1. Nothing in this policy is intended to unreasonably increase the resident’s cost of installing a satellite receiver, unreasonably delay the installation, or unreasonably decrease the reception of the signals received. Should any resident believe that anything in this policy unreasonably affects the cost, delays installation, or decreases signal strength, the resident is encouraged to contact Management to discuss and resolve the matter.




  1. Nothing in this policy is to be interpreted as being in contravention of the Act regarding the installation, maintenance, and use of satellite dishes. Should any portion of this policy be interpreted as contravening the Act, that section or sections shall be considered immediately modified to conform to the Act. Should it be impossible to modify the section or sections that section or sections shall be deemed severable from the remainder of the policy, and should be of no force and effect whatsoever.




  1. Resident of the Unit shall execute a copy of this policy and provide the signed copy to the Board of Directors within thirty (30) days of the installation of the qualified satellite receiver.


Fascia board Installation instruction:

  1. If no other location will allow signal reception, the qualified satellite receiver may be mounted to the wood/fascia board below the roof tiles above the balcony. No part of the installation process can involve penetrating the roof, roof tiles, common area stucco or gutters in any way.




  1. Residents who wish to uninstall the qualified satellite receiver from the wood/fascia board must repair the wood/fascia board to the original state.




  1. Residents who live on the lower floors who wish to install a qualified satellite receiver on the fascia board near their upstairs neighbor’s balcony must install the receiver and cable so that they do not enter the upstairs neighbor’s Exclusive Use Common Area with that resident’s consent.

Lower floor residents who wish to install a qualified satellite receiver on the fascia board near their upstairs resident’s balcony must obtain the upstairs Owner’s consent if installing that receiver and accompanying cable requires access to the upstairs Owner’s Exclusive Use Common Area.


This policy is adopted by the Board of Directors of the Avalon at Eagles Crossing Homeowners’ Association at its ______________________ meeting in Oceanside, California.

HOMEOWNERS’ ASSOCIATION CLUBHOUSE RULES
NO PUBLIC FUNCTIONS


  1. No smoking is allowed.




  1. Only the Owner of a Unit can reserve the Clubhouse.




  1. Owners or responsible tenants must be present to at all times during functions at the Clubhouse. Owners are responsible for the actions of their tenants, family members, guests and invitees, and will be financially responsible for any damage done to the Clubhouse during the time of their reservation caused by themselves or their tenants, family members, guests and invitees. Willful destruction or vandalism of Association property will not be tolerated, and any damages will be billed to the Owners in addition to possible fines and other disciplinary actions. Parents are encouraged to provide appropriate supervision for their minor children as the Association does not, and cannot, provide such supervision.




  1. Music must be played at a reasonable level so as not to disturb the surrounding residents.




  1. No wet bathing suits, towels, etc. are allowed in the clubhouse at any times.




  1. All guests of the resident must park on Eagles Crossing, not within the complex.




  1. Resident is responsible for general clean-up of the Clubhouse, patio areas and restrooms, if used. (See attached checklist.)




  1. A clean-up checklist will be reviewed with you by the Clubhouse Inspector before your deposit check is returned to you so make sure you use it.




  1. Resident is responsible for ensuring that their guests vacate the premises no later than 10:00 p.m., Sunday through Thursday and 11:00 p.m. Friday and Saturday.




  1. Clubhouse capacity is 49 persons maximum.




  1. Resident is responsible for turning off all lights, closing blinds, locking all doors and setting the security alarm. (See attached sheet.)




  1. Resident is responsible for making arrangements with designated person for an inspection of the Clubhouse prior to and after the event.




  1. DO NOT prop open doors to restrooms. Have your guest(s) use your FOB key.




  1. NO PETS ARE ALLOWED in the Clubhouse.




  1. If clubhouse is not cleaned when key is returned, there is a fee of $75.00.




  1. If garbage disposal is broken or inoperable, an additional fee will be charge of $35.00




  1. Masking tape or blue tape only is allowed for displaying decorations.



  1. Fifteen minutes maximum parking allowed for loading and unloading in front of the clubhouse.

CLUBHOUSE PRIVATE FUNCTIONS

The use of the clubhouse area shall include the clubhouse and clubhouse patios. Guests at the clubhouse private function may not have access to use of the pool, Jacuzzi, exercise room, tennis court, playground or other areas outside the clubhouse. A clubhouse application must be requested and submitted for approval a minimum of 14 days in advance. Security deposits and other conditions can be revised as needed. Tenants must have written approval of the Homeowner. The Association will hold the homeowner responsible for any and all damages which may occur. All party guests must park outside of Avalon. Please keep the noise level within reason. Do not park in front of the clubhouse except for loading and unloading.




CLUBHOUSE SECURITY SYSTEM PROCEDURE


  1. When you unlock the clubhouse door to enter, go to the keypad and input the number_______. This disarms the system.




  1. When you want to leave, make sure all of the clubhouse doors are closed, go to the keypad and make sure the “ready to arm” light is lit and enter________. You have 45 seconds to leave the building.

3. IF YOU ACCIDENTALLY TRIP THE ALARM:


It is your responsibility to go quickly to the telephone and call Dependable Alarm Systems at (760) 741-9055. Tell them that you accidentally tripped the alarm and give them the password: “Board of Director”.
If you fail to contact Dependable Alarm Systems within five minutes of tripping the alarm, they will dispatch Oceanside Security Agency to respond, as well as the Oceanside Police Department (OPD), if necessary. Should this occur and it is a false alarm, you will be responsible to pay the current false alarm fees. ($185 as of Oct 1, 2014.)

CLUBHOUSE CLEANING CHECKLIST
Wipe down all three dinette tabletops and the three six-foot tabletops with mild dish soap and water.
Wipe down the coffee table with mild dish soap and water.
Wipe down the counters with mild dish soap and water.
Wash the coffee maker if you used it with mild dish soap and water.
Clean the microwave inside and out with the mild soap and water.
Remove all food from the refrigerator and wipe down the refrigerator inside and out with mild soap and water.
Clean the kitchen sink with mild dish soap and water, run the garbage disposer.
Vacuum all carpeted areas.

(There is a vacuum cleaner and some vacuum cleaner bags in the closet.)


Sweep and mop the tile floors in the kitchen and in the entryway with mild dish soap and water.
Mop the boardroom floors if it was used. There is a special cleaner for this floor and it can be found in the closet (MR. CLEAN® Multi-Surfaces Liquid.)
Wipe down the glass doors with Windex®.
Clean out the fireplace if you used it.
Wipe down the trash can lid with mild soap and water and take the trash to the dumpster.
It is very important that you ONLY use mild dish soap and a wet cloth on the dinette tables and when mopping the tile floors as any other type of cleaner will remove the finish or leave a residue.
There is a vacuum cleaner, broom and dustpan and MR. CLEAN® Multi-Surfaces Liquid available for you to use and you will find them in the closet. You will need to bring the following other supplies: Paper towels, cloth, mild dish soap, Windex®, and a sponge for washing dishes.


CLEANING INSTRUCTIONS FOR THE LAMINATED WOOD FLOOR
To care for the laminated wood floor, follow these simple cleaning instructions:

  • Vacuum or dust mop to remove loose dirt or grit.

  • Wipe up spills immediately. Do not allow liquids to stain the floor.

  • Clean the floor with a damp mop using MR. CLEAN® Multi-Surfaces Liquid. Follow label instructions.

  • Do not apply polish or waxes.

  • Never clean the floor with abrasive cleaners, scouring powders or steel wool.

  • Use protective pads under furniture legs to prevent scratching.
