Worker Migrant Indefinite Leave to Remain Guidance Notes Overview The Worker Migrant route enables Isle of Man employers to hire non-British employees to fill a particular full time genuine vacancy that cannot be filled by a Settled Worker. Applicants for Indefinite Leave to Remain (ILR) are required to meet further English Language requirements and are also required to satisfy Knowledge of Life in the UK and Islands requirements before their application is submitted. An applicant for ILR will not require anew Certificate of Employment (CoE) to be issued to them as part of their application.
Indefinite Leave to Remain Requirements ILR maybe applied for by a Migrant Worker who is the current holder of a leave to remain visa. All applicants must meet the Isle of Man Immigration Rules in order for their leave to remain application to be approved. Appendix W Part 2.4 of the Isle of Man Immigration Rules lists all of the requirements that a Worker Migrant must comply with. The key requirements are set out below for ease and applicants should satisfy themselves that they can meet all relevant requirements of the Isle of Man Immigration Rules before applying. The applicant must have spent a continuous 5 years lawfully in the Isle of Man in which the most recent period was spent with leave as a Worker Migrant or Tier 2 (general)
migrant The applicant must submit with the ILR application a certification in writing from their employer which states the following information o That the employer will require the applicant for the employment in question for the foreseeable future o The gross annual salary or hourly wage plus hours worked per week that the applicant will be paid for the foreseeable future
The salary being paid is the appropriate rate for their employment - (refer to Appendix W Part 1.1). Applicants must provide proof of this requirement with their application.
