ORDINANCE 2017-223-E

AN ORDINANCE APPROVING, AND AUTHORIZING THE MAYOR AND CORPORATION SECRETARY TO EXECUTE AND DELIVER, FOR AND ON BEHALF OF THE CITY, A CONSERVATION EASEMENT GRANTING A CONSERVATION EASEMENT TO ATLANTIC BEACH PRESERVATION AND CONSERVATION, INC., FOR PROPERTY LOCATED IN COUNCIL DISTRICT 13 NEAR SEMINOLE ROAD, TO PREVENT ANY USE OF THE SUBJECT PROPERTY THAT WILL IMPAIR OR INTERFERE WITH THE ENVIRONMENTAL VALUE OF THE PROPERTY AND TO ALLOW ATLANTIC BEACH PRESERVATION AND CONSERVATION, INC. TO IMPROVE, RELOCATE, CONSTRUCT, MAINTAIN AND REPAIR, IF NECESSARY, AN EXISTING FENCE ON THE SUBJECT PROPERTY; PROVIDING FOR CITY OVERSIGHT BY THE PARKS, RECREATION AND COMMUNITY SERVICES DEPARTMENT; PROVIDING AN EFFECTIVE DATE.


BE IT ORDAINED by the Council of the City of Jacksonville:

Section 1. Approval and Authorization. There is hereby approved, and the Mayor and Corporation Secretary are hereby authorized to execute and deliver, for and on behalf of the City, a Conservation Easement, in substantially the form as is contained in Second Revised Exhibit 1, labeled as “Second Revised Exhibit 1, Second Rev Easement, May 17, 2017 – Finance”, attached hereto and incorporated herein by this reference, granting a conservation easement to Atlantic Beach Preservation and Conservation, Inc., for property located in Council District 13 near Seminole Road, to prevent any use of the property that will impair or interfere with the environmental value of the property and to allow Atlantic Beach Preservation and Conservation, Inc. to improve, relocate, construct, maintain and repair, if necessary an existing fence on the subject property.

Section 2. Oversight Department. The Department of Parks, Recreation and Community Services shall oversee the project described herein.

Section 3. Effective Date. This ordinance shall become effective upon signature by the Mayor or upon becoming effective without the Mayor’s signature.
