Description

Licensing (Scotland) Act 2005


Legal Team

Councillor Campbell has been appointed a member of the Board in place of Councillor Holden who resigned. He has successfully completed the required training.
The Board has adopted a Scheme of Delegation for the purposes of the transitional regulations. This will result in most transfers, provisional grants , occasional licences/permissions, consents to alter and occasional extensions under the 1976 Act being dealt with by the Clerk.
The Board has decided to charge the maximum permitted fees for applications for premises licences and annual fees to try and ensure that the fees are sufficient to meet the costs of administering the liquor licensing system including the costs of employment of a Licensing Standards Officer as required in terms of the fees regulations. The list of fees will shortly be published on Clacksweb.
Officers are undertaking a complete review and update of the licensing pages on Clacksweb to reflect the many changes taking place because of the 2005 Act.
June and Anne have received initial training from Anite on the new licensing software applications for the Gambling and Licensing Acts.
The transitional period commences on 1 February and will run till 1 September 2009.
The first premises applications by existing licensees must be lodged by 7 March 2008. Some applications for both premises and personal licences have already been received.
Officers continue to familiarise themselves with the procedural requirements of the 2005 Act.
The next 18 months promises to be an exceptionally busy period as the changeover to the new system gets into full swing.
