Boazman, Lee Morris and Julia Emmons amending Article II, Section 138-36 of the Municipal Code of Ordinances to insert provisions requiring maximum consideration of pedestrian access and flow of pedestrian traffic in the permitting of closures of pedestrian rights-of-way due to encroachments, construction and excavations; and for other purposes. (Favorable/ 1 Abstention)
Committee Vice-Chairperson Muller sounded the above item, noted that the Recommendation from the

Committee was favorable, provided clarification, and subsequently Made a Motion to Adopt. Ms. Muller also announced that a work session regarding the item was held on Wednesday and therefore asked Councilmember Woolard, who chaired the session, to provide further clarification. Ms. Woolard responded accordingly and subsequently sounded the amendment and so Moved to Amend. Seconded by Councilmember Muller, the Motion to Amend CARRIED by voice vote. Consequently, Ms. Muller restated the Motion to now Adopt as Amended. It was properly Seconded and CARRIED by a roll call vote of 12 yeas; 0 nays.

98-R-2020 ( 1) A Resolution by Transportation Committee authorizing the Mayor to execute a contractual agreement with Malone Displays, Incorporated, for the purpose of designing, fabricating, transporting and installing display cases for a site located on Concourse T at Hartsfield Atlanta International Airport as part of the Airport Art Program, for a cost to the City of Atlanta not exceed $220,000.00, to be charged to and paid from Fund, Account and Center Number: 2H21 576001 N41001; and for other purposes. (Favorable On Condition)
Committee Vice-Chairperson Muller sounded the above item, noted that it came forth from the Committee Favorable with Conditions, and subsequently stated the conditions for approval. Prior to a Motion being Made, Councilmember Morris spoke to the cost of the subject display cases and attempted to provide clarification regarding bid information provided to him by Aviation General Manager Benajamin DeCosta. However, Ms. Muller informed the Council that she had the cost information in her office and needed time to retrieve it in order to provide more accurate clarification. Discussion was consequently deferred.
Later, when discussion regarding 98-R-2020 resumed, Ms. Muller provided the requested clarification and the Law Department was asked to give an opinion regarding the proper negotiation process. City Attorney Susan Langford responded accordingly and stated, for the Record, that under City Code, an authorized person can negotiate the higher proponent down in RFP situations. Consequently, Ms. Muller requested that Ms. Langford put that opinion in writing. The Vice-Chair subsequently Made a Motion to Adopt which CARRIED by a roll call vote of 12 yeas; 0 nays.

98-R-2020 ( 1) At the conclusion of the vote, Councilmember Muller

(Cont’d) reiterated her request for a written opinion from the Law Department addressing the aspect of someone calling and talking to bidders and/or proposers to negotiate with them, especially in situations where the company having been called was not the lowest bidder. Ms. Muller added that the opinion should also reference what the Code says regarding such a situation and that once the opinion is provided, a conversation needs to be had regarding the legalities and ethics of such behaviour. Ms. Langford asked that Ms. Muller clarify her question. She further noted that she was not aware that Ms. Muller had asked for an opinion in the past but, once clarification is provided, she would gladly provide a written opinion. Council President Pro-Tem Jim Maddox intervened and stated that Ms. Muller should put her question to Ms. Langford in writing so that she could respond accordingly. There was no further discussion on the matter.

Committee Vice-Chairperson Muller sounded the above item and on behalf of the Committee, Made a Motion to Adopt which was properly Seconded. However, Councilmember Morris noted his abstention on votes regarding 98-R-2025 and any other legislation that involves architectural and engineering services where, prior to his becoming a Councilperson, his firm provided contractual work to the such entities as the Department of Aviation and the Atlanta Pretrial Detention Center. Ms. Muller restated the Motion to Adopt and it subsequently CARRIED by a roll call vote of 11 yeas; 1 abstention; 0 nays.
