98-R-1750 ( 1) A Resolution by Public Safety and Legal Administration Committee authorizing the settlement of the lawsuit styled Secret Desires Lingerie, et al. v. City of Atlanta, Georgia, et al. in the Fulton County Superior Court, Civil Action File No. E-23123, for the amount of $12,000.00; and for other purposes.
The above item was removed from the Consent Agenda by request of Councilmember Woolard and sounded by Vice-Chair Dorsey who Moved to Adopt. However, in advance of the vote, Councilmember Woolard requested a summary of the above-referenced lawsuit and the Law Department responded accordingly. Subsequently, the Motion to Adopt PASSED by a roll call vote of 13 Yeas; 1 Nay.

ORDINANCE FOR SECOND READING
98-O-1122 ( 1) An Ordinance by Councilmembers Cleta Winslow and Michael Bond as substituted and amended by City Utilities Committee to amend Chapter 154 of the Code of Ordinances of the City of Atlanta, Georgia by adding a new Division to Article VI, for the purpose of establishing a method to determine credits and adjustments to the amount of Storm water Service Charges; to create a Storm water Utility Appeals Board to hear appeals or property owners from determinations on their requests for credits and adjustment s; and for other purposes.
The above legislation was sounded by Chairperson Muller. On behalf of the Committee, Muller recommended that 98-O-1122 be Adopted on Substitute with the appropriate Amendments which she also sounded. A brief discussion ensued but ended with Councilmember Boazman’s Motion to Call the Question. Properly Seconded, the Motion PASSED by voice vote. Ms. Muller’s Motion to Adopt on Substitute as Amended was then CARRIED by a roll call vote of 10 Yeas; 3 Nays.

98-O-1731 ( 2) An Ordinance by Councilmembers Vern McCarty, Michael Bond and Cleta Winslow as substituted and amended by City Utilities Committee amending the 1998 (Water and Sewer Revenue Fund) Budget anticipating and appropriating $2,500,000.00 for the purpose of funding operating expenses to provide stream clean-up as required by the Consent Decree in Upper Chattahoochee Riverkeeper et al. versus the City of Atlanta; authorizing the Mayor to amend the Notice to Proceed with CH2MHILL/TOC, Inc., a Joint Venture under FC-6710-96-A, Annual Architectural and Engineering Services Contract in an amount not to exceed $2,500,000.00; and for other purposes.
The above legislation was removed from the Consent Agenda at the request of Council President Pitts. After Committee Chair Muller sounded the legislation, Mr. Pitts clarified his request that it be removed from Consent and asked for clarification regarding the amount of money CH2MHILL had already received under their annual contract. Ms. Muller was unable to respond, however, the Finance Department agreed to provide Mr. Pitts with such information later in the meeting. Consideration of 98-O-1731 was deferred until later in the meeting. At that time, Councilmember Muller and Chief Financial Officer Judith Blackwell provided Mr. Pitts with the requested information. In due course, Ms. Muller Made a Motion to Adopt 98-O-1731 which was APPROVED by a roll call vote of 13 Yeas; 1 Nay.

The above legislation was sounded by Committee Vice-Chair Winslow who Made a Motion to Adopt and Per the request of Chairperson Alexander, Ms. Winslow read a letter from the Apparel Mart, into the Record. Pursuant to the letter, Ms. Winslow Moved to Amend 98-O-1161 so as to delete the section that pertains to the re-zoning of the Apparel Mart. Properly Seconded, the Motion to Amend PASSED by voice vote. A brief discussion ensued and subsequently, the Vice-Chair’s Motion to Adopt as Amended PASSED by a roll call vote of 13 Yeas; 0 Nays.
