Supreme Court, June term, 1917.

Hooton & Watson purchased stock in the Pensacola State Bank,

owned by Hyer. Notes were paid up until the Bank closed. The

purchasers held that bank officials were aware of its insolvency, but a

special master, February, 1916, dismissed the complaint. See the

summary, p. 546 554, of the history of the bank and its financial

difficulties, 1909 1915, with notes on the activities of W. A. Blount, F. E.

Brawner and others, in attempting to restore its stability. The lower court

decree was affirmed.

Wentworth was charged with driving an automobile without

paying a City tax imposed before a State law became effective. The

lower court verdict in his favor was affirmed.

Writ of error to Okaloosa County Cirouit Court from Florida

Supreme Court, June term, 1918.

The Blackwell brothers were convicted of murdering M. M. Davis

and his wife, Nanoy. A change of venue was denied and they claimed

the presiding judge was prejudiced. The lower oourt judgment was

reversed and a new trial ordered. See also appeal from the retrial

proceedings in Bay County, 79 Florida Reports 709.

Fudge vs. Florida. (E. J. Fudge, plaintiff in error, vs. the State

Supreme Court, January term, 1918.

Fudge was convicted of murdering his two little daughters, but

an older child may have been responsible for the murder suicide. The

lower court judgment was reversed.

Supreme Court, January term, 1918.

Norton was a passenger on an east bound train; after leaving Sneads, he was told River Junction was the next stop. The train

stopped instead at the Apalachicola River bridge, and Norton was

injured as he got off and fell from the trestle. The lower court

judgment was affirmed.

Supreme Court, January term, 1918.

Presley, a black, was convicted of murdering deputy sheriff

Pickering near Flomaton. The lower court verdict was reversed and

a new trial ordered.

Rutherford solicited members for the Pensacola chapter, Order

of Owls. Members were entitled to insurance benefits, but the company

was not authorized by the State. The lower court judgment was affirmed.

Supreme Court, January term, 1918.

Sommers and others, stockholders of the Apalachicola

Northern Railroad and the Saint Joseph Land and Development Co.,

claimed they were defrauded by the issuance of illegal bonds and

company mismanagement. The lower court judgment was reversed;

with concurring opinion of Chief Justice Browne, p. 178 229.

Mrs. Stephens's young daughter, Tessie, was jailed for failure

to pay a fine for loitering. The lower court judgment was affirmed. See

Thiesen vs. Gulf, Florida & Alabama R.R. (Christian Thiesen,

plaintiff in error, vs. Gulf, Florida & Alabama Railway Company et al.,

Writ of error to Escambia County Circuit Court from Florida

Supreme Court, January term, 1918.

The company filled in a channel opposite Thiesen s land on Pensacola Bay; he sued under the Riparian Act, 1856, but the Supreme

Court held that he failed to show that his title extended to the low

water mark. See the dissent by Chief Justice Browne, p. 36 52, citing Morgan vs. Livingston (6 Martin [o.s., La.] 19), which defined certain Spanish and French terms used in Louisiana and West Florida land titles.

On rehearing, p. 52 79, Thiesen claimed common law righi as riparian owner; after a review of West Florida land claims, the lower

court decision was reversed.

Van Pelt vs. Hilliard. (J. C. Van Pelt, as sheriff, appellant, vs. J. G. Hilliard,

appellee.) 75 Florida Reports 792 814.
Appeal from Escambia County Court of Record to Florida Supreme Court, January term, 1918.

Hilliard owned a restaurant in which he served liquor kept there

by his customers. The sheriff seized the bottles, but Hilliard's injunction

against him was reversed by the Court.

Bailey vs. Van Pelt. (H. K. Bailey, petitioner, vs. J. C. Van Pelt, as Sheriff

Bailey failed to have his cattle dipped and was convicted of

failing to comply with regulations of the State Live Stock Sanitary

Elliott and Russell vs. Florida. (Robert Elliott and Eulie Russell,

plaintiffs in error, vs. the State of Florida, defendant in error.)

Writ of error to Washington County Circuit Court from Florida Supreme Court, January term, 1919.

The plaintiffs were convicted of obtaining money under false pretenses from the Chipley State Bank. The lower court judgment

against Elliott was affirmed; that against Russell was reversed.

Ellis vs. Thiesen. (Cary Ellis as Marshal of the City of Pensacola,

plaintiff in error, vs. Chris Thiesen, defendant in error.) 78 Florida

Writ of error to Escambia County Court of Record from Florida Supreme Court, June term, 1919.

Thiesen was arrested for violating a City ordinance relating to

the construction of privies and sewers. The Court affirmed the lower

court judgment and voided the ordinance. See also Cary vs. Ellis, 78 Florida Reports 186.

Gunn vs. Florida. (Charlie Gunn, plaintiff in error, vs. the State

Writ of error to Santa Rosa County Circuit Court from Florida Supreme Court, June term, 1919.

Gunn was convicted of stealing parts from the boat, "President";

he had found them and kept them openly on an island near Bagdad.

The lower court decision was reversed.

Writ of error to Walton County Circuit Court from Florida

Supreme Court, June term, 1919.

Hall was convicted of first degree murder in the death of Arnold Mitchell. The jury found the act to be premeditated, not the result of

a drunken brawl; the lower court verdict was affirmed.

Appeal from Escambia County Circuit Court to Florida Supreme

Court, January term, 1919.


Alex McKinnon deposited money with the Bank as a gift to each

of his children. Without the children's knowledge, he loaned the money

to the president of the bank and the debt was never repaid. The lower

court's decision in the bank's favor was reversed in this and in three

other parallel cases.

Supreme Court, January term, 1919.

Marasso and others owned various alcoholic beverages and

were convicted of violating the State prohibition act of 1918. His

conviction was upheld by the Supreme Court; with dissenting opinion

of Chief Justice Browne, p. 447 466. See also In re seizure of 7 barrels

of wine (79 Florida Reports 1 24) where the lower court verdict was

reversed.

Supreme Court, January term, 1920.

The Trust Company hoped to dismantle the Birmingham,

Columbus & St. Andrews Railroad in order to pay its debts; Dent and

others objected since the sale was not approved by the State Legislature.

The lower court judgment was affirmed.

Anderson vs. Tedford. (C. T. Anderson, petitioner, vs. 0. W. Tedford,

Marshal of Panama City, respondent. 80 Florida Reports 376 380.


Original jurisdiction, Florida Supreme Court, June term, 1920. Anderson was arrested for holding a public meeting in Panama City

without a permit. The Court voided the City ordinance and ordered his release.

Moneyway's car stalled on the tracks in Milton, and it was struck

by a log train of the company. The lower court judgment was reversed.

The circuit court ordered the Commissioners to hold a special election on reinstating an aldermanic form of government, rather than
