A.Designated Service Areas32.Based on the record before us, we conditionally designate Blue Wireless as a limited ETC eligible only for Lifeline support in its licensed service area in the state of New York, including its licensed service area of the Tribal lands of the Allegany Indian Reservation and Cattaraugus Indian Reservation, as listed in Appendix A. 33.Based on the record before us, we also conditionally designate SI Wireless as a limited ETC, eligible only for Lifeline support in its licensed service area in the state of Tennessee, as listed in Appendix B. A.Regulatory Oversight34.Under section 254(e) of the Act, the petitioners are required to use the specific universal service support they receive “only for the provision, maintenance, and upgrading of facilities and services for which the support is intended.”72 An ETC receiving Lifeline support uses that support as intended when it reduces the price of its telecommunications services by the amount of the support for the eligible consumer.73 In providing Lifeline services pursuant to the conditional ETC designations granted herein, the petitioners must comply with the measures described in petitions and the Commission’s rules and orders. We find that reliance on petitioners’ commitments to meet these requirements is reasonable and consistent with the public interest and the Act. We conclude that these additional reporting requirements will further the Commission’s goal of ensuring that petitioners satisfy their obligations under section 214(e) of the Act to provide the services supported by the Lifeline program throughout their designated service areas. 35.Finally, we note that the Commission may institute an inquiry on its own motion to examine each of the petitioners’ records and documentation to ensure that the universal service support they receive is being used for the purpose for which it was intended.74 Each of the petitioners is required to provide such records and documentation to the Commission or USAC upon request. We further emphasize that, if either petitioner fails to fulfill the requirements of the Act, the Commission’s rules, or the terms of this order after it begins receiving universal service support, the Commission may exercise its authority to revoke such petitioner’s ETC designation.75 The Commission also may assess forfeitures for violations of Commission rules and orders.76 36.ordering clauses37.ACCORDINGLY, IT IS ORDERED that, pursuant to the authority contained in section 214(e)(6) of the Communications Act of 1934, 47 U.S.C. § 214(e)(6), and pursuant to authority delegated in sections 0.91, 0.291, and 54.722(a) of the Commission’s rules, 47 C.F.R. §§ 0.91, 0.291, 54.722(a), Buffalo-Lake Erie Wireless Systems Co., L.L.C. d/b/a Blue Wireless IS DESIGNATED AN ELIGIBLE TELECOMMUNICATIONS CARRIER eligible only for Lifeline support for those portions of its licensed service areas in New York to the extent described in this Order. 38.IT IS FURTHER ORDERED that, pursuant to the authority contained in section 214(e)(6) of the Communications Act of 1934, 47 U.S.C. § 214(e)(6), and pursuant to authority delegated in sections 0.91, 0.291, and 54.722(a) of the Commission’s rules, 47 C.F.R. §§ 0.91, 0.291, 54.722(a), SI Wireless, LLC IS DESIGNATED AN ELIGIBLE TELECOMMUNICATIONS CARRIER eligible only for Lifeline support for those portions of its licensed service areas in Tennessee to the extent described in this Order. 39.IT IS FURTHER ORDERED that pursuant to section 1.102 of the Commission’s rules, 47 C.F.R. § 1.102, this Order SHALL BE EFFECTIVE upon release.
