Regulatory decisions cannot be readily separated from policy choices that are appropriately made by people under the direct control of elected ministers Minor function The regulatory function is incidental to non-regulatory ministry activities, such as service delivery. Creating a separate entity to perform the function, or assigning it to an existing independent regulator, is not justifiable
