25. Department of Transportation prohibitions and consequences a. The DOT regulations establish-prohibitions in 49 CFR Part 382, Subpart Bi bi The consequences for drivers engaging in substance use-related conduct are provided in 49 CFR Part 382, Sub- part E. Drivers who engage in prohibited conduct must be immediately removed from safety-sensitive functions and cannot resume such duties unless the requirements for referral, evaluation and treatment under 49 CFR 382.605 have been met. Additionally, supervisor/managers having actual knowledge that a violation has occurred are prohibited from permitting the driver to perform or continue to perform safety-sensitive functions.
