b. With certain exceptions
related to illegal drug use, supervisors will not use the employee’s refusal of EAP assistance or the outcome of services rendered as the basis for taking disciplinary action.

c. Supervisors must base their disciplinary decisions and actions on the employee’s job performance and/or conduct issues.
d. Supervisors should inform all DA Civilian employees who display performance and/or
conduct issues that the EAP may help them address personal problems that may have the potential to affect performance and conduct.
e. Supervisors will promote EAP services as a benefit of employment. These services are not limited to worksite- related problems. (See DA Pam 600
