Dear Mr. President:
On behalf of the Family Business Estate Tax Coalition (FBETC), thank you once again for your strong and continuing support of death tax repeal. As you put together your fiscal 2007 budget plan, we strongly urge you to once more include a provision to permanently eliminate this onerous tax.
Permanent repeal of the burdensome death tax will dramatically reduce the time, money and energy spent by family business owners on estate planning and will preserve and expand employment opportunities. As you are aware, it is well documented that imposition of the death tax, at rates that can reach as high as 46 percent, forces business owners to sell or break up active businesses that are essential to the health of local economies.
We are very concerned about the temporary nature of the death tax repeal provisions in current law. Because of the so-called “sunset provision” in the law, the death tax will be fully repealed only for one year, in 2010. Unless the law is changed, a tax at death will be reinstated in 2011, once again forcing many families to sell or break up the business when an owner dies.
Moreover, the temporary provisions further complicate an already overly-complex tax code. The uncertainty surrounding repeal requires business owners to continue with estate-planning strategies that are costly, cumbersome and time consuming. If business owners are permitted to operate with the assurance that the death tax will be permanently repealed, resources currently allocated to mitigating the death tax can be reinvested into expanding the businesses, thus shoring up job opportunities and providing a much-needed stimulus to local economies.
Repeal of the death tax is critically important to the future of America’s family businesses, farms and ranches and the people they employ. The FBETC applauds your continued support for permanent repeal and we look forward to working with you to ensure that this much-needed tax relief is permanently locked into place.
