NOTICE OF REVISED PROCEDURAL SCHEDULE
On November 17, 1997, Delmarva Power & Light Company filed a Motion to Dismiss and Motion for Summary Judgment, as well as a Request for Stay of Procedural Schedule, in Case No. 8768. In the Request for Stay, Delmarva notes the revised procedural schedule provides that Delmarva (and any other parties) shall pre-file direct testimony by November 21, 1997.
In a conference call conducted on November 18, 1997, in which the Complainants (Mid-Atlantic Petroleum Distributors Association and Delmarva Oil Heat Association), Delmarva, the Office of People's Counsel, and the undersigned Hearing Examiner participated, the parties agreed to the following revisions in the procedural schedule in this matter:
Complainants shall file a response to the Motion to Dismiss and Motion for Summary Judgment on or before January 30, 1998, which response may also contain any comment with respect to the Commission's decision in Case No. 8747, expected to be issued in the near future with regard to affiliated transactions and affiliated standards of conduct for gas and electric companies in Maryland.
Delmarva, and any other parties, shall have 30 days to respond to Complainants' filing.
The November 21, 1997 date for pre-filing testimony by Delmarva (and any other parties) is hereby stayed pending further notice.
