OFFICIAL RULES: Westways® Photo Contest 2015
No purchase is necessary to enter or win. A purchase will not increase your chance of winning.
1. ELIGIBILITY
Entrants must be members of the Automobile Club of Southern California (“Auto Club” or “Sponsor”), legal residents of California, and 18 years of age or older as of May 31, 2015, to enter the Westways Photo Contest 2015 (“the Contest”). Employees of the Auto Club and its affiliated clubs, affiliates, subsidiaries, and related companies, participating promotional vendors (and their affiliates, subsidiaries, and related companies), and service providers and their respective immediate families (as well as household members of each, whether related or not), are ineligible. The contest is open to both amateur and professional photographers. Void outside California and wherever prohibited by law.

2. CONTEST DEADLINE
The Contest commences at 12:01 a.m. PST, February 13, 2015, and is limited to the first 13,000 submissions received no later than midnight PDT, May 31, 2015. Winning entries will be published in the October 2015 issue of Westways® magazine.

3. ENTRY
Submit one digital photograph of California’s natural beauty, colorful wildlife, and/or iconic qualities. Photos that require the use of a model release for identifiable people or any other type of release for any copyrighted subject owned by others (as determined by the Sponsor in its sole discretion) will be disqualified. Limit one entry per household. Follow the submission guidelines below.
By entering this Contest, you agree to abide by its rules and to accept the judges’ decision as final. By entering this Contest, you also warrant and represent to Sponsor that your entry: (a) is your original work, (b) has not been previously published, (c) has not won previous awards, (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity, including as a result of publication of your entry via various media including print and web posting, and you will indemnify and hold harmless the Sponsor from any claims to the contrary. You further agree, and represent and warrant to Sponsor, that your entry meets these standards of photo manipulation: Only minor burning, dodging and/or color correction is acceptable, as is cropping. High dynamic range images and stitched panoramas are NOT acceptable. Any changes to the original photograph not itemized here beyond what is necessary to conform to the required file guidelines for entry will render the photograph ineligible for a prize.
Submission of an entry and/or acceptance of a prize grants Auto Club and third parties authorized by Sponsor the exclusive, perpetual right to publish, use, edit, adapt, modify, excerpt and/or copy the entry for any and all purposes in any and all media currently in existence or hereafter developed without compensation to you, which includes, but is not limited to, the right to publish the entry in Westways magazine, on AAA.com (including any other related websites and social media platforms), and to use your entry as we see fit in exhibitions and promotions of Westways magazine.
Submissions may not:

• Contain material that violates or infringes another’s rights, including but not limited to privacy, publicity, or intellectual property rights;

• Contain material that is violent, inappropriate, depicts nudity, or is indecent, obscene, hateful, tortious, defamatory, slanderous, or libelous;

• Contain material that promotes bigotry, racism, hatred, or harm against any group or individual, or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;

• Contain material that promotes any illegal activities or any other activity that may appear unsafe or dangerous;

• Contain material that promotes any particular political agenda or message;

• Contain material that is unlawful, in violation of or contrary to the laws or regulations in California or in any state where it was created;

• Contain any materials relating to lotteries, gambling, tobacco, alcohol, drugs, firearms/weapons, or any activities that may appear unsafe or dangerous;

• Contain material that defames, libels, misrepresents, or is negative about Sponsor or its products, or other people, products, or companies;

• Contain trademarks, logos, or trade dress owned by others or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses, or street addresses;

• Contain copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies, or other media or musical "samples") without permission;

• Contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, or otherwise constitute an invasion of privacy or publicity rights;

• Communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;

• Constitute in itself, a violation of law.


Submissions are the views/opinions of the individual entrant and do not reflect the views of the Sponsor in any manner.
When creating a submission, entrants should not, and may not (a) put themselves, or any other persons, in danger of actual bodily injury or death, or (b) violate law. Any submission that, in Sponsor’s sole discretion, violates either prohibition in the foregoing sentence shall be disqualified.

4. PRIZES
First Prize: Round-trip coach air for two to Kailua-Kona on Hawaiian Airlines; Three (3) nights in a luxurious one-bedroom suite at Hilton Waikoloa Village on Hawai‘i Island; Four-day convertible car rental from Discount Hawaii Car Rental; Two (2) one-way ExecuCar airport transfer vouchers; One (1) red Samsonite Southbridge 25” Spinner suitcase. Estimated retail value: $5,439.95.
Second Prize: One (1) $1,000 Disneyland Resorts gift card; One (1) Pentax K-50 camera; Four (4) LEGOLAND® California Resort Hopper tickets; Two (2)

Fourth Prize: One (1) weekend night stay at The Westin Long Beach with breakfast for two; Two (2) one-way ExecuCar airport transfer vouchers; One (1) red Samsonite Southbridge 25” Spinner suitcase; Four (4) Royal Passports to the Queen Mary in Long Beach; Four (4) tickets to the Aquarium of the Pacific in Long Beach. Fifth Prize: Two (2) nights at the Aloft Ontario–Rancho Cucamonga; Two (2) tickets to the 2016 Auto Club 400 race at Auto Club Speedway in Fontana; Two (2) one-way ExecuCar airport transfer vouchers. Estimated retail value: $946.
Honorable Mention (up to 10): One-year Classic Automobile Club of Southern California membership; Gift card from Hard Rock Café San Diego. Estimated retail value: $73. If winner is already a member of the Automobile Club of Southern California, winner may apply value of the membership prize toward renewal of next year’s dues.
Taxes, if any, are the responsibility of the winner. Winners, as applicable, will be issued IRS Form 1099. Airfare and other transportation, baggage fees, gratuities, and all other expenses not expressly specified herein are the responsibilities of winners. No prize substitutions will be allowed except by Auto Club, if, in its sole and absolute discretion, it determines that a prize component is not reasonably available, in which case a prize of equal or greater value will be awarded. Prizes, including hotel nights, are non-transferable, non-refundable, not redeemable for cash, and may not be sold. Certain other restrictions may apply. Auto Club acts only as an agent for the various providers listed.
Prize terms and conditions:
FIRST

Hilton Waikoloa Village: Prize includes daily resort charge and is subject to space availability and blackout dates. Prize must be used by August 31, 2016.

Hawaiian Airlines: Air travel is awarded in the form of one-hundred-sixty-thousand (160,000) HawaiianMiles, which is equivalent to two (2) round-trip Coach Class tickets between any North America Hawaiian Airlines gateway city and Kailua-Kona, Hawaii (KOA). Hawaiian Airlines’ California gateway city airport codes are LAX (Los Angeles), SFO (San Francisco), SMF (Sacramento), OAK (Oakland), SJC (San Jose), and SAN (San Diego). Winner must deposit HawaiianMiles into their free HawaiianMiles account before the expiration date on the certificate. Redemption and use of complimentary award miles for travel are wholly subject to terms and conditions of the HawaiianMiles program. Travel awards are based on space availability. The certificate cannot be transferred, exchanged, or replaced and has no cash value whatsoever. Other restrictions apply; see Terms and Conditions of the HawaiianMiles program. Fees, taxes, and other charges are not included.

Discount Hawaii Car Rental (discounthawaiicarrental.com): Prize includes base four-day rental plus taxes and fees. Car will be booked for pick-up and drop-off at Kona Airport (KOA). Winner is responsible for optional add-ons such as insurance, GPS, gas packages, and car seats. Prize is subject to availability, which may be limited at prime times such as late December and around holidays. Prize must be used by August 31, 2016.

Disney: This prize is supplied by the Automobile Club of Southern California. Disney Gift Cards are redeemable at DisneyStore.com, Disney Store locations in the U.S., participating locations at Walt Disney World® Resort in Florida, Disneyland® Resort in California, Disney Cruise Line, ClubPenguin.com, and DisneyPhotoPass.com. LEGOLAND® California Resort: Tickets expire December 31, 2016, and include admission LEGOLAND® California, SEA LIFE® Aquarium, and LEGOLAND Water Park. The tickets do not include entry into “Brick or Treat Party Nights.”

Universal Studios HollywoodSM: Each Front-of-Line pass is valid for one admission and one-time front-of-line access at select shows and attractions. Front-of-Line privileges are for a daytime visit only and exclude Halloween Horror Nights and special events. Blackout dates apply. You must schedule arrival no less than two (2) weeks prior to your intended visit to arrange admission to the park.

THIRD

Blue Man Group Las Vegas: Must book tickets at least three days prior to the performance you would like to attend. Blackout dates apply. Call for current dates. Not valid on sold-out performances, holidays, and is subject to availability. All reservations are final. No substitutions, cash equivalents, or transfers are permitted. Not for resale. Category restrictions apply. Blue Man Group is not responsible for replacing lost or stolen tickets and/or vouchers. Tickets must be picked up no later than one hour prior to show time at the Blue Man Group box office.

Cirque du Soleil: This ticket certificate/voucher is valid through September 2016. Please note show availability, show days, and show times are subject to change without notice. Additional blackout dates may apply, including special events, holidays, and holiday pricing periods. No substitutions, cash equivalents, or transfers for any part are permitted, and the prize cannot be combined with any other offer. Cirque du Soleil, Treasure Island, and/or MGM Resorts International are not responsible for replacing lost or stolen tickets and/or vouchers. Once reservation has been confirmed simply bring your confirmation number, photo identification, and voucher to the Box Office at least one hour prior to show time or any day prior and exchange for tickets. Performance schedule for the calendar year 2015 (subject to change for 2016):

• Mystère performs at Treasure Island Saturday–Wednesday 7 p.m. or 9:30 p.m.; dark Thursday and Friday.

• Kà performs at MGM Grand Saturday–Wednesday 7 p.m. or 9:30 p.m.; dark Thursday and Friday.

• The Beatles LOVE performs at The Mirage Thursday–Monday 7 p.m. or 9:30 p.m.; dark Tuesday and Wednesday.

• Zarkana performs at ARIA Tuesday–Saturday 7 p.m. or 9:30 p.m.; dark Sunday and Monday.

• Zumanity performs at NYNY Tuesday–Saturday 7 p.m. and 9:30 p.m.; dark Sunday and Monday. Zumanity The Sensual Side of Cirque du Soleil was created for a mature 18 years of age or older audience. Management reserves all rights.

• Criss Angel Believe performs at Luxor Wednesday–Sunday 7 p.m. or 9:30 p.m. with single occasional performances on given days; dark Monday and Tuesday.



Best Western: The Best Western Travel Card® is referred to herein as the “Travel Card” or collectively as “Travel Cards.” The Travel Card is a stored value card and is fully transferable. Travel Cards can contain either currencies or units. Travel Cards are issued in the form of a physical plastic card, electronic card, or, in some circumstances and in some locations, digital printable format. Travel Cards issued for payment of the face value of the Travel Card carry no expiration date. In limited circumstances, Travel Cards provided as promotional awards or otherwise for promotional purposes may contain an expiration date. Travel Cards will not be replaced if lost, stolen, or destroyed. Travel Cards are not exchangeable for cash in part or other substitutions, and no change will be given. FIFTH

Aloft Ontario-Rancho Cucamonga: The certificate is nontransferable. Reservations are based on space availability and blackout dates may apply. Certificate expires December 31, 2016. Incidental expenses are not included unless otherwise noted on certificate. Winner must contact the hotel directly (909-484-2018) in advance to arrange the visit.

Auto Club Speedway: Prize includes four (4) Upper Reserved Seat tickets to the 2016 Auto Club 400 NASCAR Series race. Date to be determined.

HONORABLE MENTION

Hard Rock Cafe San Diego: Promotional comp cards are good for food and non-alcoholic beverages. Excludes merchandise, gratuity, and special events. Promotional card is valid at participating Hard Rock Cafe restaurants. Card is not redeemable online at Hardrock.com or at Hard Rock Hotels, Casinos, or Live Music Venues. Card cannot be replaced if lost or stolen. Card cannot be redeemed for cash, except where required by law.
5. SUBMISSIONS
The competition is open to unpublished work created from May 31, 2014–May 31, 2015. Entries may be submitted pursuant to the following guidelines:
File specifications: Submissions should be in JPG or JPEG format. Files should be at least 5 inches by 7 inches, but no larger than 10 MB.
Filename should not have spaces, slashes, or odd characters and must have the .jpg or .jpeg extension.
Submitting the entry: Enter by filling out all fields and uploading your photo on this website. Entry is only possible through this website. Entry is not possible by post, courier service, e-mail, or any other method of delivery. All entries become the physical property of Auto Club and will not be returned.

6. JUDGING/WINNERS
Members of the Westways editorial and design staffs will judge the entries based on creativity, technical expertise, and aesthetic value. The decision of the judges is final. Judging will occur at 3333 Fairview Road, Costa Mesa, CA 92626-1698, on or about the week of June 1, 2015.
Winners will be notified via e-mail on or after June 19, 2015. Winners will be required to sign and return an Affidavit of Eligibility, Publicity, Liability, Grant of rights to Auto Club. All forms, without any alteration, must be received by us within thirty (30) days of the date of delivery of notification to a potential winner, or alternate winners will be selected; provided, that under no circumstances shall Sponsor be required to make more than three (3) attempts to award a prize.
By entering this Contest and/or accepting a prize, you agree to allow Auto Club to use your name, voice, and image in connection with publication of your winning entry, and for promotional purposes (as described in Section 3 above) without review, notification, or approval.

7. MISCELLANEOUS
This Contest is subject to all federal, California, and local laws, and is void where prohibited. Winners agree that Auto Club and prize contributors, including their parents, subsidiaries, affiliates (and related companies), officers, directors, and employees, shall not be liable for injury, loss or damage of any kind resulting directly or indirectly from the Entrant participating in this Contest or from the acceptance or use of any prize awarded (including any Entrant’s guests), or from use of their names, photographs, and/or likenesses for advertising and publicity purposes without any compensation and upon request, will provide written consent to such use (“Release”). Any guest accompanying the winners will be required to sign and return a release of liability/publicity within a specified time. Failure to return documents in a timely manner or the return of prize notification as undeliverable will cause Prize(s) to be forfeited. Auto Club reserves the right to verify eligibility qualifications of any winner(s). Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the web site, AAA.com/westwaysphotocontest, or who is otherwise in violation of the Official Rules. Sponsor further reserves the right to cancel, terminate, or modify the Contest if it is not capable of completion as planned, or for any other reason, including, but not limited to, for example, infection by a computer virus, bugs, tampering, unauthorized intervention, or technical failures of any sort. In the event of early termination of the Contest, winners will be selected from all eligible entries received at the time of termination in accordance with the judging procedures described above. In no event will Sponsor be responsible for any damages or losses arising out of access to and use of the website, or the downloading from and/or printing material downloaded from said site.
Sponsor is not responsible for lost, late, incomplete, illegible, or misdirected entries, nor is it responsible for incorrect or inaccurate information utilized in the Contest. Receipt of entries cannot be confirmed. In the event of a dispute concerning the identity of a person submitting an online entry, the entry will be deemed submitted by the person in whose name the e-mail account is registered.
All decisions and/or actions by Sponsor shall be exercised in its sole and absolute discretion.

8. Governing Law: Consent to Jurisdiction
The Contest shall be governed by the laws of the State of California without regard for choice of laws or conflicts of laws principles. Any and all disputes or claims arising out of or connected in any way with the Contest will be resolved individually and exclusively by final and binding arbitration administered by the American Arbitration Association (the “AAA”) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the AAA. The arbitration shall be held in Orange County, California. The arbitrator’s decision shall be controlled by the terms and conditions of these Official Rules. There shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only Entrant’s and/or the Sponsor’s or a prize provider’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; provided, however, that if this sentence is declared invalid or unenforceable, either in whole or in part, the remaining sentences of Section 8 shall remain in full force and effect. The arbitrator shall not have the power to award special, consequential, incidental, exemplary, punitive, or other similar damages against the Sponsor or any prize provider. If any part of this arbitration provision is deemed to be invalid or otherwise unenforceable or illegal, the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein, except that any such invalid or illegal provision shall be enforced to the greatest extent permitted by law. Notwithstanding anything contained herein to the contrary, the Sponsor or any prize provider may seek to obtain injunctive relief against an Entrant for the breach or threatened breach of these Official Rules, without posting bond, in addition to any other remedies in law or equity, which may be available to the Sponsor or prize provider, in any of the federal or state courts located in Orange County, California. Each Entrant consents to jurisdiction and venue in the federal or state courts located in Orange County, California, for the purposes set forth above and/or to confirm any award obtained by the Sponsor or a prize provider in arbitration.

9. WINNERS LIST
A winners list will be available upon request once the October 2015 issue of Westways is released. Send a self-addressed, stamped envelope to Westways, Photo Contest 2015, 3333 Fairview Road A327, Costa Mesa, CA, 92626-1698. Requests must be received by November 30, 2015.
