Description of Transaction:

Atlantic Broadband is submitting an application for authority to provide facilities based local exchange telecommunications services. The Company will provide dedicated voice and data services to large and small businesses. The Company will publish a product guide on its website once it begins offering its services to customers.

Through ML No. 209722, the Company amended its application to withdraw its request to provide interexchange services, pursuant to the deregulation of interexchange services in Maryland.

Applicable Law:

The Commission requires all telephone companies that seek to provide service in the state to file an application using the model application form available on its website. The model application lists the requirements for the various types of operating authority and is included as part of the application.  The Commission has broad authority over telephone companies under sections 2-112 and 2-113 of the Public Utilities Article (“PUA”) of the Maryland Code.  In addition, the Commission has express authority to require resellers to obtain authorization to provide service under PUA section 8-403.

Staff Recommendation:

Staff recommends the Commission grant the requested authority, grant the Company the requested COMAR waivers in Waiver Group “C”, accept the Company’s proposed tariff, and direct the Company to file “clean copies” of its tariff with an effective date reflective of the date of the Commission’s Administrative Meeting.
