Now, what is up with that damn chair?

This seems to raise two different questions regarding the chair. First, from the IDI perspective, is it plausible that an intruder would pull the chair back behind them and block the door upon their egress through the storage room window, if that is how they exited? It doesn’t seem likely but this is skating on the fine line of state of mind, so we disregard it for now. The other question raised is more troubling. Let us suppose that Officer French and Fleet White did not report a chair in the basement because it wasn’t there. In fact, their statements would seem to suggest it. Then if JR saw a chair that he had to move to get into the train room it ineluctably follows that his entry into the basement occurred before 6 a.m., 26 December, 1996. This places his foray below at or before the 911 call. While it is true that JR could have simply lied about the chair, that alone would indicate deception. And keep in mind that the detailed accounts given by FW and Officer French are two corroborating statements of omission regarding the existence of something hard to overlook if it blocks a route you stated you took. This undermines a state of mind defense for the Ramseys. Both men exhibited a similar state of mind regarding noting the chair and reporting it. We shall see later that this is the tip of the iceberg and that mysterious little chair will come up again. We also suspect it is related to JR’s statements under oath suggesting a wide window of time in which he could have been in the basement. That provides perjury cover.



The supra causality assertion is corroborated by yet another. The temperature in Boulder, CO at 7 a.m. on 26 December, 1996 was about 7 degrees F and very dry. National Weather Service Data shows Denver at 6 degrees F at its lowest on 26 December. The previous day, 25 December, the low was 24 degrees F. As this author has lived in Boulder, we note it is a fairly consistent pattern to find that Denver temperatures are about 3 to 4 degrees higher than Boulder temperatures. And since lows almost always occur just before sunrise, a conservative estimate of the temperature that day (warmest probable temperature) would have been about 7 degrees F. If a window were open when either Officer French or Fleet White entered the train room the temperature gradient as a function of position would be too steep not to realize that a window was open. Not sensing this gradient is considerably improbable, and noticing this gradient would most likely turn one’s attention to an open window immediately. It is thus highly unlikely that the window in the storage area was open when Officer French or Fleet White entered the train room since they were unable to state whether or not it was. However, according to JR, the window was open and he closed it. This requires that JR employed deception by stating that the window had ever been open or he was in the basement prior to 6:06 a.m. Given the previous findings, the latter option is more likely.
