98-O-2150 ( 5) An Ordinance by Zoning Committee to amend Ordinance Z-98-

Z-98-75 11 which rezoned property from the R-4 (Single-Family

Z-98-11 Residential), and R-5 (Two-Family Residential) Districts to the PD-H (Planned Development - Housing) District, for the purpose of a site plan amendment, and to rezone property from the R-4 (Single Family Development – Housing) District, property located at 2045 Marietta Road, N.W., and for other purposes.

98-O-1725 ( 6) An Ordinance by Councilmember Cathy Woolard as substituted

Z-98-60 by Zoning Committee to amend the 1982 Zoning Ordinance of the City of Atlanta, as Amended, by enacting a new chapter 18G, SPI-7, Candler Park Special Public Interest District; to rezone properties within said district from RG-1, R-4, and R-3 to SPI-7; to repeal conflicting laws; and for other purposes.

Committee Chairperson Alexander sounded the above item, provided clarification, and on behalf of the Committee, Made a Motion to Adopt on Substitute. The Motion was properly Seconded. However, Councilmember Woolard requested to bring forth an Amendment to the Substitute. The request was granted and Ms. Woolard sounded the amendment. She provided clarification and so Moved to Amend. The Motion was properly Seconded and subsequently CARRIED by a roll call vote of 13 yeas; 0 nays. A subsequent Motion to Adopt on Substitute as Amended CARRIED by a roll call vote of 13 yeas; 0 nays, as well.

98-O-1662 ( 8) A Substitute Ordinance by Zoning Committee to rezone property

Z-97-27 from the PD-H (Planned Development-Housing) District to the R-4 (Single-Family Residential) District, property located at 2400 Defoors Ferry Road, N.W., and for other purposes.

Committee Chairperson Alexander sounded the above item, noted that the Council had essentially been ordered by the Court to approve it, and accordingly Made a Motion to Adopt. It was properly Seconded and following a brief discussion, the Motion CARRIED by a roll call vote of 10 yeas; 2 nays.
Later in the meeting, Councilmember Emmons announced that her machine did not work when the votes were cast and she therefore requested that her nay vote be added to the tally. Under the directive of Council President Pitts, Ms. Emmons’ “nay” vote was so Recorded by the Clerk.

98-O-1663 ( 9) A Substitute Ordinance by Zoning Committee as amended to

U-97-32 grant a Special Use Permit for a golf course in an R-4 (Single-Family Residential) district [Section 16-06.005 (1) (k) ] for property located at 2400 Defoors Ferry Road, N.W., and for other purposes.

Committee Chairperson Alexander sounded the above item, noted that the Council is mandated by court order to approve it, then, on behalf of the Committee, Made a Motion to Adopt. The Motion was properly Seconded and a brief discussion ensued wherein Councilmember Moore spoke on the importance of Zoning records being properly maintained especially in such instances where the Law Department has to fight an issue in court. Furthermore, Councilmember Starnes requested a point of clarification to verify if the conditions from the Zoning Committee were included with their package. Mr. Alexander responded accordingly and the Motion to Adopt subsequently CARRIED by a roll call vote of 10 yeas; 3 nays.

Subsequently, the Motion to Adverse CARRIED by a roll call vote of 14 yeas; 0 nays.
