This report summarizes the imported food and agricultural products regulated by Mexico’s Ministry of Health (SALUD). SALUD issues regulations to improve and protect public health. Imports of food and beverages for human consumption are subject to compliance with sanitary regulations dictated by SALUD. The Federal Commission for the Prevention of Sanitary Risks (COFEPRIS) www.cofepris.gob.mx, an agency within SALUD, is responsible for the control and surveillance of food and beverages, food supplements, tobacco, plant nutrients, toxic or dangerous substances, biotechnology products, and pesticides.
On September 27, 2007, in coordination with the Ministry for the Economy (SE), SALUD published the “Agreement that Establishes the Classification of Products whose Import or Export is Subject to Sanitary Regulations from the Ministry of Health”1. This agreement lists the tariff codes of products subject to SALUD regulation and specifies which products require either a Sanitary Import Permit (Spanish: Permiso Sanitario Previo de Importación) or a Sanitary Import Notification (Spanish: Aviso Sanitario de Importación), to be included in the import documentation submitted by the customs broker. A list of the tariff codes for imported products under this regulation is below.
Article 1, Section A, of the aforementioned regulation states that COFEPRIS will issue a Sanitary Import Permit for products classified under the Harmonized Tariff Codes in Table 1, when these products are imported and intended for human consumption or will be used in the further processing/manufacturing of products intended for human consumption.
Article 2, Section A, states that COFEPRIS will require a Sanitary Import Notification for imported products classified under the Harmonized Tariff Codes in Table 2, when intended for human consumption or to be used in further processing/manufacturing of products intended for human consumption.
The importer of products subject to these regulations must be registered with SALUD and is responsible for securing all the necessary documentation and information. The main documents an importer must submit to apply for SALUD permits are a health certificate or a free sale certificate issued by the U.S. government or other competent authority, an original product label, a label in Spanish, a copy of fees paid and, in some cases, a physicochemical, microbiological or physical analysis of the product to be imported.
Please note that the following tables reflect SALUD’s regulations as of the date of this report and are subject to change. Please consult an importer and/or customs broker for the most accurate and updated information.
