1.6Social protection

An important tool to advance social protection for disadvantaged groups is the so-called Open Method of Coordination (OMC). This is a means of voluntary cooperation between the Member States in different areas. The OMCs are based on soft-law mechanisms, such as guidelines, indicators and sharing of best practice, elaborated by the Social Protection Committee, which consists of representatives from Member States.58 The Social Protection Committee publishes annual reports on the social situation in the EU. The reports always include the available information on the situation of persons with disabilities.59


The 2013 Social Investment Package (document 06.15) consists of a number of soft law measures for combating poverty and social exclusion, many of which directly target persons with disabilities. The Package specifically targets the phenomenon of child poverty, and recommends to the Member States a set of targeted measures to support children with disabilities and other vulnerable children using, for example, the EU financial instruments at Member States’ disposal (document 06.16).
In 2013 the European Parliament adopted a non-legislative resolution assessing the impact of the financial crisis on access to care for vulnerable individuals, including persons with disabilities (document 16.17). The resolution invokes the EU’s obligations under the CRPD (particularly, Articles 19 and 26) and relies on the commitments outlined in the European Disability Strategy.
EU law includes a variety of compensatory measures to level out the situation of persons with disabilities by providing them with free or reduced-price services and tax incentives. They include:


  • Directive 2003/96, allowing Member States to apply differentiated rates of taxation for energy products and electricity when they are used for or by people with disabilities (document 06.03);

  • Directive 2006/112/EC, allowing Member States to apply a reduced VAT rate to certain goods and services, used by disabled people, including audio-books and books in Braille (document 06.06);

  • Directive 2008/6/EC, allowing Member States to maintain free postal services for persons with visual impairments (document 06.08);

  • Directives 2009/72/EC and 2009/73/EC, obliging the Member States to protect ‘vulnerable customers’ access to energy (documents 06.10. 06.11);

  • Directives 2014/24/EU and 2014/25/EU, allowing Member States to reserve the right to participate in public procurement to sheltered workshops and operators whose main aim is the integration of disabled people’ (documents 01.41, 01.42);

A number of instruments (documents 06.04, 06.09, 06.13) address the application of national social security schemes to (self) employed persons and their families moving within the Union and cover, among other things, the entitlement of persons moving across EU borders to invalidity and sickness benefits. These Regulations are regularly amended to take account of Member States’ changing legislation on the matter.

06.07

Regulation (EC) No 1370/2007 of the European Parliament and of the Council of 23 October 2007 on public passenger transport services by rail and by road

Enables Member States to maintain or set tariff ceiling for the benefit of (among others) people with disabilities with regard to public service contracts with operators.

Provision only creates a possibility, not an obligation, for maximum tariffs.
