23. Disclosures to the President of the United States or to Members of the United States
Congress acting in response to an inquiry or complaint from the patient
a. Written consent of the patient is required (see para 10

27).
b. Any information not otherwise prohibited from release by other regulations or directives maybe disclosed. This is subject to the limitations stated by the patient in their DA Form R.

c. This authority for disclosure from a patient's record does not extend to situations where the President or a Member of Congress is acting as an intermediary fora third party (such as the patient's parents or spouse. However, most correspondence concerning Army personnel that is addressed to the President is forwarded to the Army for direct reply to the inquirer. Such correspondence addressed to the President maybe treated as inquiries directed initially to the Army.
d. The limitation in paragraph 10–23c, should not be interpreted as a restriction on complete and accurate responses to inquiries on behalf of third parties concerning
(1) The nature and extent of the drug and alcohol problem in a unit, installation, or command.
(2) A description of the SUDCC, program facilities, techniques, or the like.
