Clinton Public Library: ACCESS TO CIRCULATION RECORDS
The circulation records of the library are for the sole purposes of protecting library property and for compiling statistical information about library use. Such records shall not be used either directly or indirectly to otherwise identify the types of materials used by individual patrons or to determine the purposes for which a patron requests library information or materials.
The Access to Public Records Act (“APRA”)(Ind. Code 5-14-1.5), specifically exempts the following types of library information from disclosure:
Library or archival records:
(A) which can be used to identify any library patron; or

(B) deposited with or acquired by a library upon a condition that the records be disclosed only:

(i) to qualified researchers;

(ii) after the passing of a period of years that is specified in the documents under which the deposit or acquisition is made; or

(iii) after the death of persons specified at the time of the acquisition or deposit.
I.C. § 5-14-3-4(b)(16)(A) to (B).
The circulation and records of the Clinton Public Library shall not be made to any individual, group or agency of local, state or federal government except pursuant to such process, order or subpoena as may be authorized under the authority of, and pursuant to, local, state or federal law relating to civil, criminal or administrative discovery procedures or legislative investigative powers. Any costs incurred as a result of such order, in a search through patron records, shall be borne by the individual or agency demanding the search.

Public Access Computing

The Clinton Public Library offers access to the computers and the internet to meet the informational, recreational, and educational needs of our community.  Public access computer workstations are available in the Adult and Young Adult Departments. All workstations provide MS Office applications as well as internet browsing. The use of this technology is a privilege.  Patrons using library computers or laptops must read and agree to the conditions set forth in this policy. Failure to comply with the guidelines in this policy may result in the loss of the right to use the library computers.  



PROCEDURES and POLICIES for COMPUTER and INTERNET USE

Use of the public access computers is generally on a first-come, first-served basis.  Because of high demand, computer use is limited to one hour at a time, two hours per person per day, unless additional time is needed for distance learning or classroom assignments. 

Computers in the Adult Department are for use by those over 18 years of age. 

Computers in the Young Adult Department are for use by those 17 or younger, except during the school day (before 3 p.m.) when adults may use a YA Department computer if no others are available.

Patrons using a public access computer must register at the circulation desk and be prepared to show a valid library card or other identification.  Patrons with outstanding fines or overdue library materials may be prohibited from using library computers. 

Minor internet access:  Minors 17 years and under are restricted to computers in the Young Adult Department; they must have a parental consent form signed and be prepared to show identification before they will have access to the internet.  The parent or guardian must fill out the forms at the circulation desk and these will be kept on file.  For minors 11 years and under who are still in elementary school, the parent or guardian must be present at the computer at all times during internet access. 

The library staff will assist patrons with the computers, but because of the many different programs and applications available, the staff may not be able to provide complete technical support.

Patrons may print from computer workstations for a fee of $.10 per page (b&w); printing is not available from laptops.



LEGAL GUIDELINES and PROTECTION MEASURES

Resources of the Internet are for educational, informational and recreational purposes only and not for unauthorized, illegal or unethical purposes. Actions that violate local, state, or federal law will be prosecuted.

The use of text or graphics that are legally defined by the state and Federal law as obscenity or child pornography is prohibited.

Unauthorized disclosure, use or dissemination of personal information regarding minors is prohibited.

Users must respect the privacy of others by not attempting to modify or gain access to files, passwords or data belonging to others; by not seeking unauthorized access to any computer system or damaging or altering software components of any network or database. 

In compliance with the Children’s Internet Protection Act, the library uses technology protection measures on Internet computers to protect against access to visual depictions that are obscene, or that may be defined as child pornography, or harmful to minors. However, the library cannot completely control the resources found on the Internet. Parents are ultimately responsible for monitoring material accessed by minors.

In the interest of free access, the library staff will allow any adult wishing to access a blocked site to request that the blocking measures be temporarily removed.

DISCLAIMER

Because the Internet is a global electronic network, there is no federal, state or local control of its users or contents.  The sources and information cannot be guaranteed to be accurate, complete or current. Users should use critical judgment in relying on the information found.

Because computers are located in public areas, the library cannot guarantee privacy or confidentiality. Users are also warned that the privacy of e-mail and other communications is not guaranteed.

The Clinton Public Library assumes no responsibility for damages to a user’s computer, external drives or files arising from the use of the Internet through a library connection.

U. S. Copyright Law (Title 17, U.S. Code) prohibits the unauthorized reproduction or distribution of copyrighted materials, except as permitted by the principles of “fair use”.  Patrons may not copy or distribute electronic materials without the explicit permission of the copyright holder.  The library disclaims any liability arising from access to or use of information from the Internet through its facilities.
