AND NOW, it is hereby ORDERED and DECREED that the Stipulation of Settlement entered into by the parties in the above-captioned matter and received by the Bureau of Hearings and Appeals, is ADOPTED. Accordingly, the matter pending before the Bureau of Hearings and Appeals is considered SETTLED AND ENDED. The parties are hereby instructed to carry out the terms of the Stipulation as agreed to by the parties.
This is an administrative adjudication from the Appellant’s appeal of a decision of the Office Medical Assistance Programs (OMAP) (Department) to deny Medical Assistance Long-term Care (MA-LTC) eligibility due to failure to provide a request for payment within the requisite time frame. The telephone hearing was held on May 8, 2015 from the Bureau of Hearings and Appeals in Philadelphia, PA. The parties reached a resolution of this matter and entered into a Stipulation of Settlement that was orally placed on the record. The Stipulation is as follows:
By close of business on May 8, 2015, the Appellant’s Representative agrees to provide certified proof that she submitted the claim request for this case by February 11, 2015.
Upon receipt of the verification, the Department agrees to determine whether the Appellant is entitled to payment.
If the Appellant is entitled to payment, the Department will authorize payment and will issue a new notice by the close of business May 11, 2015. If the Appellant is not entitled to payment, the Department will issue a new notice by the close of business on May 11, 2015.
If the Appellant fails to provide the information by the stipulated date, the original notice dated February 18, 2015 will stand.
All actions will be completed by May 11, 2015.
Based upon this Stipulation of the Parties it is hereby ORDERED that the Stipulation is adopted in its entirety and the parties are directed to implement the terms of the Stipulation upon receipt of this order.
