LECTURE - 4

Definition

  • "An 'Agent' is a person employed to do any act for another or to represent another in dealings with third persons."
  • The person for whom such act is done, or who is so represented, is called the Principal. P appoints X to buy 50 bales of cotton on his behalf. P is the Principal and X is his Agent. The relationship between P and X is called Agency.

Different Classes of Agents

  • The relationship between the principal and agent and the extent of the authority of the latter are maters to be determined by agreement of the parties.
  • Some of the particular kinds of agency-contracts,, together with their legal incidents are described below:

  • 1.Broker
  • A broker is one who brings buyers and sellers into contract with one another.
  • 2. Factor
  • A factor is a mercantile agent with whom goods are kept for sale.
  • 3. A Commission Agent
  • A commission agent is one who secures buyers for a seller of goods and seller for a buyer of goods in return for a commission on the sale.
