Introduction

Welcome to Keith Ace Hardware

Keith Ace Hardware (“the Company”) has prepared this handbook to provide you with an overview of the Company’s policies, benefits, and rules. PLEASE READ IT CAREFULLY. It is intended to familiarize you with important information about the Company, as well as provide guidelines for your employment experience with us in an effort to foster a safe and healthy work environment.


All personnel policies are a condition of employment and will apply in addition to any applicable laws and regulations. Upon completion of your review of this handbook, please sign the acknowledgement statement on the last page and return to the Human Resources Department before starting work.

History of Keith Ace Hardware (added May 7, 2013)


On December 8th, 1983 John Keith bought the 97 year-old Lee Hardware in McGregor, Texas from G.W. Lee. John started out making it a point to meet just about everyone who came into the store. We continue to try that grand tradition in all of our stores now as we strive to be the best and most knowledgeable in the hardware business and provide our customers with TEXAS SIZE SERVICE.

Through the years we have been blessed with good leadership and great employees, not to mention the best customers in the world, that has enabled us to grow into other communities outside of McGregor.

After the McGregor store we opened our store in Hewitt, Texas in 1985 in the Lone Star Plaza. In 1988 business had grown and we had to build a bigger building at 1508 N. Hewitt Dr., which is currently Texas Goodwill Industries. Again business grew and in January of 1997 we had to build an even larger store at it current location at 1424 N. Hewitt Dr. The store is currently in the city limits of Waco, Texas, but we still consider it to be our Hewitt Store.

After the Hewitt store, we opened our store in Clifton, Texas in 1987 at 621 W. 5th St. Again we were blessed with great customers and in August of 1998 we started moving to our current location at 604 N. Ave. G.

In early 1998 we bought the Hubbard Hardware Store, in Hubbard, Texas. We reopened under our name in March of 1998 at 701 E. Hwy. 31.

During the summer of 2001 we bought the 100 year old Rush-Gardner & Bartlett of Marlin, Texas. We reopened under our name in October of 2001 at 122 Live Oak.

During the spring of 2002 we bought Red Oak Ace Hardware in Red Oak, Texas. We reopened under our name in April of 2002 at 154 E. Ovilla Rd.

In March of 2003 we broke ground on our largest free standing building in Brady, Texas. We opened the doors on August 11th at 2210 S. Bridge St.

In July of 2006 we bought Lorena Hardware and Feed in Lorena, Texas. We reopened under out name at 201 S. Frontage Rd.

In July of 2010 we started work on our newest store in Salado, Texas. We opened the doors on September 14th at 213 Mill Creek Rd. Ste. 100.

We continue to strive to serve all of our current customers at the highest level possible and we hope that we can continue to grow and hopefully be blessed to become YOUR local Hardware store where ever you might be.

Mission Statement


It is our goal to provide service to our customers that exceed the service found at any of our competitors. We are committed to listening to our customer's comments and responding to their requests. We will stand behind every piece of merchandise we sell. We will fix it, exchange it, or refund their money, without a hassle.

We will provide our customers a clean store that is well stocked with quality merchandise. We will be the most conscientious, courteous, knowledgeable, and well-trained salespeople in our profession. We will provide all of this at very competitive prices, and we will be the overall best value for our customers in the markets we serve.


Open Door Policy


Keith Ace Hardware seeks to provide a work environment that encourages direct and open communication between employees and management. For this reason, the Company has adopted a formal open door policy. We encourage open communication, feedback, and discussion about any matter of importance to an employee. Start with your supervisor. If needed, continue to follow the chain of command.

Code of Conduct


Employees at Keith Ace Hardware must conduct themselves at all times in an ethical and professional manner. The Company code of conduct requires that employees act with honesty, integrity and good judgment. Each employee should demonstrate respect for the rights of others.

Any incident of unethical or dishonest behavior should be reported to your immediate supervisor. All reports of unethical behavior will be investigated thoroughly. If the allegation is substantiated, management will determine the appropriate disciplinary action. Employees who violate ethical standards may be subject to discipline, up to and including termination.

Sexual Harassment


Keith Ace Hardware is committed to providing a respectful, non-hostile work environment. Sexual harassment is a form of misconduct that undermines the workplace, violates the respect for fellow workers, lowers morale and productivity and causes absenteeism.

Sexual harassment is defined as unwelcome sexual advances, request for sexual favors, and other verbal or physical conduct of a sexual nature when this conduct explicitly or implicitly affects an individual’s employment, unreasonably interferes with an individual’s work performance, or creates an intimidating, hostile, or offensive work environment.

If you or a co-worker have been the subject of sexual harassment, immediately report the conduct to your supervisor or to the Human Resources Department. Keith Ace Hardware will immediately have the incident investigated. The privacy of the employee filing the report and the employee under investigation shall be respected at all times consistent with the obligation to conduct a fair and thorough investigation. A worker determined to exhibit behavior contributing to sexual harassment of anyone in the workplace will be subject to disciplinary action, including termination, with or without notice.

It is the intent of Keith Ace Hardware to provide a work environment free from verbal, physical, and visual forms (i.e. signs, posters, or documents) of sexual harassment and an environment free of harassment, intimidation or coercion in any form. All employees are expected to be sensitive to the individual rights of their co-workers.


General Work and Employment Policies

Immigration Law Compliance


Federal Law requires all employees to present documentation confirming their identity and eligibility to work in the United States. New employees and re-hires must complete the I-9 Employment Eligibility Verification Form within three business days of their start date.

Confidentiality


It is the responsibility of Keith Ace Hardware's employees to safeguard sensitive company information. The nature of our business and the economic well being of our company is dependent upon protecting and maintaining proprietary company information. Continued employment with the company is contingent upon compliance with this policy. Each manager/supervisor bears the responsibility for the orientation and training of his or her employees to ensure enforcement of company confidentiality. Sensitive company information is defined as trade secrets or confidential information relating to products, processes, know-how, customers, marketing data, accounting, pricing, sales volume, inventories, salary information, growth plans and strategies, negotiations and contracts, advertising, suppliers, cost codes, discounts, policies and procedures, etc. All of these such topics are considered confidential company information. Anyone who breeches our confidentiality by giving information to competition or anyone unauthorized will be terminated.

Note: Any time someone asks, “How are things going?” answer fine and leave it at that. Do not elaborate under any circumstances. If someone asks specific details of topics considered confidential, tell them you don't know and refer them to the General Office (G.O.).


Introductory Evaluation Period


All new employees are subject to a 90 day probationary period. Your performance will be carefully evaluated during this period. At the end of the probationary period or any time during, you may be offered a position as a regular full-time or regular part-time employee. If your evaluation is not satisfactory, your employment will be terminated.

Dress Code / Hygiene (updated August 1, 2014)


As representatives of Keith Ace Hardware, employees should remember that their appearance is a direct reflection on the level of professionalism in the Company. For this reason, all employees shall follow these basic minimum guidelines in regard to dress and personal appearance. Management may impose additional appropriate standards.

Non-Office Personnel

• Full time employees will be given 5 red Ace shirts.

• Part time employees will be given 3 red Ace shirts.

As these shirts are worn and need replacing, it will be the employee's responsibility to replace the shirts. If the employee is leaving the company, all shirts are to be returned.



Store Managers

Will dress to project the image of a professional businessman at all times, suit and tie is not required. Nice shoes or boots, nice pants/slacks or shorts, and red Ace shirts with Ace or Keith logos are acceptable. Name tags with name and titles are to be worn at all times. Jeans and t-shirts are not acceptable.



Office Personnel

Will dress to present a professional appearance at all times. Nice clean shoes or boots, nice pants or skirts and a nice dress shirt or blouse are acceptable.



All Personnel (updated August 1, 2014)

• Athletic shoes are acceptable as long as they are clean and conservative in appearance. No wild colors, art deco, etc.

• Nice jeans are acceptable. They should not contain patches, tassels, fringes, etc. Sweat pants and extra baggy pants are not acceptable.

• Only red Ace shirts with the Ace or Keith logos are acceptable.

• No bare mid sections or low cut shirts are acceptable.

• Socks must be worn with all shoes.

• Slick bottomed, high heeled or open toed shoes are not acceptable due to safety reasons.

• During warmer seasons shorts may be worn. They should be hemmed at the bottom and be of acceptable length. Acceptable length is defined as: longer than your fingertips when your arms are held down your side.

• All non-office personnel must wear a name tag at all times. Name tags will be provided, but lost name tags will be the responsibility of the employee to replace.

An employee who is in doubt about the appropriateness of a particular mode of dress should consult their supervisor or manager in advance. Supervisors and managers are charged with the responsibility of enforcing this policy.



Hygiene

In our business, you, like the merchandise, are always on display, constantly scrutinized by the customers. The more we can do to give them a favorable impression, the better feeling they will leave with, the better we will all do and the happier we will all be. With this in mind, it is imperative that each of us, at all times, be conscious of how we appear to our customers.

• Employee's clothing should at all times be clean and well kept.

• Hair and general overall appearance should always be considered prior to reporting for work. This means the basics of bathing, shaving (when called for), brushing teeth, hair combing, etc. Never come in unkempt.

• Be conscious of your appearance at all times. If you get soiled while working, clean up when you are finished. When you return from lunch, be sure to freshen up, wash hands, comb hair, brush teeth or use mouthwash.

• Out of respect for our customers and other employees with allergies; cologne, perfumes, and scented aftershaves are not allowed on the sales-floor.

• If an employee requires a reasonable accommodation regarding their dress for bona fide religious reasons, they should contact their supervisor or the Human Resources Department. Unless an undue hardship would result, such an accommodation will be made.

Remember that the people you will be dealing with will be in extremely close quarters as you show the merchandise or explain merchandise to them. There are few things that are more distracting or dissatisfying to a customer than to have to deal with someone who they perceive as dirty, or who smells bad, or has bad breath. The customer leaves with a bad impression of the individual, the store, and his or her purchase.

Employees who refuse to comply with Keith Ace Hardware’s reasonable standards of dress may be sent home to change into more appropriate attire. Repeated violation of this policy can lead to disciplinary action up to and including termination.

Cooperation


No business can achieve a maximum of success unless there is complete cooperation between employer and employee. This firm pledges to its employees, full cooperation toward furthering the best interest of the firm, which will benefit us all. We expect full cooperation in return. Your prosperity is our prosperity.

Keith General Office is open to any suggestions or constructive criticism that our employees feel will result in improved conditions or further the firm's interest.


Drug Free Workplace


Keith Ace Hardware is committed to enforcing a drug-free workplace environment. Possession of alcohol, illegal drugs, or a controlled substance is prohibited on company property or in any location in which the employee represents the company for business purposes. Employees are expected to report to work on time in appropriate mental and physical condition. The unlawful manufacturing, distribution, dispensation, possession or use of a controlled substance on company premises or while conducting company business is absolutely prohibited. Violation can lead to termination, with or without notice.

Keith Ace Hardware does not sponsor or endorse any specific drug and alcohol treatment or training programs. Such programs are available through public and private health care facilities. Affected employees are encouraged to seek assistance for themselves and their dependents.

Keith Ace Hardware does not require drug testing as a condition for employment, but by accepting employment you are agreeing that you may be required to submit to a drug test at anytime at the request of management.

Attendance


Keith Ace Hardware expects all employees to conduct themselves in a professional manner during their employment. This includes practicing good attendance habits. All employees should regard coming to work on time, working their shift as scheduled and leaving at the scheduled time as essential functions of their jobs, i.e., good attendance habits are an integral part of every employee’s job description.

Among other things, “good attendance habits” include the following:

• Being at your work station ready for work by the start of the shift;

• Appearing for work no earlier than 5 minutes prior to the start of the shift and no later than the start of the shift;

• Remaining at your work station unless the needs of the job require being elsewhere, except during authorized breaks (including restroom breaks);

• Taking only the time normally allowed for breaks;

• Remaining at work during your entire shift, unless excused by a supervisor or manager;

• Not leaving work until the scheduled end of your shift unless excused by a supervisor or manager;

• Leaving promptly at the end of your shift unless you have been given advance permission by your supervisor or manager to work past that point; and

• Calling in and personally notifying your supervisor or another member of management if you are going to be either absent or tardy, unless a verifiable emergency makes it impossible for you to do so.


Giving Notice of Absence or Tardiness


Under some circumstances, an employee’s absence or tardiness may be excused, but only if that employee gives proper notice of such a problem before the start of their shift. Keith Ace Hardware needs advance notice of attendance problems so that other arrangements can be made to cover an employee’s absence if necessary. “Proper notice” means that the employee will call Keith Ace Hardware at a designated telephone number prior to the start of the employee’s shift and personally notify their supervisor or another member of management about the problem, unless a verifiable emergency makes it impossible to do so.

It is not sufficient to call in and leave a message with a co-worker or someone else who is not in a supervisory position. Office staff have been instructed to route all such calls to supervisory personnel. If you fail to give proper notice of attendance problems in advance as explained in this policy, you may be subject to disciplinary action, up to and possibly termination.


Job Abandonment


An absence of two days in a row without calling in or returning to work will be considered job abandonment, and Keith Ace Hardware will process your work separation as a voluntary resignation on your part.

Personnel Files


Employee personnel files are confidential and are the property of Keith Ace Hardware. Access to the information contained within the files is restricted to qualified personnel who have a legitimate need to view the information. However, with reasonable advance notice, employees may review their personnel file. Employees who wish to review their own file should contact their supervisor or the Human Resources Department.

Employment of Relatives


Keith Ace Hardware permits the employment of qualified relatives of employees as long as such employment does not, in the opinion of the Company, create actual conflicts of interest (direct or indirect supervision of a relative). The decision to hire such an individual will be made by the Human Resources Department.

Categories of Employment


Upon hire, you will either be classified as a Full-Time or a Part-Time employee. This determination can only be made by management. This classification can be changed during a review, performance evaluation, or at management's discretion. (Working 40 hours a week for several weeks does not classify you as full time.)

In addition to the preceding, employees are also categorized as “exempt” or “non-exempt”:

Exempt employees are all full-time or part-time professional employees who are paid on a salaried basis and who are not entitled to overtime.

Non-Exempt employees are all full-time, part-time, temporary, supplemental or seasonal employees paid on an hourly basis and entitled to overtime compensation under the Fair Labor Standards Act.


Recording Hours Worked


All non-exempt employees are required to clock in or out indicating all hours worked.

  • Clock in only when you are ready to go to work;

  • Always remember to clock in or out;

  • If you forget to clock in or out, take it to the manager on duty for him or her to adjust;

  • Always clock in or out as close as you can to the schedule posted, unless instructed to do differently by the manager;

  • Do not clock in or out for another employee.

Breaks


All personnel are expected to be timely and prepared to work when clocking in and when returning from breaks. All personnel should be properly dressed and have all personal business taken care of before clocking in (including applying make-up and/or eating). Everyone is expected to go directly to his or her daily duties. Food and drinks are to be consumed only on breaks in designated areas, not on the sales floor.

Lunch Break: an unpaid ½ hour or more, as allowed by management, is provided in the middle of an eight hour work day. All employees are required to take a lunch break and no employee is authorized to perform work during their lunch break. Lunch break schedules must be approved by your supervisor and are generally taken on a staggered schedule so that your absence does not create a problem for co-workers or customers. Employees are expected to follow assigned lunch schedules.


Pay Policies

Pay Periods


Everyone is required to have direct deposit set up. Non-exempt employees are paid on a weekly basis. Exempt employees are paid bi-weekly. Pay periods start on Wednesday and end on Tuesday. Direct deposit will be issued on each Friday. (First week or two of employment may result in a paper check). If Friday is a holiday, you will receive your direct deposit the following business day.

Commission Pay


If you are paid commission, you will be paid by terms of the specific program you are participating in. If an employee resigns or is terminated, all commission pay will be forfeited for the period.

Pay Deductions


Keith Ace Hardware is required by law to make certain deductions from your paycheck each pay period. Such deductions typically include Federal and State taxes and Social Security (FICA) taxes. All deductions and the amount of the deductions are listed on your pay stub. These deductions are totaled each year for you on your Form W-2, Wage and Tax Statement.

Work Scheduling and Overtime


Non-exempt employees are not permitted to work more than 40 hours during a seven-day workweek unless the additional work is ordered and approved in advance by the supervisor. From time to time, overtime may be required due to high workload demands or to cover unforeseen absences, with or without prior notice. When required, overtime is mandatory and is a condition of your employment.

Non-exempt employees who perform overtime work will be paid one-and-one-half times their regular rate of pay for every hour worked over 40 hours in a seven-day workweek. Overtime pay is based only on hours actually worked. Holidays, vacation, and other hours paid but not worked are not considered when calculating overtime.


Performance Evaluations


Every employee is hired on a 90-day probationary/training period. As with all other employment, however, this is not a guarantee of employment for that entire period, or for any particular length of time. Management reserves the right to terminate an employee (whether probationary or other) at any time, for any reason. Employment is dependent upon performance, knowledge, learning procedures, and service to customers. Employees will be given a review at 3 months after hire date. Management may give reviews more often as they determine necessary.

Employees will have a performance evaluation on an annual basis, based on your anniversary date. The performance evaluation is an opportunity for an employee and supervisor to establish mutual understanding of job standards and identify employee development objectives. Raises are not guaranteed, but are at management’s discretion and based upon a variety of factors such as management’s assessment of job performance as well as adverse economic or financial conditions. Managers may only give raises during an evaluation so that good and bad points can be discussed at the time of the evaluation. All raises must be approved by the G.O.

All information shared with employees in their reviews is considered confidential and should not be shared with other employees.

Leave of Absence and Time Off


Keith Ace Hardware is committed to assisting employees, in response to individual family situations, with the opportunity of leaves of absence. All regular full-time employees are eligible for paid or non-paid leaves of absences after completing a minimum of 90 days of continuous employment with Keith Ace Hardware. Where the need for leave is foreseeable, you must submit a Leave Request Form along with supporting documentation at least two weeks in advance for consideration to management.

Personal Leave


Personal leave without pay for emergencies or personal needs will be considered for employees on an individual basis. Employees must use all earned unused vacation time before an unpaid personal leave is authorized. If a personal leave of absence is granted, it is done so solely at the discretion of management. A personal leave of absence may be granted for up to thirty (30) days unless otherwise required by law, such as in the case of military service.

Family Leave


The Federal Family and Medical Leave Act covers employees at work locations that employ 50 or more employees. According to the terms of the Act, Keith Ace Hardware provides up to 12 weeks of unpaid leave in a 12 month period for the following reasons: the birth or adoption of a child; to care for a seriously ill child, spouse or parent; for a serious health condition of the employee; or for any qualifying necessity that arises when a family member is called to active military duty. An eligible employee may take up to 26 weeks of unpaid leave per year to care for a family member recovering from a serious injury or illness incurred while on active military duty. To be eligible, an employee must have worked at least 1,250 hours during the 12-month period immediately preceding the start of the leave. Consult the Human Resources Department for further details regarding a Family and Medical Leave of Absence.

Holidays


Full time employees will be paid for a regular work day if it falls on a holiday on which we will be closed and that day is one of their regularly scheduled work days (8 hour maximum or regular scheduled hours for that day, whichever is less). Holiday pay will not be time and a half.

Keith Ace Hardware offers four paid holidays each year to eligible employees:



  • New Year’s Day

  • Easter

  • Thanksgiving

  • Christmas Day

All holiday closings are subject to change.

Jury Duty


It is the duty and responsibility of each of us as citizens to do our part in the judicial system. Employees who are called for jury duty will be granted time off without pay to perform their civic duty. Those who are eligible may elect to use their vacation time and pay during jury duty. Otherwise, the period of absence will be without pay, as the entity, which calls you to serve, will pay you for the time that you serve.

Notify your supervisor as soon as possible if you receive a jury duty summons. If chosen to sit on a jury, immediately inform your supervisor how long the trial is expected to last. Thereafter, you are required to regularly check in with your supervisor to keep the Company updated as to the expected date of your return to work.


Military Leave


Keith Ace Hardware will grant employees called into military service an unpaid leave of absence and reemployment rights as required by State and Federal law. Employees on military leave may, at their option, use any or all accrued paid vacation leave during their absence but there is no requirement to do so.

Vacation


Keith Ace Hardware offers paid vacation to eligible employees to provide them with opportunities for rest, relaxation, or to attend to personal matters. All regular full-time employees are entitled to vacation with pay in accordance with the following schedule:

Uninterrupted Employment Vacation Accrual

1 – 4 5 days per year (40 hours for hourly, ½ pay period for salaried)


5 or more 10 days per year (80 hours for hourly, 1 pay period for salaried)

Vacation time should be requested using a Leave Request Form at least two weeks in advance. Vacation schedule requests will be considered in light of the expected work load and availability of staff, especially during holiday periods.



  • Vacation time will be according to the anniversary date that the employee started with the company.

  • Vacation time must be used by the end of the employee’s anniversary year and cannot be carried over to the next year.

  • If an employee resigns or is terminated, all vacation benefits are forfeited.

  • Vacation time off is paid at the employee’s regular rate of pay at the time of vacation.

  • Vacation time does not pay at time and a half overtime rates.

  • Part time employees may request vacation without pay. Each request will be handled on a case by case basis.


Insurance and Benefits


As part of our ongoing commitment to our employees and their well-being, we provide employees the opportunity to participate in a variety of competitive and comprehensive benefit plans. Our plans are designed to help protect employees and their families against financial hardships caused by illness, injury, disability, and death.

The benefits listed in this handbook are meant to be a general description only. Complete details are provided in the official plan documents for each of the benefit plans offered. Keith Ace Hardware reserves the right to modify or eliminate benefits, in whole or in part, without notice. Contact the Human Resources Department for details about any of these benefits.


Eligibility


All regular full-time employees are eligible for benefits after completing a minimum of 90 days of continuous employment with Keith Ace Hardware. Full-time employees are defined as those who were classified as full time upon hire. See Categories of Employment for more details.

Health Insurance (updated August 1, 2014)


Keith Ace Hardware provides regular full-time employees with group health insurance coverage. Since 2004, the company supplements a portion of the premium cost for the employee only. Full time employees are eligible after 60 days of full time, uninterrupted employment.

  • The policy will start the first of the month following the 60-day eligibility period if all applications are completed correctly and submitted by the appropriate date.

  • Applications must be submitted complete within the first 45 days of full time employment.

  • If an employee declines coverage at time of eligibility, he or she will not be eligible again until the group policy renewal date.

  • The plan also provides optional coverage for dependents. The premium cost for dependent coverage is the sole responsibility of the employee, to be paid through payroll deduction.

  • Any changes to a policy, including adding or deleting spouses or dependents, requires a 30 day written notice and may take up to 60 days to become active.

  • Keith Ace Hardware does not supplement pay in such case that health benefits are declined.
