ABOUT THIS PRICING PLAN

      1. This section contains the rate plans that we currently offer to new customers for the Post-Paid Mobile Broadband Service.

      2. This pricing table, together with:

        1. your application;

        2. the general terms as applicable to you;

        3. the service description;

        4. the dictionary, and

        5. the appendices,

forms your agreement.

      1. You may obtain a copy of the latest version of the above documents on our website: www.virginbroadband.com.au or from us on request.

      2. If you cannot find the name of your rate plan in this section, you should refer to the rate plans – special offers as it contains rate plans that we do not currently offer to new customers - they are old rate plans which will only be offered to new customers as a special. You can also call us for more information.

      3. The meaning of the words printed in italics like this is set out in the dictionary.


MOBILE BROADBAND

    1. Equipment Charges

      1. You may:

        1. purchase a modem from us to access the service; or

        2. use your own modem approved for use on our 3G/HSPA to access the service.

      2. If you choose to use your own wireless modem to access the service:

        1. your modem must be a compatible modem; and

        2. the operation of your modem, and any repairs to it, is your responsibility.

    2. Service Charges

      1. How do we calculate data usage?

        1. We will charge you for the volume of data uploaded and downloaded using the service.

        2. Charges are based upon 1 kilobyte increments and are rounded to the nearest cent.

        3. Charges for part of a 1 kilobyte increment will be rounded up to the next 1 kilobyte increment.

        4. There are 1000 kilobytes for every 1 megabyte.

      2. Which rate plan applies to you?

        1. If you have already completed your application for the service the name of your rate plan will be indicated on your application. If you do not know the name of your rate plan you may call us to confirm your rate plan details.

        2. The rate plans for the service are set out below.

        3. You may select a minimum term of 12 or 24 months or a BYO plan with no minimum term in your application.

        4. You must pay us the monthly plan charge for the rate plan you choose each month during the term of the agreement. The monthly plan charge includes an amount of data allowance, as indicated in the table below. We will bill you for monthly plan charges in arrears.

        5. Any unused included data allowance is forfeited at the end of each month.

MOBILE BROADBAND PLANS

    1. Eligibility:

      1. The Mobile Broadband plans in Table 1 to 4 below are available to you from certain dates and if you:

        1. are a credit approved, residential customer;

        2. are in a 3G/HSPA enabled areas. In areas where there is no HSPA coverage you will automatically connect to our 3G or GPRS network at reduced speeds. See www.virginmobile.com.au/coverage to check coverage.

    2. Is it a fixed-length agreement?

      1. If we supply you with a USB or a WiFi modem for use with our service, you must connect to a Mobile Broadband plan for a minimum term of 12 or 24 months. The agreement is a fixed-length agreement.

      2. If you Bring Your Own (“BYO”) modem you can purchase a starter pack and have no minimum term. The agreement is a non fixed-length agreement.

    3. What you have to pay us

      1. Tables 1 to 4 below set out the charges that apply and the included value per month for the Mobile Broadband plans.

      2. Each month you must pay the respective monthly plan charge as set out in Table 1 to 4 below

      3. You must pay the monthly plan charge even if you do not use the service.

      4. There are no excess usage charges;

      5. There are no excess roaming charges (Broadband is only available in 3G Broadband (HSDPA) enabled areas as defined at www.virginmobile.com.au/coverage to check coverage. In areas where there is no HSDPA coverage you will automatically connect to our 3G or GPRS network at reduced speeds, if appropriate network coverage is available. There is no coverage outside Australia);

      6. Your data allowance applies to downloads and uploads of data on your service.

      7. The Acceptable Use Policy applies to your use of the service. Please refer to Appendix D.

      8. Data usage that counts towards your stated rate plan monthly data allowance includes data allowance data transfers.

      9. If you exceed your monthly data allowance your access to the service will be speed limited to 128kbps. If you exceed your data allowance by 0.25GB, your service will be unavailable until the end of your monthly usage period. With notice we may cancel the service if we believe it's being used for continuous downloading, or if your use is so heavy it impacts our ability to provide the service to other users. Please refer to the Acceptable Use Policy (Appendix D) for further information.

      10. You may purchase up to 3 data top-ups per month.

      11. Note that in all cases Peer 2 Peer data transfers will be speed limited to 32kbps.

      12. Any unused data allowance is forfeited at the end of each usage period.

    4. What happens if the service is cancelled early?

      1. Subject to your rights under clause 2A of the general terms, you will be required to pay us:

        1. any usage charges incurred up to, and including, the cancellation date;

        2. the sum of unpaid equipment charges owing on your device under the equipment payment plan (if any).

OTHER CHARGES

    1. Roaming charges

International Roaming is not available on the Mobile Broadband service.

    1. Replacement Equipment

      1. If we need to repair or replace any of the equipment that you have purchased from us, outside the warranty period we may, subject to our obligations under the statutory warranties (see clause 13.2 of the general terms), charge you the cost of repair or replacement cost.

      2. The replacement cost of the standard USB modem is $149.00.

      3. The replacement cost of the WiFi modem is $192.00.

    2. Late Or Non-Payment Fees And Charges

(a) If you do not pay all amounts you owe us by the date the payment is due, we may charge you a late fee of $10.00.

(b) Before we charge you a late fee, we will remind you on your bill (and/or otherwise) that you have not paid all amounts you owe us by the date that payment was due.




    1. Change of Account Holder Fee

If we agree to let you change the name on your account by assigning your rights under this agreement we will charge you a $25.00 fee for processing this change.

    1. Replacing your SIM card

We may charge you a $15.00 charge for replacing your SIM card.

    1. Copy of Back Bills

If you ask us for another copy of one of your bills we may charge you $5.50 per copy.

    1. Payment Dishonour Charges

      1. We may charge you a dishonour fee of $10 if your payment by direct debit is dishonoured by your nominated financial institution or credit provider.

      2. We may also charge you a dishonour fee of $10 if you pay us by cheque and the payment is dishonoured by your financial institution.

      3. This fee is in addition to any fees that your financial institution or credit provider may charge you.

    2. Changing your rate plan

      1. You may change to a rate plan with a higher monthly plan charge for no admin charge at any point during your commitment, subject to our normal credit checking procedures.

      2. You may change to a rate plan with a lower monthly plan charge after 3 months of your commitment start date.

      3. You can only change rate plans within the same ‘family’ of rate plans and if you are on a 24 month commitment plan you can only change to another 24 month commitment plan. If you are on a BYO plan you can only change to another BYO plan.

      4. If you are on a rate plan with a 12 or 24 month commitment, you can change rate plans once every three (3) months.

      5. If you are on a BYO rate plan, you can change rate plans once per billing period.

      6. We may charge you a fee if you move from one rate plan to another before the end of your minimum term.  The amount of the fee will depend on various factors, including the terms of your current rate plan and the terms of the new rate plan you are moving to.  You should contact customer service for further information on the fee that may apply in your case.

      7. If you change your rate plan to a new rate plan at any time, or renew your agreement and choose a new rate plan, we will apply the charges set out in your new rate plan immediately and on your next bill you will be charged a pro-rated monthly plan charge for your old rate plan and your new rate plan.

      8. If your existing rate plan is a limited offer and you want to change rate plans then pricing will revert to the standard offer available at the time.

      9. Customers with a standard USB modem can only change onto a plan that has a standard USB modem attached to it (if they want a new modem they need to pay out existing contract and re-contract onto the new plan with the new modem)

      10. Customers with a WiFi modem can only change onto a plan that has a WiFi modem attached to it (if they want a new modem they need to pay out existing contract and re-contract onto the new plan with the new modem)

      11. customers on a 12 month plan can upgrade to a 24 month plan that has the same modem type associated with it

      12. customers on a 24 month plan cannot change to a BYO or 12 month plan

      13. customers on a 12 month plan cannot change to a BYO plan
