ANNEX III.23.2: FINANCIAL REPORTS OF POLITICAL PARTIES

Annual financial reports of political parties of 2014
Political Parties are obliged to deposit in the Central Electoral Committee their financial expenditure relation in accordance with the article 23,Law nr.10374 , 10.02.2011 ‘For some changes and additions to 8580 law, 17.02.2000 “For Political Parties”, amended. The report model which is in accordance with the above mentioned law (article 15/2), has been approved by the Central Electoral Committee Decision nr.3, 18.01.2012 “For the approval of the rules and standardized format on financial reporting of political parties and other electoral subject and reports by auditing experts”. The report submission is due on 31 March of the forthcoming year, according to the Central Electoral Commission Decision nr.nr.3, 18.01.2012 “For the approval of the rules and standardized format on financial reporting of political parties and other electoral subject and reports by auditing experts”. CEC publishes these financial reports in its official website within 30 days from their submission. The public funding is available only after each political party has submitted its relation on expenditures executed in the preceding fiscal year. For these reason, only the parties benefiting from public funding are eligible to deposit their expenditure balance sheets to the CEC. Out of 124

political parties registered in Parties’ Register found in the First InstanceCourtof Tirana, have deposited financial balance sheet for the 2014 , only the following subjects:


1. Partia Socialiste e Shqipërisë (Socialist Party of Albania)

2. Partia Demokratike e Shqipërisë (Democratic Party of Albania)

3. Partia RepublikaneShqiptare (Republican Party of Albania)

4. Lëvizja SocialistepërIntegrim (Socialist Movement for Integration)

5. Partia Drejtësi, Integrim dhe Unitet (Party for Justice, Integration and Unity)

6. Partia BashkimipërtëDrejtat e Njeriut (Union for Human Rights)

7. Partia Demokristiane e Shqipërisë (Democristian Party of Albania)

8. Partia Kristian Demokrate (Christian Democratic Party)

9. Fryma e Re Demokratike (New Democratic Aspiration)

10. Partia Bashkimi Liberal Demokrat (Democratic Liberal Union Party)

11. Partia Civile (Civil Party)

12. Partia Aleanca Popullore (Popular Alliance Party)

13. Partia Aleanca Demokristiane e Shqipërisë (Democristian Alliance Party of Albania)

14. Partia Minoriteti Etnik Grek për të Ardhmen-MEGA (Party of Ethnic Minority for the Future MEGA)


Financial auditing of political parties
In accordance with the obligations deriving from the “Law on Political Parties”, for the auditing of public fund allocated and used by the political parties in the calendric year 2013 and with the decision nr.15 30.04.2014 ‘On the announcement on the results of drawing the lot on accounting experts that will audit political parties’ funds for the year 2013’,CEC. has appointed by lot 22 approved auditing experts that will audit the 124 political parties registered in Parties Register found in the Court of the First Instance of Tirana.
Only 21 out of the 22 experts did sign the service contract. Five of the experts, despite having stipulated the contract with CEC. (Juridical Department) and agreed what derived from it, did not at the end fulfill the obligations to audit political parties’ funding for the year 2013. The above mentioned experts had to audit a total of 34 political parties.

In conclusion,based on the auditing reports and information submitted to the CEC. by the selected and appointed auditing experts for the auditing of public fund allocated and used by 90 political parties for the year 2013, comes out that there has been no violations to the Law nr 8580, 17.02.2000 “For the Political Parties” .For these reasons no proposal for sanctions or penalties has been made by the auditing experts.


A.5. Distributions of annual funds for the political parties in the year 2014

In accordance with the article15/2, point 2, lettereof the Law nr.8580, 17.02.2000 “For Political Parties”, amended, CEC determines the financial amount allocated to each political party in the form of annual financial assistance. The Law ‘On the State Budget for the year 2014’, had already allocated anannual budget of 190 million ALL in the form of financial support for the year 2014. Article 19,point 2, of the Law ‘On Political Parties”, amended, determines the rules by which the yearly distribution of funds shall be made according the following criteria:

a) 70 %, according to the number of Parliamentary Seats gained in the last general political elections.Every party in the parliament is entitled to public financial contributionsaccording to the current Electoral Code in proportion to the seats gained;

b) 20% in equal amount among the parliamentary parties;

c) 10%,distributed to the parties which has gained at least 1% of the votes in the last parliamentary elections (country based)

The undistributed 10 % is added to the 70 % part and distributed to the parliamentary parties.

CEC nr.759, dated 06.08.2013 "On the announcement of the final results of the elections for the Assembly, dated 23 June 2013", with Decision Nr. 3, dated 20.01.2014 "On the distribution of the annual funding to political parties", distributed 190 million ALL between political parties, as follows:

After the approval on the decision for the amount of public funds to the benefit of political parties, Law nr.17 / 2014 "On some amendments in Law nr.8580, dated 17.02.2000" For political parties ",CEC has made changes toArticle 19 on the rules for determining the amount of public funds allocated to each political party.

Based on article 19, letter b of the Law Nr 8580, dated 17.02.2000, "For political parties", amended, 20% of the fund is allocatedamong the parliamentary parties and parties that have taken over 10,000 votes in the last parliamentary elections.

Also, the above-mentioned law according to Article 2, which entered into force on 30.03.2014 and did not provide financial effects that would affect the distribution of public funds for 2014.
The Demo-Christian Party, the Social Democratic Party, theParty for Social Democracy, the New Democratic Aspiration Party, The Red and Black Alliance Party,presented to the CEC the request on, "On the review of the decision No. 3, dated 20.01.2014 of the CEC" For Distribution of annual funding to political parties in the form of annual financial assistance for 2014 ".

CEC,by the decision nr. 14, dated 29.04.2014 "On consideration of the request of the DemoChristian Party, the Social Democratic Party, The Social Democracy Party, the New Democratic Aspiration Party, The Red and Black Alliance Party," On the review of the decision No.3, dated 20.01.2014 of the CEC "On an annual allocation of funds of Political Parties in the form of annual financial assistance for 2014" decided to reject the request.

Against the decision nr.14, dated 29.04.2014 of CEC, the interested subjects appealed at Administrative Court of First Instance in Tirana. Administrative Court of First Instance in Tirana with decision nr.4355,dated 23.07.2014 decided to announcethe lack of the subject matter jurisdiction and the transfer of Acts to the Electoral College of the Court of Appeals of Tirana.

The Electoral College of the Court of Appeal of Tirana after the reviewing of the administrative issues with decision nr.1,dated 06.10.2014, decided,the Dismissal of the case, passing the case to the Constitutional Court for an opinionregarding the decision nr.4355, dated 23.07.2014 of the Administrative Court of First Instance in Tirana, Law nr. 125/2014 "On an addition to the Law nr.17 / 2014" For additional nr.858017.02.2000 "On political parties,amended", on article1/1 has determined that the financial effects arising from implementation of this law, for the 2014budget year, extended only for the period from its entry into force by the end of the year that corresponds to the period from 30 March until the end of the year.

With the entering into force of the law, to the list of political parties that receive funds from the state budget as financial support for their annual activity, is also added a provision that parties which have gained 10 000 votes in the last parliamentary elections may benefit from public funds as follows:
1. Partia Demokracia Sociale (Social Democracy Party) 11,891 votes

2. Partia Social demokrate (Socialdemocratic Party)10,220 votes

3. Partia Demokristiane e Shqipërisë (Demochristian Party of Albania) 13,288 votes

4. Aleanca Kuq e Zi (The Red and Black Alliance Party) 10,196 votes

For this reason, the CEC decision nr.22, dated 31.10.2014 "On the redistribution of annual funding to political parties for the period April-December 2014", redistributed the sum of 142.5 ALL among the 12 political parties. In this way, 190 million ALL allocated from the state budget as the annual financial assistance to political parties in 2014, was distributed among 12 political parties as follows:

2. Partia Demokratike e Shqipërisë (Democratic Party of Albania)57.745.343ALL

3. Levizja Socialiste për Integrim (Socialist Party for Integration) 21.141.463 ALL

5. Partia Republikane Shqiptare (Albanian Republican Party )7.197.553ALL

6. Partia Bashkimi për të Drejtat e Njeriut (Union for Human Rights Party) 4.696.013 ALL

7. Partia Kristian Demokrate e Shqipërisë (Christian Democratic Party of Albania) 4.696.013 ALL

As shown in the above report, according to the Electoral Code and the law "For political parties" CEC checks and makestransparent to the public the finances of political parties during the election campaignas well as the funds obtained and spent by political parties during the calendric year.

Due to the important and problematic aspects that this process carries,CEC.in cooperation with international organizations, representatives of political parties, experts and interest groups have produced a detailed analysis, discussed during the proceedings of the Technical Roundtable, "The financing of political parties during election campaign ".


In order that the control and transparency of the political parties financial accounts maybe assured according to the principles and rules sanctioned by international documents , CEC has drafted a set ofrecommendations which details are given below.
