2.1 International Agreements

The Kyrgyz Republic is a Party to the following international agreements:




  • Convention on Environmental Impact Assessment in a Transboundary Context (ratified by the decree of the Legislative Committee o f the Parliament (Jogorku Kenesh) of the Kyrgyz Republic as of November 1, 2000);




  • Vienna Convention on Ozone Layer Protection, and Montreal Protocol on Ozone Layer Depleting Substances (ratified by the Law of the Kyrgyz Republic # 16 as of January 15, 2000);




  • On Kyrgyz Republic accession to the UN European Economic Commission Convention On Environmental Impact Assessment in a Transboundary Context (ratified by the Law of the Kyrgyz Republic # 6 as of January 12, 2001);




  • Convention on Access to Information, Public Participation and Justice on Environmental Issues (ratified by the Law of the Kyrgyz Republic #5 as of January 15, 2001).




  • Law of the Kyrgyz Republic On Kyrgyz Republic Accession to Convention on Biological Diversity as of July 26, 1996.




  • Law of the Kyrgyz Republic On Kyrgyz Republic Accession to Convention on Combating Desertification in Countries Experiencing Severe Draught and/or Desertification, particularly in Africa as of July 21, 1999.




  • Law of the Kyrgyz Republic On Kyrgyz Republic Accession to UN Framework Convention on Climate Change and UN EEC Convention on Long-range Transboundary Air Pollution as of January 14, 2000.




  • Law of the Kyrgyz Republic On Accession to International Convention on Protection of New Plan Species as of January 14, 2000.




  • Law of the Kyrgyz Republic On Ratification of Rotterdam Convention on Preliminary Agreement Procedure in regard to certain hazardous chemicals and pesticides in international trade as of January 15, 2000.




  • Law of the Kyrgyz Republic On Kyrgyz Republic Accession to UN Convention of Wetlands of International Importance as Habitats for Waterfowls (Ramsar Convention) as of April 10, 2002.




  • Law of the Kyrgyz Republic On Ratification of London, Copenhagen, and Montreal Amendments to Montreal Protocol On Ozone Layer Depleting Substances as of January 15, 2003.




  • Law of the Kyrgyz Republic On Ratification of Kyoto Protocol to UN Framework Convention on Climate Change as of January 15, 2003.




  • Decree of Legislative Committee of Jogorku Kenesh of the Kyrgyz Republic On Kyrgyz Republic Accession to Convention On World Cultural and Natural Heritage Protection as of June 8, 1995.




  • Decree of the Government of the Kyrgyz Republic On Implementation of Basel Convention on Transboundary Movements of Hazardous Waste and its Disposal and Agreement on hazardous and other Waste Transboundary Movement Control as of May 14, 1997.



2.2 Environmental Legislation and Regulations

The principal legislative documents pertaining to Environmental Impact Assessment (EIA) and Ecological Expertise (EE) in the Kyrgyz Republic are:




  • Law of the Kyrgyz Republic On Environmental Protection as of June 16, 1999;

  • Law of the Kyrgyz Republic on Ecological Expertise as of June 16, 1999;

  • Instruction On Order of Implementing Environmental Impact Assessment (EIA) in the Kyrgyz Republic (approved by the Ministry of Environmental Protection as of June 27, 1997);

  • Instruction On Order of Implementing State Ecological Expertise of Pre-project, Project and Other materials and Documents in the Kyrgyz Republic (approved by the Ministry of Environmental Protection as of September 3, 1997).

The Law of the Kyrgyz Republic on Environmental Protection (June 16, 1999) is the principal legal instrument governing environmental protection within the Republic and the Law of the Kyrgyz Republic on Ecological Expertise (June 16,1999) is the principal instrument governing the process of environmental assessment.



2.3 Other Relevant Laws

During the past four years (1999 - 2003) legislative acts on regulation of environmental management and environment and nature protection have been significantly updated and improved reflecting the State’s commitment to modernizing its environmental policy. Among the most important legislative acts are:




    • Law of the Kyrgyz Republic On Wildlife as of June 17, 1999;

    • Law On Atmospheric Air Protection as of June 12, 1999;

    • Law On Biosphere Territories as of June 9, 1999;

    • Law On Protection and Use of Plants as of June 20, 2001;

    • Law On Industrial Waste as of November 13, 2001.

From the perspective of securing environmental safety the following laws are considered to be the most important:





  • Law On Protection of Population in case of Emergency Situations as of February 24, 2000;

  • Law On Radiological Safety of Population as of June 17, 1999;

  • Law On Drinking Water as of March 25, 1999;

  • Law On Sanitary and Epidemiological Well-being of Population as of April 17, 2000;

  • Law On Radioactive Waste Treatment as of February 12, 2001;

  • Law On Mining Waste Tailings and Slag Heaps as of June 26, 2001;

  • Law On Interstate Use of Water Bodies, Water Resources and Water Facilities as of July 23, 2001;

  • Law On Agricultural Land Management as of January 11, 2001;

  • Law On Unions (Associations) of Water Users as of March 15, 2002;

  • Law On Mineral Resource Sharing Agreements as of April 10, 2002;

  • Law on Mountainous Territories as of November 1, 2002;

  • Law on Biodiversity Preservation Strategy as of August 3, 2002;

  • Land Code of the Kyrgyz Republic as of June 2, 1999; and

  • Forestry Code of the Kyrgyz Republic as of July 8, 1999.
