SPONSOR: The $25,000 Pick the Pole Giveaway (the “Pick the Pole Giveaway) is sponsored by Charlotte Motor Speedway, LLC aka Lowe’s Motor Speedway, PO Box 600 Concord, NC 28026 (“LMS”), CT Communications, Inc. (“CTC”) and Circle K Stores, Inc. (“Circle K”). LMS, CTC and Circle K shall be referred to herein collectively as “Sponsor”.

WHO CAN ENTER? NO PURCHASE NECESSARY: Open only to legal U.S residents 21 years of age or older. Employees of CTC, Circle K, LMS, Speedway Motorsports, Inc., Atlanta Motor Speedway, Inc., Bristol Motor Speedway Inc., Las Vegas Motor Speedway Inc., Speedway Sonoma, LLC aka Infineon Raceway, Texas Motor Speedway Inc, NASCAR, its advertising and promotion agencies, their respective parent companies, affiliates, agents, retailers, subsidiaries, sales representatives and/or distributors and their immediate families, (parents, children, spouse, siblings) and those living in the same household (whether related or not) as such individuals are not eligible. Void in Puerto Rico and where ever prohibited by law.

HOW TO ENTER: Eligible individuals can enter by picking up an entry blank form (“Entry Forms”) for the “25,000 Pick the Pole Giveaway” at CTC and Circle K stores. Not all retailers may be participating. Completed Entry Forms must be submitted to the appropriate driver box on the avenue of flags at Lowe’s Motor Speedway located at 5555 Concord Parkway, Concord, North Carolina 28027 on Thursday, May 25, 2006 between the hours of 9:00 AM and 6:45 PM (EST). Limit one (1) entry per person.
Entry Forms for the Pick the Pole Giveaway will be made available beginning on May 1, 2006. ALL ENTRIES MUST BE RECEIVED BY May 25, 2006 by 06:45 PM (EST).
No illegible, incomplete, forged or altered entries or mechanically reproduced entries will be accepted. Sponsor and judges not responsible for late, lost, stolen, damaged, garbled, incomplete, misaddressed, or misdirected entries or mail, for errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures. Sponsor reserves the right, at its sole discretion, to cancel, terminate or suspend this Pick the Pole Giveaway and award the Prize Money from among eligible entries received as of the time of such action should any unauthorized human intervention or other causes beyond Sponsor’s control corrupt or affect the administration, security, fairness or proper conduct of the Pick the Pole Giveaway. Entrant understands that the information supplied on the Entry Form may be used for marketing purposes.
ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE, TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE PICK THE POLE GIVEAWAY IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION; AND IF SUCH INDIVIDUAL ENTERS THE PICK THE POLE GIVEAWAY HE/SHE WILL BE DISQUALIFYIED.

SELECTION OF THE WINNERS: All Entry Forms will be audited by a third party accounting firm (the “Firm”). The participant who guesses the winning driver and the closest winning speed (without going over) of the NEXTEL Cup Qualifying on CTC Pole Night on May 25, 2006 will be contacted after qualifying results are made official by NASCAR. The Firm who audits the entry blanks to determine the Pick the Pole Giveaway winner will be the official conductor of the giveaway. The Firm’s decisions are final and binding in all respects. By participating, entrants agree to abide by and be bound by these Official Rules and the decisions of the Firm.

PRIZE/APPROXIMATE RETAIL VALUE (ARV)
Prize Money Awarded to One Winner: Upon the conclusion of the NEXTEL Cup Qualifying on CTC Pole Night, Thursday May 25, 2006, the winner will be notified via phone within six hours of qualifying results being made official by NASCAR. If NASCAR’s official results are made available in time, representatives of the Sponsor will use reasonable efforts to inform the winner in person the night of the event. A check for $25,000 (USD) (the “Prize Money”) will be awarded to the winner. In the event of a tie (that is, more than one entrant correctly guesses the winning driver and the closest winning speed), the Prize Money will be divided evenly among all winners.
ODDS OF WINNING: Odds of winning depend on the total number of eligible entries received.

PICK THE POLE GIVEAWAY NOTIFICATIONS: Winner will be notified via phone within six hours of qualifying results being made official by NASCAR. The Prize Money will not be awarded until the notified winner submits a signed affidavit and release. The Sponsors will make the Prize Money and all details available beginning with the publication of NASCAR’s official results of the CTC Pole Qualifying and the official declaration of a winner by the Firm. All details upon final approval by LMS.

WINNERS’ RESPONSIBILITIES: The Pick the Pole Giveaway winner will be solely responsible for all taxes on the Prize Money and will receive an IRS Form 1099 for the value of the Prize Money.
The winner will be required to sign an Affidavit of Eligibility, Liability Release and a Publicity Release (except where prohibited by law) prior to issuance of the Prize Money. The Prize Money may be awarded to an alternate winner if affidavit is not returned within 14 days after mailing to winner or if prize notification letter or Prize Money is returned as undeliverable.
The Prize Money is non-transferable. No prize substitution will be given, but the Sponsor reserves the right to substitute a prize (or any part of the prize) with a prize of equal or greater value. Taxes on prizes are solely the winner’s responsibility. By entering you agree to accept the whole prize. If you cannot accept the whole prize you must forfeit the prize and another winner will be selected.

RELEASE: By participating, entrants agree, and by accepting the Prize Money, winner agrees, to release and hold harmless Charlotte Motor Speedway, LLC aka Lowe’s Motor Speedway, its parent company and their respective companies, affiliates, agents and subsidiaries, and the officers, directors, shareholders, agents and employees of any of the above entities organizations from any and all liability, loss or damage incurred by participating in these Pick the Pole Giveaway and/or the awarding, receipt, acceptance, possession or use/misuse of the Prize Money. By accepting the Prize Money the winner agrees to Sponsor’s use of his/her name and address (city & state), photograph, videotape or likeness for advertising or publicity purposes and to the use of statements made by or attributed to the winner relating to Pick the Pole Giveaway or Sponsor, and grants to Sponsor any and all rights to said use, without further compensation or notice, unless prohibited by law.

WINNERS LIST/RULES REQUESTS: For the name of the Winner, send a self-addressed, stamped envelope by December 31, 2006 to: “Pick the Pole Giveaway,” PO Box 600 Concord, NC 28026. For a copy of the official rules, send a self-addressed stamped envelope by December 31, 2007 to: “Pick the Pole Giveaway” PO Box 600 Concord, NC 28026.

MODIFICATION: Sponsor reserves the right, at its sole discretion, to modify, cancel, postpone, delay, suspend and/or terminate this Giveaway game and/or Event in whole or in part in the event that the Giveaway game is not capable of running as planned or as intended by these Official Rules by reason of any of the technical or other disabling causes as described in Rule 3 or other causes that, in the sole discretion of the Sponsor, impair, corrupt or interrupt the administration, fairness, security or integrity or proper play of the Pick the Pole Giveaway game, including without limitation, hurricane, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, war, terrorist threat or activity or insurrection. In the event of cancellation of the CTC Pole Qualifying event for any reason, the Pick the Pole Giveaway will be cancelled as well and no Prize Money will be awarded.
