ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS

Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.

The following provisions are incorporated into 52.212-1 as an addendum to this solicitation:

EVALUATION FACTORS CRITERIA

General considerations:


  1. The Department of Veterans Affairs will implement the Veterans First Contracting Program P.L. 109-461, and the VA Rule of Two – means the process in 38 U.S.C. 8127 (d) whereby a contracting officer of the Department “shall award contracts on the basis of competition restricted to small business concerns owned and controlled by veterans, if the contracting officer has a reasonable expectation that two or more small business concerns owned and controlled by veterans will submit offers, and that the award can be made at a fair and reasonable price that offers the best value to the United States.” Preference will be given to Veterans-Owned Small Businesses in accordance with above mentioned implementation. Offerors shall be registered in VetBiz at the time of award.



  1. Based on market research findings this solicitation is published as a Total Small Business Set Aside. All small businesses including those not veterans’ ones can submit their offers for evaluation.



  1. The Government will determine acceptability by assessing the offeror’s compliance with the terms of the Request for Quotations to include the technical information required by the Performance Work Statement (PWS).



  1. The Government will evaluate the quotations received as per FAR 13.106-2.

    1. Quotations will be evaluated in an impartial manner.

    2. Contracting will conduct a comparative evaluation of offers.

    3. All quotations will be considered; however, those offers having the highest past performance rating will represent the best value, when compared to any lower priced quotation/offer.

    4. Quotations/Offers in response to this solicitation shall be provided, if possible, via postal mail or in person to:

    1. If via email, please send to: AQG@va.gov or America.Quinones-Gonzalez@va.gov. Consequently, if offeror determines to submit it electronically, offeror is responsible of reassuring all information submitted was transmitted and received on time, and complete. The Government limits the data to be received, and will not be responsible for any information not transmitted and/or received on time and complete.

    2. Offers/Quotations shall be submitted by or before Tuesday, November 14, 2017 and not later than 2:00 PM Atlantic Standard Time- Puerto Rico time.

    3. Last day for Questions submittal will be Wednesday, November 8, 2017 at 10:00 AM AST-PR Time.



  1. At minimum, the Government will determine contractor’s responsibility by analyzing whether the apparent successful offeror complies with the requirements of FAR 9.1 including, but not limited to:



  • Adequate financial resources or the ability to obtain them;

  • Ability to comply with the required performance period, taking into consideration all existing commercial and governmental business commitments;

  • Satisfactory record of integrity and business ethics;

  • Necessary organization, experience, and skills or the ability to obtain them;

  • Necessary equipment and facilities or the ability to obtain them; and

  • Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
