MINUTES OF THE WORK SESSION OF MAYOR AND COUNCIL OF THE BOROUGH OF STONE HARBOR HELD IN THE MUNICIPAL BUILDING, September 2, 2014

The meeting was called to order by Mayor Walters at 4:30 p.m.

Mayor Walters announced that the meeting was now open. Adequate notice of the meeting was provided by posting a copy of the time and place on the Municipal Clerk’s bulletin board and mailing a copy of same to the Press and the Cape May County Herald on January 8, 2014.

COUNTY PRESENTATION – Scott Campbell, Chairman of the Cape May County Chamber of Commerce and Vicki Clark, President presented Mayor Walters with a Resolution in Celebration of Stone Harbor’s 100th Anniversary.
Laurie Pettigrew – Regional Superintendent of NJDFW, Southern Region, presented a slide on the project they are doing with the Army Corp of Engineers in the area. She gave an overview and explained some of the techniques they are using during this project. This project is the beneficial re-use of dredge material for marsh restoration. Material is being dredged from an area near the free bridge and sprayed over an area of Ring Island to create a black skimmer habitat. It has been a learning experience and this procedure may be used up and down the coast in the future. The area and the vegetation will be closely monitored in the future.
Monica Chasten – Army Corp of Engineers was asked several questions about permit timing and State and Federal regulations.
Mayor Walters opened to the public for questions.

John Ryan 10023 Sunset Drive President of Tuxedo Cove Dredging Association asked if this project is going on now, where the bulldozer is. Laurie Pettigrew said yes the part you see is the Black Skimmer Habitat. He asked if the elevation is at its peak. She said yes, its top will be about 5 feet above mean high water. He asked what type of vegetation will be planted there. She said they do not plan to plant anything there, it will not be higher. He asked if the soil was tested and as he understands it if the soil is contaminated it is ok to move that to a site that is just as contaminated. She said that was correct.

Dale Florio 10672 Golden Gate asked questions about the dredging season. One of the limitations is between Jan-Feb the so called winter flounder, how do we go about changing that, can you change it, or is there a reason why they still think winter flounder is in the area. Laurie Pettigrew said it is true there are dredging restrictions Dec 31 is the cut- off date for dredging because of the winter flounder. There are committee meetings and you do have representation with the Fish & Game Council you could go to them. Those restrictions are more Federal, not necessarily State restrictions and it has to do with the entire East Coast fishery. Mayor Walters mentioned again that she was at a meeting in Cape May with the Fisheries and they are looking into changing our area out of their flounder season, the Council is fighting to get legislation to take Cape May County and maybe Atlantic County out of it. The Congressman is aware of it.
Bunny Parzyck 9925 Sunset Drive her home is just across from the project just being completed and she thought it was interesting that there were not going to be any plantings there. When she first saw the project starting it reminded her of a spoil site. And the spoil sites she sees tend to grow vegetation, trees, etc. Laurie said some vegetation will grow but it will be monitored.

Matt Dalon, PE Ocean Coastal Consultants presented a slide show representing the Stone Harbor Dredged Material Management Plan, Progress Report to Council. It included the Project Summary, Dredging Demand, Dredging Demand Input, 10 yr Dredging Demand Results, Alternative Analysis, and DMMP Report. He stated the project will be specific to the material that is being dredged, how much material is dredged, where it is coming from and where it is going to go, so it is tough to put a single number on each option in the report. Councilmember Carusi said on the past page, provide recommendations, next step and DMMP Draft Report on September 19th what does that mean. Matt said it will include your total demand and recommendations on what alternatives should be utilized to manage that material and the next steps to do that, to proceed with dredging projects. His complete report is on the Borough Web Page and on file in the Borough Clerk’s office.


Mayor Walters opened the meeting to the public.
John Ryan 10023 Sunset stated ten years ago when the Borough dredged, Tuxedo Cove was left off the permit. Seven years later they were turned down by DEP and the Army Corp. With great help from the Borough it was proved we were dredged in the 1930’s and 1940’s they were able to get a maintenance permit. He hired a dredger and took out 40,000 cu yds. in six weeks, on budget. He recently met with Josee, the Mayor, and Jill after he heard this project may cost 3 ½ million. He said he would consult for the township and put together a proposal. We dredged and partnered with the Stone Harbor Marina, took the spoils there, let them dry for 24 hours and trucked them to Cape May to a mining company, $6.50 per cu yd. His plan for the Borough was to do the exact same thing, put the spoils on the municipal pier, let them sit and truck them off. A clean a simple project, done in six months. He also believes the Yacht Club is dredging and they have been approved. Tuxedo Cove plans to dredge again next year we should all partner and divide the start up money.

Tim Keane from Stone Harbor Marina – Council would be well advised to look beyond the 96th Street bridge and look at Stone Harbor Marina and Stone Harbor Manor, Middle Township has a stake in this as well, a vested interested. We would be interested in partnering with the Borough.


Rich Redeker 11617 Paradise Dr. asked Matt if he had been through all the lagoons at low tide and looked at where the problems are. Matt said he has not. Mr. Redeker suggested that he take Matt around . He understands the Army Corp did it and their boat got stuck. He asked about the note on page 4 of the presentation stating the waterway between Sedge Island and Paradise Bay would not be done and he can’t understand why. Matt said one of the factors is the permitting. Mr. Redeker said if the Borough goes through the expense of dredging and you should do that water, which is horribly congested and total mud. If we don’t do that piece isn’t that sediment going to go back into the basins. Do not leave a major piece out of it. Matt said we are including an access channel to the intracoastal waterway, it will hug the lagoons and slips there, but we will not do that cut through, there are a lot of shallow spots and a lot of sediment movement.
Tim Keane – Stone Harbor Marina said Mr. Redeker’s point well taken, get out in a boat and look at it, many areas are borderline dangerous he pulls 6-8 boats out of the mud each day.
John Ryan 10023 Sunset said after Hurricane Sandy they paid their original Engineer to come back and measure, we took out 3 feet originally, he came down and measured all the properties and 2 ½ feet of muck had come back in, so we are only 6 inches ahead of what we were when we dredged a couple of years ago.

Dale Florio 10672 Golden Gate said on the slide show it says a draft final report on September 19th or how is it categorized ? Matt said it is a report that will be submitted for approval. Mr. Florio said Mayor and Council, once they received that report have to determined how much time you will deliberate because he assumes in the final report there will be a list of options, cost associated, and knowing how short the dredging season is, you would have to move pretty quickly if we want to be prepared to do something September 1st of next year. What has Mayor and Council done in establishing a time-line so we can move forward? Mayor said she will be putting together a special committee on dredging tonight, and they will have a report ready for the next Council meeting which is September 16th. We will be making recommendations to Ocean Coastal Consultants and hopefully on the 16th taking some kind of action to get moving, start testing.

Rich Redeker 11617 Paradise Dr suggests that Matt, who is going to write this report, take a ride with him, thinks Council should require him before he writes this report, how can he write a report when he hasn’t seen what is there.
Mayor said we have data from Stockton, there were people out there, it just wasn’t Matt.

RESOLUTION 2014-S-166 (Waive Down Payment)

RESOLUTION OF THE BOROUGH OF STONE HARBOR
MAKING APPLICATION TO THE LOCAL FINANCE BOARD
PURSUANT TO N.J.S.A. 40A:2-7(d), 40A:2-26(e) AND 58:11B-9(a)

WHEREAS, THE Borough of Stone Harbor desires to make application to the Local Finance Board for its review and/or approval of a proposed down payment waiver for a bond ordinance and a nonconforming maturity schedule in connection with a water supply and distribution system and sanitary sewerage system project to be financed through the New Jersey Environmental Infrastructure Trust financing program.

WHEREAS, the Borough of Stone Harbor believes:

(a) It is in the public interest to accomplish such purpose;

(b) said purpose or improvements are for the health, wealth, convenience or betterment of the inhabitants of the local unit or units;

(c) the amounts to be expended for said purpose or improvements are not unreasonable or exorbitant;

(d) the proposal is an efficient and feasible means of providing services for the needs of the inhabitants of the local unit or units and will not create an undue financial burden to be placed upon the local unit or units;

NOW THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Stone Harbor as follows:

Section 1. The application to the Local Finance Board is hereby approved, and the Administrator, Chief Financial Officer, Auditor, Engineer, Bond Counsel and financial advisor, along with other representatives of the Borough, are hereby authorized to prepare such application and to represent the Borough in matters pertaining thereto.

Section 2. The Clerk of the Borough is hereby directed to prepare and file a copy of the proposed bond ordinance and nonconforming maturity schedule with the Local Finance Board as part of such application.

Section 3. The Local Finance Board is hereby respectfully requested to consider such application and to record its findings, recommendations and/or approvals as provided by the applicable New Jersey Statute.

Resolution: Approval to submit a grant application and execute a grant contract with the New Jersey Department of Transportation for the 95th Street Road Reconstruction project.

NOW, THEREFORE, BE IT RESOLVED that Council of the Borough of Stone Harbor formally approves the grant application for the above stated project.


BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit an electronic grant application identified as MA-2015-Stone Harbor Borough-00029 to the New Jersey Department of Transportation on behalf of the Borough of Stone Harbor.
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the grant agreement on behalf of the Borough of Stone Harbor and that their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement.

RESOLUTION 2014-S-168 – (Refund Lobster Dinner Tickets)

WHEREAS, Doris Zogas, 2015 Steuben Road, Reading, Pa. 19602 purchased six (6) tickets for the Centennial Celebration Lobster Dinner on August 27, 2014; and
WHEREAS, she has notified the Borough that she will be unable to attend the Centennial Celebration and the tickets have been returned to the Borough; and
WHEREAS, the Recreation Director has requested a refund of $ 300 to be sent to Doris Zogas at the above address and the request was approved by the CFO;
NOW, THEREFORE, BE IT RESOLVED, on this 2nd day of September, 2014, by the Mayor and Council of the Borough of Stone Harbor, in the County of Cape May that $ $300.00 be refunded to Doris Zogas and that the proper officers make the proper adjustments in the Borough records.

RESOLUTION 2014-S-169– (Cape Express Soccer Use of Fields)

A RESOLUTION CREATING AN INTERLOCAL SERVICES AGREEMENT WITH CAPE EXPRESS SOCCER CLUB FOR THE USE OF

THE RECREATION FIELDS

OF THE BOROUGH OF STONE HARBOR
WHEREAS, N.J.S.A. 40:8A-1 et seq., authorizes municipalities and school districts to enter into agreements for the purposes of exchanging, sharing and cooperating with regard to services common to said communities through Interlocal Services Agreements ; and
WHEREAS, the Cape Express Soccer Club is in need of services relating to the use of recreational playing fields of the Borough of Stone Harbor for use by its High School sports soccer teams; and
WHEREAS, the Borough of Stone Harbor has certain lands, equipment and personnel available to meet the needs of the Cape Express Soccer Club in this area; and
WHEREAS, entering into an Interlocal Services Agreement with the Cape Express Soccer Club for this purpose has been deemed to be in the best interests of citizens of the Borough and the players of the Cape Express Soccer Club; and
WHEREAS, in consideration of this Agreement and in an effort to supplement the costs of maintenance of Borough facilities, Cape Express Soccer Club agrees to pay the Borough the sum of $1,500.00 per season..
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Stone Harbor, County of Cape May, State of New Jersey on this 2nd day of September, 2014, that the preamble of this Resolution is hereby incorporated by reference;
BE IT FURTHER RESOLVED that the Borough of Stone Harbor and Cape Express Soccer Club hereby agree, under the authority of N.J.S.A. 40:8A-1 et seq., as follows:


  1. Cape Express Soccer Club agrees to pay the sum of $1,500.00 per season per season and shall have full access to and use of the recreational ball fields of the Borough of Stone Harbor located in the vicinity of 80th Street and Second Avenue, for recreational activities officially sanctioned and conducted by the Cape Express Soccer Club. Including Saturday and Sunday Use, September 2, 2014 to June 1, 2015 10:00 am – 6:00 pm and Saturday and Sunday, October 11 and 12, 2014 for the Annual George Pratt Columbus Day Week-end Tournament.




  1. Such access and use shall be conditioned upon coordination with and approval by the Recreation Director of the Borough of Stone Harbor with the understanding that the activities of the Borough of Stone Harbor Recreation Department take precedence.




  1. The term of this Interlocal Services Agreement shall be from September 2, 2014 through June 1, 2015.




  1. The Cape Express Soccer Club shall provide to the Borough of Stone Harbor written proof of liability insurance for the aforementioned use of the property of the Borough of Stone Harbor as required by the Atlantic County Joint Insurance Fund; and shall, additionally, hold harmless and indemnify the Borough of Stone Harbor for any and all loses, damages, and claims of whatever nature that may arise out of or in connection with the use of the property by the Cape Express Soccer Club, its sports/recreation participants, agents, contractors, officers and/or employees.



BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized and directed to execute this Resolution as the Interlocal Services Agreement between the Borough of Stone Harbor and the Cape Express Soccer Club, pursuant to N.J.S.A. 40:8A-1 et seq.

That Borough Hall and Public Works Department be closed on September 11, 2014 from 11-12 so that employees can attend the Freedom Park Ceremony.

DISCUSSION:
Alcoholic Beverage Area Map Councilmember Mastrangelo showed a map showing in red the existing areas set by Ordinance that allow liquor licenses to be located. The areas to be added and recommended by A & F were projected in yellow and contain the three stores next to the Reeds on Third Avenue and the north side of 97th Street up to the Shelter Haven parking lot.

He asked for comments from Council. Councilmember Lane asked why are we changing this we are not going to be adding more liquor licenses, what is the purpose of this. Solicitor said we have a very limited number of liquor licenses that is never going to increase, just license which may move around in this zone. He assumes the area was formed to keep the liquor licenses in the Central Business District. He stated that by law the Council is the authority for granting these licenses, you can put reasonably conditions on every license. Even if we didn’t have the zone and someone wanted to move a license, that has to come before Council.


Councilmember Lane said if an existing liquor license at an existing facility wanted to move to another location they could do it within this zone but would still have to come before Council. Solicitor said that is right.
Councilmember Rich said years ago when Hahn’s was on 96th Street their liquor license went through from 96th to 97th Street. This would put it back that way. She asked if anyone has come to Council and asked for these changes. Mayor said one formally asked and another has mentioned it. Mrs. Rich, when you want to be creative, if the yellow area become all liquor eligible, that is a big bar. Solicitor said only if we allow it, the plan would come before Council

Mrs. Rich also asked if the public should be notified that we are talking about this, it might be a friendly idea. Also one property is on Third Avenue, which is a County road, do we have to notify them. Solicitor did not think so, Mayor said this would be an Ordinance so there would be a public hearing. Councilmember Mastrangelo said this has already been discussed twice.

He asked everyone to digest it, think about it and we will discuss it again.
