REGULAR MEETING
JULY 7, 2015

A regular meeting of the North Wildwood City Council was held on the evening of the above date in the City Hall. The President of Council stated, “The meeting is now open. Adequate notice of this meeting has been provided by posting a copy of the notice of the time and place of this meeting on the City Clerk’s bulletin board and by mailing a copy of the same to The Herald, The Press and Wildwood Leader on January 7, 2015.”
ROLL CALL: Present were Mayor Patrick Rosenello, President of Council Salvatore Zampirri, Councilpersons Edwin Koehler, Margaret Bishop, James Kane, Joseph Rullo, David Del Conte and Kellyann Tolomeo. Also present were City Administrator Kevin Yecco, Solicitor William Kaufmann and Engineer Ralph Petrella.
MINUTES: On a motion by Koehler, seconded by Tolomeo, that the minutes of the regular meeting of June 16, 2015 be approved as read. Carried.

ORDINANCE NO. 1679 – On a motion by Koehler, seconded by Tolomeo, that Ordinance No. 1679 be placed on its second reading. Carried.
The City Clerk read Ordinance No. 1679 by its title, as required by Law, Known As “An Ordinance Designating Names For Various Unnamed Alleys In The City Of North Wildwood“.
This Ordinance has been published according to Law, posted on the City Clerk’s bulletin board with copies available in the City Clerk’s Office on request.
The President of Council stated this was the time and place to hold a public hearing on Ordinance No. 1679 and asked if anyone present had any objections to the passage of this Ordinance. Hearing none, he then asked the City Clerk if he had received any objections in writing, the City Clerk stated none, the President of Council declared the hearing closed.
On a motion by Koehler, seconded by Tolomeo, that Ordinance No. 1679 be passed on its second reading and published according to Law, the roll being called, all voting in the affirmative, the President of Council declared Ordinance No. 1679 duly adopted.
ORDINANCE NO. 1681 – On a motion by Tolomeo, seconded by Bishop, that Ordinance No. 1681 be placed on its second reading. Carried.

COUNCIL:
COUNCILMAN KOEHLER thanked all City Employees who helped all run smoothly during the very busy July 4 Weekend.
CITY CLERK JETT read the following letter from Mr. John Halligan:
Just wanted to say thank you to the above pictured police officers. There
was a 4th but didn't make it into the picture. In light of all the bad press
that police officers are receiving it is necessary to share pictures like
this. I am a police officer as well and know all to well what we are up
against. My family has been vacationing in North Wildwood for as long as I
can remember. The North Wildwood Police Department has always been a high
class professional department.
Not only do you welcome is with open arms for the MALESW in the fall you
make us all feel right at home throughout the year. It is no easy task
protecting the influx of visitors and residents during these summer months
but NWPD does it extremely well.
All it took was less then 10 seconds to make my son's night by posing for a
picture with his heroes. It may not seem big to some but it meant the world
to him. The picture painted of police today makes it seem that we are
heartless and unapproachable. This proves that wrong. Thank you all and be
safe.
MAYOR ROSENELLO stated that he has received a letter thanking the EMTs of the Fire Department for their quick and capable response – they saved his life when he suffered a heart attack.

CHRISTINE GAIN, 507 E. 12th Avenue, stated that her family was disappointed about the unexpected removal of the 12th Avenue surf beach. The surf beach at 2nd Avenue is dangerous. There are strong currents and riptides. The slope is dangerous and there have been drownings in the Inlet. The jetskis create a hazard for our children. There are no signs or bouys marking the area as a surf beach. The outfall pipe is dangerous. Surfers have needed to be saved from being knocked around near the outfall pipe. There should be signs at the outfall pipe. There are high readings of pollution near the outfall pipe after heavy rains. The flags in the area indicate that no swimming or fishing is permitted in that area but fishermen are there anyway. The small fish in the area attract larger fish, including predators such as sharks. There should be no fishing allowed where we have surfers in the water. The sunbathers are always welcome at 12th Avenue beach but they should move to another area if they feel crowded. Many senior citizens enjoy 12th Avenue beach. The surfers do not take up much room there. The 12th Avenue area is made up of private residences and small condo units. The surf beach in this area does not affect many people. The Beach Patrol says they cannot protect both surfers and sunbathers but they never respond to calls like the Mayor’s office. The Beach Patrol should do what is necessary to protect everyone who wants to enjoy the 12th Avenue beach. They also need to enforce the use of leashes on the surf boards. Now our children are in a dangerous situation. The open grate was only closed this past week. The City should be more pro-active in protecting our children. The signage needs to be improved at the new surf beach. Families were not given notice about closing the 12th Avenue surf beach. Novice surfers are in a dangerous area now. Is this acceptable without taking care of all the dangers that exist in the Inlet area? Please consider moving the surf beach back to 12th Avenue. It is a safe location. Please put in better safeguards for our children.
JOE JURUSZ, 220 E. 11th Avenue, stated the 3rd Avenue is not suitable for surfing. There are ever-shifting sandbars and currents. It is not safe for beginning surfers. This area puts all surfers at risk. It is a long way out and someone in distress would have to wait a long time to be rescued. The 3rd avenue beach has never been used for surfing. It has dangerous currents and riptides. There are jetskis near the surfers. The State Police have only been there once. We were told to write down the registration numbers of the jetskis. This area is an accident waiting to happen. ESA cancelled their surfing contests in North Wildwood after 15 years because they would not hold a contest where dangerous conditions exist. The City needs a safer surf beach than 3rd Avenue. The 12th Avenue beach is ideal for surfing. Other municipalities in Cape May County have surfing beaches (except Wildwood). When was the decision made to close the 12th avenue surf beach? (answer: after Memorial Day weekend). Who made this decision? (answer: Mayor, Public Safety Committee, Council). Who had input in the decision? (answer: Beach Patrol Chief, Mayor). It is not in the meeting minutes why this decision was made. There should have been input from other sources, etc.
MAYOR ROSENELLO stated that when there is a public safety issue we do not take public opinion polls. We address the issue immediately. When the Beach Patrol Chief or the Fire Chief or the Police Chief have a problem we make a decision which we believe will be the best for the municipality. When the Beach Patrol Chief stated that due to the erosion along the front beach the Beach Patrol could not adequately provide a safe beach for both surfers and swimmers in the 12th Avenue area, the decision was made to close that particular beach to surfing. There is no conspiracy involved here against surfing or surfers; it was a public safety issue that was addressed at the recommendation of the Beach Patrol Chief.
JOE JURUSZ stated that when the 9th Avenue surf beach was closed in 2013 it was later reopened. If erosion is the issue, surfers have nothing to do with that. They only bring their backpacks and spend the day in the water. We would like a solution, perhaps rotating the days that the surf beach at 12th Avenue can be open, so that surfers and sunbathers can all be satisfied. We do not want our children getting run over by jetskis. Councilmembers should sit at different areas of the beach and count the jetskis. There are more in the Inlet area near the surf beach than anywhere else. The City should get the surfers out of the Inlet area. There was plenty of room at 12th Avenue today; it was not crowded at all. 3rd Avenue was crowded.

MAYOR ROSENELLO stated that the City hopes to reopen the 12th Avenue surf beach as soon as possible. This past weekend there was no way that the Beach Patrol could have sectioned off a surf beach in the 12th Avenue area. It would have been physically impossible. The entire beach was too crowded for the people to have to have moved to the north or south. If a family feels that the 2nd Avenue surf beach is not safe, then they should not surf there. The City would love to open the 12th Avenue surf beach but it is not possible at present. Thousands of surfers are enjoying the 2nd Avenue surf beach there have been no incidents. We are working with the State Police to patrol the area for jetskis. There are jetski problems all along the beach, not just in the Inlet.
JOANNE JURUSZ, 220 E. 11th Avenue, stated that she wonders every day if her children will come home from surfing. They experience many dangers at the 2nd Avenue surf beach, including stomach aches. The City government should work with the public not against it. There was no consideration given before making this decision. My letter was not read at the last City Council meeting. Did all Council members receive my letter? (answer: yes). Were any alternatives considered? Why is 12th Avenue surf beach closed to surfing? The surfers are in the water, not on the beach. They have as much a right to the beach as the sunbathers do. The current situation is making you look bad. The beach is not smaller this year than any other year.
MAYOR ROSENELLO stated that 2nd Avenue is the alternative. There is much more sand and beach at 2nd Avenue than at 12th Avenue. That area can handle both surfers and sunbathers. The City has spent millions $$$ recently to build up the front beach but it is the Inlet side that is currently growing. In the last 12 years we have never had such erosion along the entire front beach as we have had this year. The vast majority of visitors to our beaches are sunbathers and swimmers. As a result of the extreme erosion on the front beach, the Beach Patrol Chief recommended that we limit surfing to the 2nd Avenue beach this summer. The beach is absolutely smaller this year than in previous years.
PRESIDENT OF COUNCIL ZAMPIRRI stated that the City is trying to do what is best for surfers; that is, provide a beach where they can surf. No one has been harmed and there have been no incidents at the 2nd Avenue surf beach.
JOANNE JURUSZ asked Mayor and Council if they would send their children to surf at 2nd Avenue.
MAYOR ROSENELLO stated that his children have been surfing there for years.
COUNCILWOMAN TOLOMEO stated that 2nd Avenue surf beach is a clean area and the safety issues can be addressed. Would you not listen to the recommendation of the Beach Patrol Chief who has been on the beach for 45 years?
JOANNE JURUSZ stated that only a fraction of the surfers are here tonight. Jurusz does not feel good when coming into North Wildwood anymore. This whole situation stinks and does not make sense. We do not know how this decision came about and we want answers. You should be concerned about the safety of our children. We want everyone to be happy.
NATHAN GAIN, 507 E. 12th Avenue, stated that there are many concerns over safety issues at the 2nd Avenue surf beach. The City does not support the rights of children to surf. The surf beach area is dirty, it is not safe and the decision to make us surf there is not right. The City is not doing anything to protect the rights of residents and visitors. The jetskis are dangerous and deadly. They should be 200 yards off shore. That is the legal limit. The City is not addressing the issues that are important to public safety.
BOB MASCHIO, 623 W. Spruce Avenue, stated that he had promised his little sister that he would teach her to surf but now it is too dangerous for a beginner to learn at the 2nd Avenue surf beach. The outfall pipe makes the area unsuitable for surfing. That area is the 6th most polluted area in the State; Mayor Rosenello has seen the report.

MAYOR ROSENELLO stated he has the correct report from Stockton University refuting the nonsense on the Internet.
BOB MASCHIO stated that there are many concerns about having the surf beach near the outfall pipe. Wetsuit smelled awful after surfing there recently. There are sharks and man-of-wars in that area. There has never been marine life in the 11th /12th Avenue areas. It is much safer there. My sister doesn’t want to go surfing now and the waves in the Inlet are not as good as the waves at 12th Avenue. Does the Beach Patrol Chief really understand what is safety-related when it comes to surfing? It is disheartening to not find good waves at 2nd Avenue; now I must travel to Wildwood Crest. The change of surfing beaches is a disservice to all locals in North Wildwood. The Beach Patrol should have all citizens in mind, not just the sunbathers.
MIKE EMERS, 11th Avenue, stated that if the Inlet beaches are getting bigger, then why not move the swimmers and sunbathers there instead of the surfers? Maybe the 12th Avenue surf beach could just be closed on the busiest weekends.
DEBBIE MEDERNACH, 11th & JFK, stated that recommendations have been made such as rotating the schedule, or eliminating the surfing on holiday weekends, etc. The City did not think about the surfers, only the sunbathers and the swimmers. There are too many safety issues at the 2nd Avenue surf beach. Please consider a solution that will please everyone. Also, the hot dog vendor at 12 & JFK is blocking the walkway with his hot dog cart. He needs to move to allow access to the walkway.
MAYOR ROSENELLO stated that the Police Department will address that problem.
