Money laundering

From the State Police, during 2014, regarding the criminal offence of “Criminal proceeds of crime or criminal activity”, Article 287 of the Criminal Code in total, there have been identified: 205 cases with 265 offenders.



Compared with the same period of the last year the amount seized for the criminal offence of “Criminal proceeds of crime or criminal activity”, there have been identified 120 criminal offences more, with 158 offenders more.
During the period, September 1- 31 March 2015, for the criminal offence of “Criminal proceeds of crime or criminal activity”, Article 287 of the Criminal Code in total, there have been identified: 156 cases with 228 offenders.
Compared with the same period of the last year, the amount seized for the criminal offence of “Laundering of Criminal proceeds of crime or criminal activity”, there have been identified 102 criminal offences more, with 157 offenders more.
The annual statistical data show that the Prosecution Office for Serious Crimes in 2014 has registered 13 criminal proceedings for Section 333/a, "Structured criminal group", by pressing charges to 38 defendants, while two prosecutions with 13 defendants were sent for trial.

The State Police has referred in total 54 cases for THB, 2 cases more compared to 2013:



  • 9 cases for “Trafficking in minors” Art. 128/b of CC; and

  • 45 cases for “Trafficking in persons” Art. 110/a of CC.




  • Data on convictions for 2014

During 2014, 11 new cases were tried by the Serious Crimes Court of First Instance (SCFI) compared to no cases in 2013 for THB.



  • 5 cases for the offense of “Trafficking of adult persons” – Art. 110/a/4 of CC

  • 1 case for the offense of “Trafficking of adult persons” – Art. 110/a/2 of CC

  • 4 cases for the offense of “Trafficking of minors” – Art. 128/b/3 of CC

  • 1 case for the offense of “Trafficking of minors” – Art. 128/b/1 of CC

Whilst 3 cases were carried over from previous years, out of which:



  • 1 case for “Trafficking of adult persons” – Art. 110/a of CC

  • 1 case for “Trafficking of women” – Art. 114/b/3 of CC

  • 1 case for “Exploitation of prostitution under aggravating circumstances”- Art. 114/a/5 of CC, which was overturned by court of appeals.

During 2014, in total 9 defendants were convicted for THB and other crimes related to THB, of whom 2 defendants were convicted for 2 crimes at the same time, 1 person for exploitation of prostitution under aggravating circumstances and trafficking of minors with 11 years and 4 months of imprisonment, and 1 person for trafficking of adult persons and trafficking of minors convicted with 12 -years of imprisonment. Whilst, for 1 other defendant charged with trafficking of minors cases is still under trial.


24.5 Fight against terrorism
Albanian State Police (ASP) has drafted a national strategy on prevention of extremism and terrorism which involves, law enforcement agencies, civil society organisations, religious communities, and the media. This document will be soon submitted for endorsement to the competent authorities.
From September 01, 2014 to 31 March 2015, the structures of the antiterrorist acts at GDSP and Serious Crime Prosecution Office have increased their cooperation in prosecution of the criminal offences.
Also, for some specific issues, cooperation of domestic intelligence with antiterrorist Directorate of Kosovo Police has increased especially in the exchange of information in time and joint operations for controlling and arrests of citizens involved in criminal activities. The Security Council lists for individuals and groups supporting terrorism have also been updated.
During the period 01.09.2014 - 31.03.2015 relating with the activities of antiterrorism, can be mentioned the following cases:

  • 2 operations, on behalf of Egypt and Italy, for the capture of 2 internationally declared wanted persons for terrorism;

  • 1 operation against groups intending to commit terrorist acts, where 5 people were detained / arrested and 2 others were declared wanted.

Given the current situation and, the growing concerns of the recruitment of the Albanian citizens who engage in military formations or groups of armed units in several countries in conflict, the Ministry of Internal Affairs proposed introduction of several new offenses in the Criminal Code.


These amendments were adopted with Law No. 98/2014 " and they are as follows:


  • Participation in military actions in one foreign country, Article 265 / a.

  • Organization for the participation in military actions in one foreign country, Article 265 / b

  • Call for participation in violent military action in one foreign country, article 265 / c.

By order of the Ministry of Internal Affairs No. 548/7 dated 17.10.2014 Antiterrorism Directorate was created. It tasks include:



  • Increasing the capacity of human resources and logistical means;

  • Defining the work object based on the trends, object of the work of anti-terror structures

  • Cooperation with SIS, through a coordinator

  • Qualified staff in the fight against terrorism.

The mission of this structure is to decrease at lowest levels the risk of terrorism related to the country and its interest, by providing the improvement of the security elements and to build trust in the community on preventive measures against the terrorist acts.

During this period the following took place:



  • 31 operations with the use of special investigative techniques.

  • 21 criminal groups dealing with distribution and trafficking of narcotics (a total of 97 persons prosecuted) were dismantled;

  • 20 operations involving various forms of international cooperation (with Italy, Greece, Kosovo, Germany, Switzerland).

One of the most important operations is the codenamed “Xibraka”, took place in January 2015 (in cooperation with German authorities). As a result 19.4 kg of pure cocaine, 97.6 kg of mixed cocaine, 321950 EURO as well as firearms were seized.


In the period September 1, 2014-31 March 2015, the State Police identified 107 cases of cultivation of narcotics plants, detected 27, 43 offenders identified, 32 were arrested, 4 prosecuted while free and 7 people declared wanted. A total of 41.534 narcotics plants and cannabis sativa were destroyed.

During the period January -31 March 2015, the following measures were taken:



  • General Director of the State Police adopted the Action Plan No. 1535, dated 09.03.2015, "On the prevention and fight against the criminal activity of cultivation of narcotics during the Year 2015";

  • Telegram No. 11584, dated 09.03.2015 “On greenhouses controls for the prevention of the cultivation of the narcotics plants cannabis sativa” was sent to the Regional Police Directorates;

  • Note No. 1625/1, dated 23.03.2015 “On the initiation of the operational measures on the control of greenhouses for the cultivation of narcotic plants” was sent to the Regional Police Directorates.

Also:


  • 1,780 greenhouses in national level were controlled;

  • 4 self-awareness activities were carried out;

  • 559 police employees were engaged on service;

  • 2 police operations were implemented.


24.7 Judicial cooperation in criminal and civil cases
During the reporting period, there has been increase of cooperation between the Prosecution Office and their counterparts in the neighboring countries as well as the EU Member States and of the United States of America.

The cooperation of the General Prosecution Office and the Interpol National Central Office Tirana was particularly fruitful, in relation to operations focusing the prevention of crimes against life and health, as well as the capture of criminal organizations dealing with drug trafficking and exploitation of prostitution.

CHAPTER 25: SCIENCE AND RESEARCH


Key achievements
In order to address the obligations stemming from Article 109 of the SAA, the Ministry of Education and Sport (MES) and the Agency for Research, Technology and Innovation (ARTI) have taken further actions to stimulate research and innovation. To implement short-term priorities of the National Plan for European Integration 2014 – 2020 (NPEI), the MES and the ARTI have focused on the promotion of the EU’s research framework programme Horizon 2020. Furthermore, the ARTI participated in the drafting of various project proposals to be submitted to the Horizon 2020 programme.
Status of legal harmonization
Currently, the ARTI is continuing work on the National Strategy for Scientific Research 2016-2020, to implement the NPEI 2014 – 2020. Along the same lines, the ARTI concluded work on the fund for “National Projects for Research and Development 2010-2014”.

Institutional framework
During the reporting period, the ARTI worked with universities and Albanian scientific research institutions64 on the signature of the European Chart for Researchers and Code of Conduct for Recruitment of Researches. So far, 13 universities and scientific research institutions have signed the abovementioned documents.
Following the implementation of the Agreement of Scientific and Technologic Cooperation between the Republic of Albania and the Republic of Austria, the Joint Commission evaluated the first call for project proposals and enabled mobility funding for 10 cooperation projects. The latter projects will have a time span from 1 January 2015 to 31 December 2016.
On 22 December 2014, the ARTI successfully re-vitalized a research and technological cooperation with the Scientific and Technological Research Council of Turkey (Tubitak). The cooperation aims at generating new research, stresses a multidisciplinary approach and includes any field of study. This cooperation is based in an inter-state agreement between Albania and Turkey in 2011, which was not previously implemented. Calls for proposals were opened in December 2014 and were successfully closed on March 20, 2015.
Economic and social aspects
During the September 2014 – April 2015 period, the Agency for Research, Technology and Innovation (ARTI) and the Ministry of Education and Sport (MES) in cooperation with several universities and scientific research institutions organized 24 trainings to increase participation in the EU framework programme, Horizon 2020. In order to promote cooperation between private and public universities65 information exchange was organized during the Horizon 2020 Informative Days and contact points were set up with the Centers for Transfer of Agricultural Technology in Fushe Kruje and Vore.
During the reporting period, the ARTI organized trainings on the Horizon 2020 application procedure and its new calls for application aimed at universities and research centers. The latter activities took place at the Epoka University on 27.3.2015, the Aldent University on 18.2.2015, the Faculty of Veterinary Medicine on 17.2.2015, the Metropolitan University on 28.1.2015, the Luigj Gurakuqi University of Shkoder on 20.1.2015, and the European University of Tirana on 16.1.2015.
The ARTI and the MES also carried out bi-lateral programmes with Slovenia, Turkey and Austria on science and scientific research.
In order to support research and development, the ARTI is establishing a national database for the research infrastructure possessed by universities and scientific institutions.
Meanwhile, the ARTI is working to the implementation of the Euraxess project. In order to assure effective implementation of this project in Albania, a steering group is established with representatives from the MES, the Ministry of Economic Development, Trade and Entrepreneurship, the Ministry of Foreign Affairs, the Ministry of European Integration, the Academy of Science and representatives of research community, This group will serve as advisory board and a tool to increase efficient implementation of the law. During the reporting period, the ARTI continued its project presentation efforts through informative days and trainings in universities and scientific institutions.
On 2 March 2015, the ARTI initiated the Euraxess T.O.P. III project that is a continuation of the viability of Euraxess project. Within the framework of the Euraxess T.O.P. III project, the ARTI is tasked with gathering statistics on the establishment of a database for on researchers in the diaspora.
